brought me to June Maxam&#8217;s <em><strong><a href=\"http:\/\/www.northcountrygazette.org\/\">North Country Gazette<\/a><\/strong><\/em> this morning &#8212; my first stop there <a href=\"http:\/\/blogs.law.harvard.edu\/shlep\/2006\/10\/23\/whaddayaknow-about-fair-use-and-copyright\/\">since questioning<\/a>, in a series of postings last\u00a0month,\u00a0<em>NCG<\/em>&#8216;s claim that &#8220;Fair Use is not applicable&#8221; to the copyrighted material appearing at that site.\u00a0\u00a0The Nov. 21st\u00a0<a href=\"http:\/\/www.northcountrygazette.org\/articles\/112106DemeaningJudges.html\"><em>NCG<\/em>&#8216;s article<\/a> is about Florida Judge Cliff Barnes, who is representing himself before the State&#8217;s Judicial Qualifications Commission.\u00a0 The Barnes story is interesting, and concerns\u00a0public complaints he made about the conduct of other judges, local enforcement officers, and the public defender. \u00a0(Read more <a href=\"http:\/\/www.tcpalm.com\/tcp\/local_news\/article\/0,2545,TCP_16736_5096429,00.html\">here<\/a> and <a href=\"http:\/\/www.palmbeachpost.com\/localnews\/content\/local_news\/epaper\/2006\/10\/26\/1026slbarnes.html\">here<\/a>.)\u00a0 The judge seems more than capable of presenting his own case, so the story does not particularly deserve a lot of <em>shlep<\/em> attention.\u00a0<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" height=\"54\" alt=\"announcerR\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2006\/08\/announcerS.gif\" width=\"40\" \/>\u00a0What <em>is <\/em>worth noting, to update our readers and the record, is the current copyright notice at the end of the <em>North Country Gazette<\/em> article.\u00a0 \u00a0The broad claim of rights now ends with the words &#8220;This article is copyright protected&#8221; and <em>no longer\u00a0has the erroneous statement &#8220;Fair Use is not applicable.&#8221;<\/em>\u00a0\u00a0In addition, the\u00a0Home Page Sidebar no longer contains the wrongheaded prohibition against all reproduction &#8220;in accordance with Fair Use.&#8221;\u00a0\u00a0<\/p>\n<p>I&#8217;m not sure\u00a0when the changes were made, but the <a href=\"http:\/\/www.northcountrygazette.org\/articles\/111406HealthData.html\">oldest piece<\/a> linked to today&#8217;s front page, dated Nov. 14th, does have the corrected version.\u00a0\u00a0 (I checked only\u00a0<a href=\"http:\/\/www.northcountrygazette.org\/articles\/101906FreeLegalAdvice.html\">one article<\/a>, dated Oct. 19, 2006, to\u00a0see if older\u00a0<em>NCG<\/em> pieces\u00a0had also been amended.\u00a0 That article, which was a verbatim copy of a NYS court <a href=\"http:\/\/www.courts.state.ny.us\/press\/pr2006_20.shtml\">press release<\/a>,\u00a0continues to say\u00a0&#8220;This article is copyright protected and Fair Use is not applicable.&#8221;)\u00a0 This result &#8212;\u00a0ending the incorrect Fair Use Disclaimer &#8212; was my modest goal when I first approached the publisher of <em>NCG<\/em> and raised the topic at this weblog.\u00a0\u00a0 I&#8217;m thankful the misleading statement about the Fair Use doctrine is gone, as it did a disservice to readers of the <em>Gazette<\/em>.\u00a0 I&#8217;m also hopeful that my mentioning this good outcome won&#8217;t lead to its reversal, <a href=\"http:\/\/blogs.law.harvard.edu\/shlep\/2006\/10\/26\/its-back-maxam-again-claims-fair-use-is-not-applicable\/\">as happened<\/a>\u00a0after only one day last month.\u00a0\u00a0 We should applaud <em>The North Country Gazette<\/em> for changing its policy.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A Google News Alert for &#8220;pro se&#8221;
