Both Senator Durbin and Leahy have said their confirmation votes depend upon Mukasey&#8217;s answers concerning waterboarding.\u00a0 All ten Democrats on the <a href=\"http:\/\/www.talkingpointsmemo.com\/docs\/mukasey-waterboarding\/?resultpage=1&amp;\">Senate Judiciary Committee recently sent a letter to Mukasey asking him to answer whether waterboarding was illegal under U.S. law, including treaty obligations<\/a>.\u00a0 Other Senators, including Republicans such as Arlen Specter, are reportedly troubled too.  <a href=\"http:\/\/specter.senate.gov\/public\/index.cfm?FuseAction=Files.View&amp;FileStore_id=0ca3cb6c-1d62-4fb9-9e1e-459bb94e2a4a\">Senator Specter also wrote Mukasey a letter<\/a> asking for responses on a number of issues, including waterboarding.<\/p>\n<p>Meanwhile, the legal ignorance appears to be contagious.  <a href=\"http:\/\/www.nytimes.com\/2007\/10\/25\/us\/politics\/25torture.html?ref=politics\">Rudy Giuliani now says he doesn&#8217;t know whether waterboarding is torture<\/a>, claiming &#8220;it depends on who does it,&#8221; among other astounding qualifications.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The associated press is now reporting (Oct. 25) that Mukasey&#8217;s confirmation is uncertain.
