Both cases settled before the Supreme Court could determine the issue. The most recent was <a href=\"http:\/\/www.lsnj.org\/sjls\/PDF\/111159p.pdf\" target=\"_blank\">Mt. Holly Gardens Citizens in Action, Inc. v. Twp. of Mt. Holly,<\/a> 658 F.3d 375 (3d Cir. 2011). The prior case was <a href=\"http:\/\/www.justalandlord.com\/wp-content\/uploads\/2010\/11\/order_denying_Petition_for_Rehearing_with_dissenting_opinion_11-15-2010_SHSJ_case.pdf\" target=\"_blank\">Gallagher v. Magner,<\/a> 619 F.3d 823 (8th Cir. 2010). Another lawsuit is in process called <a href=\"http:\/\/www.cfpbmonitor.com\/files\/2013\/06\/HUD.pdf\" target=\"_blank\">Am. Ins. Ass&#8217;n v. U.S. Dep&#8217;t of Hous. &amp; Urban Dev.<\/a> (D.D.C., filed 06.26.13), \u00a0brought by the insurance industry to challenge the disparate impact regulations promulgated this year by the Department of Housing and Urban Development (HUD). <a href=\"http:\/\/www.cfpbmonitor.com\/2013\/06\/26\/breaking-news-insurers-sue-hud-regarding-disparate-impact-2\/\" target=\"_blank\">read article<\/a>\u00a0Those regulations define when disparate impact claims are available and are consistent with the general outlines of the doctrine as it been developed by all the Circuit courts.\u00a0<a href=\"http:\/\/portal.hud.gov\/hudportal\/HUD?src=\/press\/press_releases_media_advisories\/2013\/HUDNo.13-022\" target=\"_blank\"> 24 C.F.R. \u00a7 100.500(a)\u2013(b)<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court has twice in recent years accepted certiorari in cases to decide whether disparate impact claims are available under the Fair Housing Act.
