Santa Claus<\/strong><\/a><\/em>, Dec. 12, 2005.\u00a0\u00a0Nonetheless, in the true spirit of the Season, he offers this self-help advice to those caught up &#8212; intentionally or not &#8212; in the Christmas shopping frenzy and other schmoliday customs.<\/p><\/blockquote>\n<p>In the normal course of the English Language, the term <a href=\"http:\/\/dictionary.reference.com\/search?r=2&amp;q=Black%20Friday\"><strong><em>Black Friday<\/em><\/strong><\/a> would refer to a Friday infamous for financial market disaster\u00a0(<em>viz.<\/em> Sept. 24, 1869) or for other forms of social calamity.\u00a0 In the United States, as you surely know, it has also come to signify the Day After Thanksgiving.\u00a0 It is deemed either the &#8220;official&#8221; or &#8220;<em>un<\/em>official&#8221; start of the Christmas-Holiday Shopping Season, and designated &#8220;Black&#8221; to refer to the day that retailers can (hopefully) stop recording losses in red ink in their account books, and can instead start to show profits\u00a0in black ink.\u00a0(see <em>CBCNews<\/em>\/AP, &#8220;<a href=\"http:\/\/www.cbc.ca\/money\/story\/2006\/11\/24\/usholidayshoppin.html\">U.S. Shoppers Hit Stores on &#8216;Black Friday&#8217;<\/a>,&#8221; Nov. 24, 2006)<\/p>\n<p>Some shoppers are up early for Black Friday, or never go to bed, envigorated by the thrill of the chase\u00a0for bargains.\u00a0(<em>e.g<\/em>., <em>AZCentral.com<\/em>, &#8220;<a href=\"http:\/\/www.azcentral.com\/arizonarepublic\/local\/articles\/1125blackfriday1125.html\">In Search of a Deal<\/a>,&#8221; Nov. 25, 2006)\u00a0Yet,\u00a0Black Friday can also be a day filled with stress\u00a0and confrontation (<em>New York Times<\/em>, &#8220;<a href=\"http:\/\/www.nytimes.com\/2006\/11\/25\/business\/25shop.html?ei=5090&amp;en=3b12a854964d3445&amp;ex=1322110800&amp;partner=rssuserland&amp;emc=rss&amp;pagewanted=all\">Attention Holiday Shoppers: We Have Fisticuffs in Aisle 2<\/a>,&#8221; Nov. 25, 2006), and begin a season of true financial disaster for millions of American consumers.\u00a0<\/p>\n<p><a href=\"http:\/\/www.sundayschoollessons.com\/lent3kles.htm\"><em><font face=\"Arial\" color=\"#336699\" size=\"2\">orig<\/font><\/em><\/a><font face=\"Arial\" size=\"2\">.<\/font>\u00a0<img loading=\"lazy\" decoding=\"async\" height=\"77\" alt=\"JesusMoneyChangers\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2006\/11\/JesusMoneychangers.gif\" width=\"120\" \/>\u00a0<\/p>\n<p><em>shlep<\/em>\u00a0may not be able to keep you from busting your budget, or mistaking massive gift-giving\u00a0for the manifestation of love and affection, but we hope to help you avoid getting scammed\u00a0or suffering\u00a0other shopping and holiday pitfalls, and to help you find solutions or legal remedies, if you&#8217;re victimized by the dishonest or unscrupulous.\u00a0 As the wise self-helper knows: the best way to &#8220;solve&#8221; a legal problem is to prevent it in the first place; and, prevention often means knowing your rights and\/or acting with common sense.\u00a0 The follow links and resources should assist you in those goals (if only by keeping you and your credit card occupied instead of shopping).<!--more--><\/p>\n<p><img loading=\"lazy\" decoding=\"async\" height=\"46\" alt=\"NoloLogo\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2006\/11\/NoloLogo.gif\" width=\"60\" \/>\u00a01) As usual, <em>Nolo.com<\/em> offers useful advice. Remember also, most (but not all) platinum and gold credit cards double the manufacturer&#8217;s warranty up to an additional year for free. Check with your bank before shopping. <\/font><em>&#8220;<\/em><\/p>\n<p><em><img loading=\"lazy\" decoding=\"async\" height=\"63\" alt=\"MrConsumerBlog\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2006\/11\/MrConsumerBlog.gif\" width=\"50\" \/>\u00a0 6) <\/em><a href=\"http:\/\/www.consumerworld.org\/\"><em><strong>Consumer World<\/strong><\/em><\/a>: We strongly recommend the website <em>Consumer World<\/em> for anyone who wants to be a smart consumer.\u00a0 It is &#8220;a public service, non-commercial guide with over 2000 of the most useful consumer resources.&#8221;\u00a0 This is a most valuable\u00a0place to go\u00a0for news, opinion, advice and warnings, links to myriad resouces (including a very good <a href=\"http:\/\/www.consumerworld.org\/pages\/legal.htm\">Legal Resources page<\/a>), and many ways to find bargains, obtain discounts,\u00a0and compare prices.\u00a0 Those who like to receive their information in a weblog format, you can go to <em>Consumer World<\/em>&#8216;s affiliate, <strong><a href=\"http:\/\/www.mrconsumer.com\/\"><em>MrConsumer Blog<\/em><\/a><\/strong>, which &#8220;updates <em>Consumer World<\/em> daily with the latest consumer news, commentary and bargains.&#8221;<\/p>\n<p>The above links and resources won&#8217;t assure you a\u00a0Happy Holiday Season, but they can surely help you avoid some headaches and\u00a0shopper&#8217;s remorse. \u00a0<\/p>\n<p><em>update <\/em>(Nov. 28, 2006): In an editorial titled &#8220;<a href=\"http:\/\/www.nytimes.com\/2006\/11\/28\/opinion\/28tue4.html?ex=1322370000&amp;en=fe2c267f7a1d25ce&amp;ei=5090&amp;partner=rssuserland&amp;emc=rss\">Holiday Defenses Breached<\/a>,&#8221; the <em>New York Times<\/em> complained today that, with CompUSA\u00a0launching an event at 9 PM on\u00a0Thanksgiving Day itself,\u00a0holiday shopping frenzy has even gone beyond Black Friday midnight-madness sales. \u00a0\u00a0&#8220;Looking back on the holiday weekend past, we\u2019re still haunted by those television reports from the malls of America. The images of hordes of shoppers re-enacting the Vandal sack of Rome were bad enough. Much worse was the realization that the start of the Christmas shopping season has crashed through the invisible barrier of Thanksgiving Day.&#8221;\u00a0 The editorial\u00a0worries that &#8220;Soon it could all end in a hostile bid to merge Christmas and back-to-school sales.&#8221;<\/p>\n<blockquote><p><em>p.s.<\/em>\u00a0 If you consume large amounts of information from law-related weblogs (or have planned to do so as soon as the task gets easier), <em>shlep<\/em> suggests that you check out Justicia&#8217;s <a href=\"http:\/\/www.blawgsearch.com\/\"><strong><em>BlawgSearch<\/em><\/strong><\/a>.\u00a0 The all-seeing Robert <a href=\"http:\/\/www.legaline.com\/2006\/11\/new-blawg-only-search-tool.html\">Ambrogi noted<\/a> at <em>his LawSites<\/em> weblog, when\u00a0<em>BlawgSearch<\/em> was launched on Nov. 15th, that the site already indexed over 600 lawyer weblogs and plans to add many more.
