In order to justify the expulsion of a student in the Rhineland-Palatinate, the German state of which Mainz is the capital, there has to be a disturbance of the peace in the operation of the university, or the rights and duties of a member of the university have to be infringed in some way. According to the law in Baden-Wurttemberg, the state in which Rottenburg is located, the student leader of the neo-Nazi youth group would have to be \u201csentenced to prison for at least a year for a crime that was deliberately committed,\u201d before the university could expel him. Um eine Exmatrikulation zu rechtfertigen, m\u00fcssten in Rheinland-Pfalz der Frieden des Hochschulbetriebes gest\u00f6rt oder die Rechte und Pflichten eines Hochschulmitgliedes verletzt sein. In Rottenburg m\u00fcsste der HDJ-Leiter gem\u00e4\u00df dem baden-w\u00fcrttembergischen Hochschulgesetz &#8220;wegen einer vors\u00e4tzlich begangenen Straftat zu einer Freiheitsstrafe von mindestens einem Jahr rechtskr\u00e4ftig verurteilt&#8221; werden.
