{"id":298,"date":"2006-11-16T13:50:03","date_gmt":"2006-11-16T17:50:03","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/shlep\/2006\/11\/16\/pre-marital-living-together-agreements\/"},"modified":"2007-01-20T18:55:43","modified_gmt":"2007-01-20T22:55:43","slug":"pre-marital-living-together-agreements","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/shlep\/2006\/11\/16\/pre-marital-living-together-agreements\/","title":{"rendered":"pre-marital &amp; living-together agreements"},"content":{"rendered":"<p>Fans of <a href=\"http:\/\/en.wikipedia.org\/wiki\/Clint_Eastwood\">Clint Eastwood<\/a> (and\/or <a href=\"http:\/\/en.wikipedia.org\/wiki\/Sondra_Locke\">Sondra Locke<\/a>) will probably understand the meandering shlep that began for me last month by reading Forrest Carter&#8217;s Western classic <em>Gone to Texas<\/em>,\u00a0then found me\u00a0borrowing the dvd of <em><a href=\"http:\/\/en.wikipedia.org\/wiki\/The_Outlaw_Josey_Wales\">The Outlaw Josey Wales<\/a><\/em> from my local library over the weekend, and resulted in this posting on living-together and pre-nuptial agreements.\u00a0 (If the rest of you want to connect the dots, you&#8217;ll have to use your self-help skills\u00a0and click on the above links.)<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" height=\"81\" alt=\"JoseyWales\" src=\"http:\/\/blogs.law.harvard.edu\/shlep\/files\/2006\/11\/JoseyWales.jpg\" width=\"60\" \/>\u00a0Rather than gossip about Clint and Sondra, I&#8217;ll just say that they might have saved themselves a lot of grief and legal fees if they had entered into a Living Together Agreement prior to their breakup in 1988.\u00a0\u00a0 As <em>FreeAdvice<\/em>.com wisely <a href=\"http:\/\/family-law.freeadvice.com\/pre_marital_agreement\/living_together.htm\">notes<\/a> &#8220;safeguarding income and assets \u2013 and negotiating an agreement &#8212; in the event of termination of the relationship or death is far easier to accomplish when neither party is angry, under stress and\/or hostile.&#8221;\u00a0 Although <em>FindLaw for the Public<\/em>&#8216;s compilation of links to <a href=\"http:\/\/family.findlaw.com\/marriage\/marriage-laws\/state-marriage-laws.html\"><strong>Marriage and Living Together Laws in 50 States<\/strong><\/a>, is a must-see on this topic, most self-helpers would surely do themselves a favor by stopping first to read the extensive <a href=\"http:\/\/www.nolo.com\/resource.cfm\/catID\/3C3AF4CE-DB9E-48C4-8DFCFE2E47C91747\/118\/304\/145\/\"><strong>Nolo.com materials on Living Together<\/strong><\/a>.\u00a0<\/p>\n<p>While noting that a living-together agreement may not seem very romantic, Nolo nonetheless <a href=\"http:\/\/www.nolo.com\/article.cfm\/ObjectID\/E354BF5F-A357-40DA-BAF2A0F4093A8BE8\/catID\/3C3AF4CE-DB9E-48C4-8DFCFE2E47C91747\/118\/304\/145\/ART\/\">advises<\/a>: &#8220;Practically speaking, your agreement will help you avoid trouble when you mix your money and property, and it will make clear your intentions and expectations regarding property ownership, household expenses and the like. It can also greatly ease the division or distribution of property after a breakup or death. On a more personal note, the process of negotiating and drafting your agreement may well strengthen your abilities to communicate with and understand each other.&#8221;\u00a0 Nolo offers a <a href=\"http:\/\/www.nolo.com\/article.cfm\/ObjectID\/3BF049AF-27BA-48FB-84B2A56C8CE46BA6\/catID\/3C3AF4CE-DB9E-48C4-8DFCFE2E47C91747\/118\/304\/145\/FAQ\/\">Property Rights of Unmarried Couples href=\"http:\/\/www.abanet.org\/abastore\/index.cfm?section=main&amp;fm=Product.AddToCart&amp;pid=2350223\"><em>ABA Guide to Marriage, Divorce and Families<\/em><\/a> (256 pp, April 2006, $16.95) offers a free, 12-page\u00a0Sample Chapter online\u00a0covering <a href=\"http:\/\/www.abanet.org\/abastore\/index.cfm?section=main&amp;fm=Product.AddToCart&amp;pid=2350223\">Pre-marital Agreements<\/a>.