{"id":207,"date":"2006-05-31T07:06:10","date_gmt":"2006-05-31T11:06:10","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/munichletters\/letter-from-munich-042\/"},"modified":"2006-05-31T07:06:10","modified_gmt":"2006-05-31T11:06:10","slug":"letter-from-munich-042","status":"publish","type":"page","link":"https:\/\/archive.blogs.harvard.edu\/munichletters\/letter-from-munich-042\/","title":{"rendered":"Letter from Munich &#8211; 042"},"content":{"rendered":"<p><strong>Letter from Munich &#8211; the Joseph Affair &#8211; 42<\/strong><\/p>\n<p>EINE DEUTSCHE FASSUNG STEHT WEITER UNTEN.<\/p>\n<p>26 October 2001 <\/p>\n<p>Dear Mr. Graf, dear friends,<\/p>\n<p>The continuation of the letter from last week:<\/p>\n<p>Jacqueline lay the newspaper on the table and picked up the programm magazine for the Franco-German channel, ARTE. \u201c\u2019On 17 October 1961,\u2019\u201d she read, \u201c\u2019a peaceful demonstration of 25,000 citizens of France moved through the streets of Paris. Twenty-four hours later dozens of demonstrators (the exact number will never be known) were lying dead. The bodies of many of the missing have never been found. The victims were all from Algeria, they were people who had officially been French citizens since 1958. The demonstration had been called as a protest against the curfew that had been imposed eleven days earlier by the Paris Prefect of Police, Maurce Papon (who later, in 1998, would be sentenced to ten years\u2019 imprisonment for collaborating with the Nazis during the German occupation). How could such a thing happen almost forty years ago in the capital of a western democracy?\u2019\u201d<\/p>\n<p>Jacqueline looked at us all, one at a time. \u201cHow could such a thing happen? Perhaps the real question is \u2018How could such a thing not happen?\u2019 in a Europe where an exaggerated respect for authority is still rooted deep in the conscious and unconsciour mind of the average citizen and where it is so very easy to intimidate most people?\u201d<\/p>\n<p>She picked up a piece of paper. \u201cI have here a report from the Dresden police headquarters about an attack on a certain Jens May in Sebnitz. Jens is the brother of Rene May, whose statement in court is already familiar to you. \u2018A connection with the Kantelberg-Abdulla case cannot be ruled out,\u2019 the Dresden police wrote. \u2018May is the brother of a witness in the above mentioned case.\u2019 And what exactly happened during this attack? The police reported, \u2018The victim was waylaid by four suspects. Two of them held him down while the others hit him with their fists. The victim suffered facial lacerations and abrasions on the arm.\u2019\u201d<\/p>\n<p>Jacqueline lay the paper down on the table. \u201cAnd was a formal complaint filed with the police? No, the police wrote in their report, because the victim had \u2018a blood alcohol level of 1.26 parts per thousand.\u2019\u201d<\/p>\n<p>She sat there, thinking, and said nothing for a moment. Then she went on, \u201cYes, that\u2019s the European concept of justice. The powerful and influential are protected at any price, and in this case that means Joseph\u2019s killers and their family and relatives are all protected. All of them have a close connection with the CDU, the largest conservative \u2013 some would say \u2018right-wing\u2019 \u2013 political party in Germany, which hold power in Saxony, the German state where Joseph was killed. And in circumstances like these what happens to the victim, to the brother of a witness to murder? One must, of course, blame the victim, or at least silence him.