{"id":105,"date":"2005-08-17T17:41:24","date_gmt":"2005-08-17T21:41:24","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/sweetpea\/2005\/08\/17\/more-motions\/"},"modified":"2006-04-28T11:43:45","modified_gmt":"2006-04-28T18:43:45","slug":"more-motions","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/sweetpea\/2005\/08\/17\/more-motions\/","title":{"rendered":"More Motions"},"content":{"rendered":"<p><a name=\"a305\"><\/a><\/p>\n<p>First, we won an important motion I wrote last month.\u00a0 Yay!\u00a0 (Writing the motion itself wasn&#8217;t bad.\u00a0 I sweated blood over the reply though.)\u00a0 Second, I almost had to argue a small motion before the court next week.*\u00a0 Boo!\u00a0 (See below.)\u00a0<\/p>\n<p>SP:\u00a0\u00a0I was thinking, why not have you argue this motion?<\/p>\n<p>Me:\u00a0 &#8212;-<\/p>\n<p>SP:\u00a0 Y.?\u00a0<\/p>\n<p>Me:\u00a0 Seriously?\u00a0 You want me to argue it?\u00a0<\/p>\n<p>SP:\u00a0 Yes.<\/p>\n<p>Me:\u00a0 Um, do I have to?\u00a0 [You can tell, I&#8217;m super ambitious, right?]<\/p>\n<p>SP:\u00a0 No darling [she calls everyone darling &#8211; it&#8217;s really cute], you don&#8217;t have to at all.\u00a0 I could easily argue it.\u00a0 I just thought it would be a great learning experience for you.<\/p>\n<p>Me:\u00a0 Cause I don&#8217;t wanna.\u00a0<\/p>\n<p>SP:\u00a0 Okay.<\/p>\n<p>Me:\u00a0 Although&#8230;I guess I should, shouldn&#8217;t I?\u00a0 I&#8217;ll have to sooner or later.<\/p>\n<p>SP:\u00a0 Wonderful.\u00a0 It&#8217;ll be terrifying, but you will do great.\u00a0<\/p>\n<p>Me:\u00a0\u00a0 &#8212;-<\/p>\n<p>As it turns out, I&#8217;m not going to after all because, as\u00a0several people\u00a0pointed out,\u00a0it makes more sense for SP to argue it (given the context of the motion).\u00a0 I&#8217;m not sure whether to be disappointed or highly relieved.\u00a0 At the moment, I&#8217;m leaning towards relieved.<\/p>\n<p>Off to Arizona tomorrow.\u00a0 Back next week!\u00a0<\/p>\n<p>*Before the trial, the court (usually a different department than the one where the trial will be conducted) holds hearings to address various motions that are brought before it.\u00a0 These motions can include things like asking the court to:\u00a0 transfer the case to another court, compel the other party to produce documents or respond to questions,\u00a0exclude evidence at trial, etc.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>First, we won an important motion I wrote last month.\u00a0 Yay!\u00a0 (Writing the motion itself wasn&#8217;t bad.\u00a0 I sweated blood over the reply though.)\u00a0 Second, I almost had to argue a small motion before the court next week.*\u00a0 Boo!\u00a0 (See below.)\u00a0 SP:\u00a0\u00a0I was thinking, why not have you argue this motion?