\u00a0 After a good discussion of the concepts involved and issues that should be considered, the chapter\u00a0lists\u00a0a few additional resources, including <a href=\"http:\/\/family-law.freeadvice.com\/pre_marital_agreement\/\">FreeAdvice&#8217;s Pre-Marital Agreement page<\/a> (which has a lengthy Q&amp;A), and advice from <a href=\"http:\/\/www.equalityinmarriage.org\/bm.html\">The Equality in Marriage Institute<\/a>.\u00a0 <em>update<\/em> (Jan. 8, 2007):\u00a0 You can find a good <a of very useful articles and FAQs on the topic of Prenuptial Agreements, including the\u00a0<a href=\"http:\/\/www.acidplanet.com\/artist.asp?podcast=958|2&amp;t=9875\">podcast: Should You Use a Prenuptial Agreement?<\/a>\u00a0(May 2006, click for the <a href=\"http:\/\/nolopodcast.blogspot.com\/2006\/05\/prenuptial-agreements.html\">transcript<\/a>), which is an interview with You?<\/a>.\u00a0\u00a0 Readers should be quite interested in the unexpected answer to the question <a href=\"http:\/\/www.nolo.com\/article.cfm\/ObjectID\/AF54C75D-7A2C-47CC-A177A113AC881DBE\/catID\/BD0FF030-3064-4680-B419B66BA296767C\/118\/304\/247\/ART\/\">Do We Need a Lawyer to Make a Prenuptial Agreement?<\/a>: &#8220;It may sound surprising coming from advocates of self-help law, but yes, you do need a lawyer when making a prenuptial agreement.\u00a0 If you want to end up with a clear and binding premarital agreement, you should get help from a good lawyer. In fact, you will need two lawyers &#8212; one for each of you. Here&#8217;s why. . . &#8221;\u00a0 Despite that advice, authors Irving and Stoner make a very important related recommendation:<\/p>\n<blockquote><p>&#8220;That said, it&#8217;s best not to ask your lawyers to start writing up a draft or final agreement until the two of you have settled on its essential terms. You should put those terms in writing &#8212; either in a written outline or a draft agreement you create yourselves. A prenup prepared by a lawyer who isn&#8217;t working from terms you&#8217;ve both agreed on is likely to be one-sided and adversarial. If you provide your lawyers with an outline or draft prepared by both of you, the whole process &#8212; and the final document &#8212; will be more balanced.&#8221;\u00a0<font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\" \/><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\" \/><\/font><\/font><\/font><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\" \/><\/font><\/font><\/font><\/font><\/font><\/font><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\"><\/p>\n<div dir=\"ltr\" style=\"margin-right: 0px\"><font face=\"Arial\" size=\"2\">One of the best self-help strategies is the avoidance of problems through proper planning.\u00a0 The above resources should help thoughtful couples avoid a lot of legal headaches when they break up.\u00a0 <\/font><\/div>\n<p><em>afterthought<\/em> (Jan. 20, 2007): <a href=\"http:\/\/www.legalzoom.com\/\"><em>LegalZoom<\/em><\/a>.com, the web resource that allows you to create legal forms online (and reviews your answers and the forms before they are finalized), has <a href=\"http:\/\/www.legalzoom.com\/law_library\/pre-nuptials\/introduction.html\">information on pre-nuptial agreements<\/a>, to help you make informed decisions.\u00a0 The page that starts there <a href=\"http:\/\/www.legalzoom.com\/legalzip\/pre-nuptials\/prenup_procedure.html\">pre-nup procedure<\/a> notes: &#8220;<span>Filling out the Questionnaire is free.