\u201d<\/p>\n<p>Then she added, \u201cPerhaps in the current fight against terrorism the authorities can somehow develop a better concept of justice.\u201d<\/p>\n<p>But what do I know about such complicated topics? I\u2019m only a simple, relatively uneducated man. Oktober 2001<\/p>\n<p>Sehr geehrter Herr Graf, sehr geehrte Freunde,<\/p>\n<p>Fortsetzung des Briefes von der letzen Woche:<\/p>\n<p>Jacqueline lag die Zeitung auf den Tisch und nahm die Programmzeitschrift des Senders ARTE. \u201e,Am 17. Oktober 1961\u2019\u201c, las sie vor, \u201e,zog ein friedlicher Demonstrationszug von 25.000 franz\u00f6sischen Staatsb\u00fcrgern durch die Stra\u00dfen von Paris. 24 Stunden sp\u00e4ter wurden Dutzende von Toten (die genau Zahl ist nie bekannt geworden) aufgefunden; die Leichen zahlreicher Vermisster sind bis heute verschollen. Die Opfer waren allesamt Algerier, seit 1958 offiziell franz\u00f6siche Staatsb\u00fcrger. Als Protest gegen die 11 Tage zuvor vom Pariser Polizeipr\u00e4fekten Maurice Papon (1998 wegen Zusammenarbeit mit den Nazis w\u00e4hrend der Besetzung Frankreichs zu zehn Jahren Haft verurteilt) angeordnete Sperrstunde war zu dieser Demonstration aufgerufen worden. Wie konnte so etwas vor knapp 40 Jahren in der Hauptstadt einer westlichen Demokratie geschehen?\u2019\u201c<\/p>\n<p>Jacqueline schaute uns alle an, einen nach den anderen. \u201eWie konnte so etwas geschehen? Vielleicht ist die richtige Frage, \u201awie konnte so etwas nicht geschehen\u2019, in einem Europa, wo das Obrigkeitsdenken wurzelt immer noch tief in dem Unbewussten und Bewusstsein der Durschschnittsb\u00fcrger, und wo es so sehr leicht ist, die meisten Menschen einzusch\u00fcchtern?\u201c<\/p>\n<p>Jetzt nahm sie ein Blatt Papier. \u201eIch habe hier einen Bericht des Polizeipr\u00e4sidiums Dresden \u00fcber einen \u00dcberfall in Sebnitz auf Jens May, Bruder vom Zeugen Rene May, dessen Vernehmung euch schon bekannt ist. \u201aZusammenhang mit Kantelberg-Abdulla nicht auszuschliessen\u2019, schrieb die Dresdner Polizei. \u201aMay soll Bruder eines Zeugen in o.g. Sache sein\u2019. Und was ist bei diesem \u00dcberfall passiert? Die Polizei berichtete, \u201aDer gesch\u00e4digte wurde von vier Tatverd\u00e4chtigen aufgelauert. Zwei der T\u00e4ter hielten ihn fest und zwei andere schlugen mit den F\u00e4usten auf ihn ein. Der Gesch\u00e4digte erlitt durch diese Handlung Platzwunden im Gesicht und Sch\u00fcrfwunden an einem Arm\u2019\u201c.<\/p>\n<p>Jacqueline lag dem Blatt auf den Tisch. \u201eUnd wurde eine Anzeigenerstattung durchgef\u00fchrt? Nein, schrieb die Polizei in ihrem Bericht, \u201aaufgrund alkoholischer Beeinflussung 1,26 Promille\u2019\u201c.<\/p>\n<p>Sie wirkte einen Augenblick nachdenklich. \u201eJa\u201c, sagte sie, \u201edas ist der europ\u00e4ische Begriff von Justiz: Man muss die M\u00e4chtigen und Einflussreichen um jeden Preis sch\u00fctzen, in diesem Fall die T\u00e4ter in der Aff\u00e4re Joseph, und ihre Familie und Verwandten. Alle habe eine enge Verbindung mit der CDU, der gr\u00f6\u00dften konservativen \u2013 mancher w\u00fcrde sagen, \u201arechtsorientierten\u2019 \u2013 Partei Deutschlands. Und unter solchen Umst\u00e4nden was passiert mit dem Opfer, mit dem Bruder eines Augenzeugen eines Mordes? Selbstverst\u00e4ndlich muss man die Opfer besch\u00fcldigen, oder mindestens zum Schweigen bringen\u201c.<\/p>\n<p>Dann f\u00fcgte sie hinzu, \u201eVielleicht im jetzigen Kampf gegen den Terrorismus k\u00f6nnen die Beh\u00f6rden irgendwie ein etwas besserer Begriff von Justiz entwickeln\u201c.<\/p>\n<p>Aber was wei\u00df ich \u00fcber all diese komplizierten Themen? Ich bin nur ein einfacher, relativ ungebildeter Mensch.
