At the main webpage of its <a href=\"http:\/\/www.halt.org\/reform_projects\/small_claims\/\">Small Claims Reform Project<\/a>, HALT\u00a0states that small claims courts &#8220;have tremendous promise as a means of empowering ordinary people to take charge of their own routine legal needs,&#8221;\u00a0and that\u00a0significant increases in dollar limits &#8220;would be the most meaningful reform to increase consumer access to the small claims courts.&#8221;\u00a0 HALT has a national campaign to increase the dollar amounts, and would like to see $20,000 case limits.\u00a0 Unfortunately, consumers in most states still face limits of $5000 or less.\u00a0 [Find out the small claims rules and dollar limits in your state, <a href=\"http:\/\/www.halt.org\/lic\/art.php?aid=76\">at this<\/a> HALT page.]\u00a0<\/p>\n<p>\u00a0<img loading=\"lazy\" decoding=\"async\" height=\"54\" alt=\"doorFront\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2007\/02\/doorFront.jpg\" width=\"20\" \/> Back in August 2000, long before launching <em>shlep<\/em>, I wrote &#8220;<em>Supersize Small Claims<\/em>&#8221;\u00a0for the now-defunct <em>PrairieLaw<\/em>.com.\u00a0[reproduced\u00a0at <em>Crime &amp; Federalism<\/em>, as part of the guest post <em>&#8220;<\/em>fedLabs 101: <a href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2005\/01\/fedlabs_101_sma.html\">small claims, big potential<\/a>&#8220;] The article asserts that &#8220;[Our lawmakers could give a big chunk of the civil justice system back to the people by simply increasing the dollar limits allowed in small claims courts.\u201d\u00a0 And, the <em>C&amp;F<\/em> post preaches:<\/p>\n<blockquote><p>Do you want to give power back to individuals?\u00a0 Would you prefer to do so on a broad scale, at the local level, and without waiting for federal constitutional amendments, programs or court precedent?\u00a0\u00a0 Whether you&#8217;re a liberal or libertarian, a lawyer, legislator or law student, I have a suggestion: start working to increase the dollar limits in small claims courts in your state.\u00a0 I can&#8217;t think of anything that could so quickly, and at so little cost, increase access to justice &#8212; especially, if coupled with other modest reforms that have been shown to work well in several states (e.g., from adopting Plain English forms and evening hours, to exploiting digital technology &#8212; as with <a href=\"http:\/\/www.courtinfo.ca.gov\/selfhelp\/smallclaims\/\">California&#8217;s Small Claims Self-Help Center<\/a>).<\/p><\/blockquote>\n<p>The newest <em><a href=\"http:\/\/www.halt.org\/ejournal\/\">HALT eJournal<\/a><\/em> (<a href=\"http:\/\/www.halt.org\/newsletters\/03_12_2007.htm\">March 12, 2007<\/a>) reminded me today of this prior advocacy and of the continued need for ATJ advocates and all citizens to lobby for more effective small claims courts.\u00a0 The main\u00a0piece in HALT&#8217;s <a href=\"http:\/\/www.halt.org\/newsletters\/03_12_2007.htm\">March 12 <em>eJournal<\/em><\/a> focuses on bills pending in four states that would increase the small claims dollar limits:<\/p>\n<ul>\n<li><strong>New Hampshire<\/strong>: Senate Bill 32-FN, introducted by Sen. Joseph Foster would increase the state&#8217;s small claims dollar limit <em>from $5,000 to $10,000<\/em>.\u00a0<\/li>\n<li><strong><img loading=\"lazy\" decoding=\"async\" height=\"28\" alt=\"graphClimbS\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2007\/03\/graphClimbS.jpg\" width=\"35\" \/><\/strong>\u00a0<strong>\u00a0Kentucky<\/strong>: House Bill 198 was introduced by Rep. Tom Burch in January,\u00a0would increase the state&#8217;s small claims dollar limit <em>from\u00a0a miserly $1,500 to a paltry $3,000.<\/em>\u00a0 [If you live in Kentucky, please press hard for evern higher limits.]<\/li>\n<li><strong>Michigan<\/strong>:\u00a0Representative John Pastor reintroduced Michigan House Bill 4160, which would increase the small claims dollar limit from $5,000 to $7,500.\u00a0<\/li>\n<li><strong>Oregon<\/strong>: House Bill 2316 has passed and would increase the state&#8217;s small claims dollar limit from $5,000 to $7,500.\u00a0 It is now awaiting a reading in the Senate&#8217;s Judiciary Committee.\u00a0 A little legislative jawboning would sure help.<\/li>\n<\/ul>\n<p>Self-helpers don&#8217;t need any further nudging to contact their state legislators.\u00a0 Or, do they?<\/p>\n<blockquote><p><strong><img loading=\"lazy\" decoding=\"async\" height=\"30\" alt=\"ProfPointer\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2007\/02\/pointerDudeNegF.gif\" width=\"40\" \/><\/strong>\u00a0 <strong>p.s.<\/strong>\u00a0 I can&#8217;t promise you more access to legal justice, but I can assure you better, timely access to law-related commentary, if you head every Monday to both\u00a0<em><a href=\"http:\/\/blawgreview.blogspot.com\/\">Blawg Review<\/a><\/em> and the\u00a0<em><a href=\"http:\/\/timkevan.blogspot.com\/2007\/03\/weekly-review_11.html\">The Barrister Blog<\/a><\/em>&#8216;s Weekly Review.\u00a0 Today&#8217;s <a href=\"http:\/\/www.beggingtodiffer.com\/2007\/03\/12\/blawg-review-99\">Blawg Review #99<\/a> is hosted by Matt Barr at <em>Begging to Differ<\/em>.\u00a0 Our thanks to Matt for listing <em>shlep<\/em>&#8216;s post last week on <a href=\"http:\/\/blogs.law.harvard.edu\/shlep\/2007\/03\/09\/family-law-civil-gideon-are-free-lawyers-always-the-best-approach\/\">Family Court Civil Gideon<\/a>.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>\u00a0\u00a0\u00a0\u00a0 Both HALT and shlep believe that increasing the dollar limits at Small Claims courts is a most-promising strategy for\u00a0achieving broader access to justice in the United States.
