Today the Supreme Court will be facing a transfer petition, originally filed by the NHRC, on the Godhra case. The NHRC and Citizens for Justice and Peace, who have also filed an affidavit and independent petition, are calling for a transfer of the case outside of Gujarat:
The basic argument of the petitioner is that, for fair play, this case along with the 11 major cases be transferred outside Gujarat. Besides questioning the application of POTA (the Gujarat government notification that would make it effective came one day after the tragedy), the petition points out that false evidence has been gathered by the prosecution against the accused, which has led to the false implication of persons who have no involvement in the crime. It also points out the absent statements of 42 passengers who travelled in the ill-fated Sabarmati express and sustained injuries.
