{"id":200,"date":"2007-04-02T11:43:47","date_gmt":"2007-04-02T15:43:47","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/ugasser\/2007\/04\/02\/law-economics-and-business-of-ipr-in-"},"modified":"2007-05-19T16:27:51","modified_gmt":"2007-05-19T20:27:51","slug":"law-economics-and-business-of-ipr-in-the-digital-age-st-gallen-curr","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ugasser\/2007\/04\/02\/law-economics-and-business-of-ipr-in-the-digital-age-st-gallen-curr\/","title":{"rendered":"Law, Economics, and Business of IPR in the Digital Age: St. Gallen Curriculum (with help from Berkman)"},"content":{"rendered":"<p>The <a href=\"http:\/\/www.unisg.ch\/hsgweb.nsf\/wwwPubhomepage\/webhomepageeng?opendocument\">University of St. Gallen<\/a> has been the first Swiss university that has implemented the principles and standards set forth in the so-called <a href=\"http:\/\/ec.europa.eu\/education\/policies\/educ\/bologna\/bologna.pdf\">Bologna Declaration<\/a> aimed at harmonizing the European Higher Education System (more on the Bologna process <a href=\"http:\/\/ec.europa.eu\/education\/policies\/educ\/bologna\/bologna_en.html\">here<\/a>.) As a result, the St. Gallen law school offers two Master programs for J.D. students: <a href=\"http:\/\/www.studies.unisg.ch\/org\/lehre\/soe.nsf\/wwwPubInhalteEng\/Master+in+Legal+Studies?opendocument\">Master of Arts in Legal Studies<\/a>, and <a href=\"http:\/\/www.mle.unisg.ch\/\">Master of Arts in Law and Economics<\/a>.<\/p>\n<p>Recently, I have been heavily involved in the <a href=\"http:\/\/www.studium.unisg.ch\/org\/lehre\/files.nsf\/SysWebRessources\/MS_MLE_Kurzbroschuere\/$FILE\/MLE_Kurzbroschuere.pdf\">law and economics program<\/a> (I should mention that St. Gallen doesn\u2019t follow the rather traditional approach to law and economics that is predominant among U.S. law schools. Today is a special day for the program&#8217;s faculty and staff, because the first generation of students enters the final 10th semester of the Bologna-compatible Master program. Arguably, this 10th semester is rather unique as far as structure and content is concerned. Instead of providing the usual selection of courses for graduate students, we have designed what we call an \u201cintegrating semester\u201d in which all students are required to take three (but only three) full-semester courses aimed at \u201cintegrating\u201d the knowledge, skills, and methods they have acquired over the past few years. All three seminars \u2013 together worth 30 credits \u2013 are designed and taught by an interdisciplinary group of faculty members from the University of St. Gallen and beyond, including legal scholars, economists, business school profs, technologists, etc. The first seminar, led by Professor <a href=\"http:\/\/www.nobel-hug.ch\/e\/team\/\">Peter Nobel<\/a>, <a href=\"http:\/\/www.aca.unisg.ch\/org\/aca\/acaweb.nsf\/wwwPubPersonGer\/DFAFFA01E9E0F917412569AD0061BDA1\">Thomas Berndt<\/a>, <a href=\"http:\/\/www.mcm.unisg.ch\/content\/view\/34\/166\/lang,de\/\">Miriam Meckel<\/a> and <a href=\"http:\/\/www.nastra.ch\/nastra\/lawyer.php?id=19&amp;lng=e\">Markus Ruffner<\/a>, is entitled Law and Economics of Enterprises and deals with risk and risk management of multinational corporations.  The second seminar, led by Professor <a href=\"http:\/\/www.mcm.unisg.ch\/content\/view\/33\/166\/lang,de\/\">Beat Schmid<\/a> and me, concerns legal, economic, and business aspects of intellectual property rights in the digital age. Professors <a href=\"http:\/\/www.siaw.unisg.ch\/org\/siaw\/web.nsf\/d638de4e02e667cac12568f0002661cf\/557dbbc990af990fc1256a1e003a28a1?OpenDocument\">Hauser<\/a>, <a href=\"http:\/\/www.iff.unisg.ch\/org\/iff\/iffweb.nsf\/wwwPubMitarbeiterGer\/waldburger+robert\">Waldburger<\/a>, and <a href=\"http:\/\/www.rwa.unisg.ch\/org\/rwa\/web.nsf\/wwwPubPersonGer\/van%20Aaken+Anne?opendocument\">van Aaken<\/a>, finally, are teaching the third seminar entitled Law and Economics of Globalization, addressing issues such as world market integration of low-income countries, foreign investments, global taxation, and regulation of multinational enterprises.<\/p>\n<p>My seminar on law and economics of IPR in the digital age starts with a discussion of basic concepts of economic analysis of intellectual property law and a stock-taking of the main IPR-problems associated with the shift from an analog\/offline to a digital\/online environment. It then follows a module in which we will explore three key topics in greater detail: digital copyright, software and business methods patents, and trademarks\/domain names. Towards the end of the semester, we will then try to tie all the elements together and develop a cross-sectional framework for economic analysis and assessment of IPR-related questions in the digitally networked environment. In this context, we will also be visiting the <a href=\"http:\/\/www.ige.ch\/defaulte.htm\">Swiss Federal Institute of Intellectual Property<\/a> (in charge, among other things, with working on IP legislation in Switzerland), where we will discuss the promises and limits of economic analysis of IP law with the Institute\u2019s senior legal advisor and the senior economic advisors.<\/p>\n<p>Clearly, we have a very ambitious semester ahead. I\u2019m particularly thrilled that a wonderful group of colleagues from Europe and abroad is helping me to do the heavy lifting (of course, my wonderful St. Gallen team <a href=\"http:\/\/www.fir.unisg.ch\/org\/fir\/web.nsf\/d638de4e02e667cac12568f0002661cf\/8da3aeed66155355c12570740028ac95?OpenDocument\">is<\/a> <a href=\"http:\/\/www.fir.unisg.ch\/org\/fir\/web.nsf\/d638de4e02e667cac12568f0002661cf\/a64a98c866c66cdbc1257074004689ff?OpenDocument\">very<\/a> <a href=\"http:\/\/www.fir.unisg.ch\/org\/fir\/web.nsf\/d638de4e02e667cac12568f0002661cf\/a9956839310bad1cc125707400379aed?OpenDocument\">involved<\/a>, too, as usual.). My colleague and friend <a href=\"http:\/\/cyber.law.harvard.edu\/people\/jpalfrey.html\">John Palfrey<\/a>, Clinical Professor of Law at Harvard Law School, the Berkman Center&#8217;s executive director, and member of the board of our St. Gallen <a href=\"http:\/\/www.fir.unisg.ch\/org\/fir\/web.nsf\/wwwPubhomepage\/webhomepageeng?opendocument\">Research Center for Information Law<\/a>, will be discussing with us thorny digital copyright issues and future scenarios of digital media. <a href=\"http:\/\/www.wilmerhale.com\/klaus_schubert\/\">Klaus Schubert<\/a>, partner of WilmerHale Berlin, will be guiding us through the software patents and business methods patents discussion. Last but not least, Professor <a href=\"http:\/\/www.ipphil.com\/\">Philippe Gillieron<\/a> from the University of Lausanne will be speaking about trademark law in the digital age, focusing on domain name disputes.<\/p>\n<p>All sessions are (hopefully) highly interactive.  The students will contribute, among other things, with discussion papers, term papers, group presentations, and will participate in mock trials (one on Google\u2019s recent copyright case in Europe), Oxford debates, and the like.
