Letter from Munich – the Joseph Affair \u2013 70<\/strong><\/p>\n

Dear Mr. Graf, dear friends,<\/p>\n

\u201cI have here a another transcript of a judicial interrogation in the matter of the investigation into the cause of death of Joseph Abdulla,\u201d Francesca said. \u201cOn the first page of the transcript is the file number of the Dresden district court: 270 Gs 3141\/00 414 Js 53329\/00. This interrogation was conducted on 21 November 2000 at 10:00 a.m. Those present were District Court Judge Weidig, District Attorney Flockerzi, Detective Chief Superintendent Krebs, and a court stenographer.<\/p>\n

\u201cThe witness was Daniel Steiner, school pupil, born on 9 March 1985 in Sebnitz and now resident in Sebnitz.<\/p>\n

\u201cAt the beginning of the transcript there is an interesting answer to a question posed by the authorities. There had been other appointments for the interrogation that the witness missed. In answer to the question as to why he had not appeared, the boy stated, \u2018I didn\u2019t come for the other appointments because I was afraid of the right-wing people. My mommy is in the hospital now. I was alone in the house.\u2019<\/p>\n

\u201cIn response to a follow-up question, he answered, \u2018Some people who were there are part of the right-wing scene. If they find out \u2013 they know who I am, too.\u2019<\/p>\n

\u201cThen the transcript states \u2013 as is usual at the beginning of such documents \u2013 \u2018The witness was informed of the object of the investigation and the name of the accused. He was admonished to tell the truth . . . .\u2019<\/p>\n

\u201cWe will see,\u201d Francesca went on, \u201chow similar the things that happened to Daniel Steiner were to those that happened to Rene May, the first witness whose judicial and police transcripts I read to you. Before the district court, Daniel Steiner stated \u2013 in much the same way that Rene May stated it \u2013 \u2018A boy, Joseph Abdulla, was murdered there (in the swimming pool),\u2019 and then he described the murder. Some months later, however, after Daniel Steiner \u2013 like Rene May \u2013 had seen how the murderers and the other members of the right-wing scene in Sebnitz were running around free and threatening people, he started to tell a completely different story, just as Rene May did.\u201d<\/p>\n

Then Francesca began to read out the rest of the transcript:<\/p>\n

Concerning the object of the investigation: \u201cIt was 1997; I was twelve years old then. It was summer.\u201d<\/p>\n

In response to a question: \u201cI don\u2019t know the exact day any more.\u201d<\/p>\n

\u201cIn response to a question as to whether it was during the (school) vacation: I don\u2019t know that any more. I suppose so.\u201d<\/p>\n

In response to a question as to whether he could still remember the event: \u201cYes. We went to the pool: myself, Antonio Keleman, Ronny Kunte \u2013 the others I didn\u2019t know so well. We all went together to the pool, to the Dr. Petzold (Municipal) Swimming Pool. We looked for a place to lie down there and then we went swimming. Before noon there weren\u2019t so many people there.\u201d<\/p>\n

In response to a question: \u201cA boy, Joseph Abdulla, was killed there.\u201d<\/p>\n

\u201eIch habe hier noch ein Protokoll einer richterlichen Zeugenvernehmung in der Todesermittlugnssache des Joseph Abdulla,\u201c sagte Francesca. \u201eAuf der ersten Seite des Protokolls steht das Gesch\u00e4ftszeichen des Amtsgerichts Dresden: 270 Gs 3141\/00 414 Js 53329\/00. Diese Zeugenvernehmung wurde am 21.11.2000 um 10.00 Uhr durchgef\u00fchrt. Anwesend war Frau Richterin am Amtsgericht Weidig, Herr StA Flockerzi, Herr KHK Krebs, und eine Urkundsbeamtin.<\/p>\n

Der Zeuge war Daniel Steiner, Sch\u00fcler, geboren am 09.03.1985 in Sebnitz und wohnhaft n Sebnitz.<\/p>\n

Am Anfang des Protokolls gibt es eine interessante Antwort auf eine Frage der Beh\u00f6rden. Es hatte andere Termine f\u00fcr die Vernehmung gegeben, die der Zeuge vers\u00e4umt hat, und auf die Frage, warum er nicht wie verlangt erschienen ist, antwortete der Zeuge, \u201aIch bin die letzten Termine nicht gekommen, weil ich Angst vor der rechten Szene hatte. Meine Mutti ist zur Zeit im Krankenhaus. Ich war allen zu Hause.\u2019<\/p>\n

Auf eine Nachfrage, antwortete er, \u201aEinige, die dort waren, sind aus der rechten Szene. Wenn die das rauskriegen, die kennen mich auch.\u2019<\/p>\n

Dann steht es im Protokoll, wie \u00fcblich am Anfang eines solchen Dokumentes, \u201aDer Zeuge wurde mit dem Gegenstand der Untersuchung und der Person des Beschuldigten bekanntgemacht. Er wurde zur Wahrheit ermahnt . . . .\u2019<\/p>\n

Wir werden sehen,\u201c fuhr Francesca fort, \u201ewie \u00e4hnlich das, was mit Daniel Steiner passierte, dem war, was mit Rene May passierte. Rene May war der erste Zeuge, dessen richterliche und polizeiliche Zeugenvernehmung ich euch vorgelesen habe. Vor dem Amtsgericht erkl\u00e4rte Daniel Steiner, etwa wie Rene May es getan hat, \u201aDa (im Schwimmbad) wurde ein Junge umgebracht, der Joseph Abdulla,\u2019 und dann beschrieb er die Ermordung. Einige Monaten sp\u00e4ter aber, vor der Polizei, nachdem Daniel Steiner, wie Rene May, es gesehen hat, wie die M\u00f6rder und andere Mitglieder der rechten Szene in Sebnitz frei herumliefen und andere Menschen drohten, begann er eine ganz ander Geschichte erz\u00e4hlen, genauso wie Rene May es getan hat.\u201c<\/p>\n

Dann begann Francesca, den Rest des Protokolls vorzulesen:<\/p>\n

Zur Sache: Es war 1997, da war ich 12 Jahre alt. Das war in der Sommerzeit.<\/p>\n

Auf Vorhalt: Den genauen Tag wei\u00df ich nicht mehr.<\/p>\n

Auf Frage, ob Ferien waren: Das wei\u00df ich nicht mehr. Ich nehme es an.<\/p>\n

Auf Frage, ob er sich noch an das Ereignis erinnern kann: Ja. Wir sind ins Bad gegangen, ich, Antonio Keleman, Ronny Kunte, die anderen kannte ich nicht so. Wir sind alle zusammen ins Bad in das Dr. Petzold Bad. Da haben wir uns einen Liegeplatz gesucht und dann sind wir dort schwimmen\/baden gegangen. Am Vormittag waren noch nicht so viele Leute da.<\/p>\n

Auf Frage: Da wurde ein Junge umgebracht, der Joseph Abdulla.<\/p>\n
