I\u2019m not making any structural changes in the building, I just want three tables here.\u2019<\/p>\n

\u201cProbably nothing will ever come of the idea of a street vendor\u2019s cart in Hanover\u2019s pedestrian zone. It would be terrific, but completely illegal.<\/p>\n
\u201cAnd just so that no one else in Germany will have ideas like that, we have in this country the authorities and the law. Everywhere. For everything. Even in the community of Worpswede in Osterholz-Scharmbeck, near Hamburg. Here, the guardians of the law have paid special attention to a shop called \u2018The Worpswede Collectors\u2019 Corner\u2019, because someone there had the same kind of creative idea that the Lenz couple had in Hanover. Marlies Schaffert of the Collectors\u2019 Corner explains: \u2018The original idea was to add something to this pretty shop, with its collectors\u2019 pieces. We just planned this coffee machine, a few cups and saucers, this fridge with pastries. And the three tables, a cozy atmosphere where people could sit, rest, and relax a bit \u2013 and just drink a cup of coffee\u2019.\u201d<\/p>\n

Und die drei Tische, an denen die Leute dann gem\u00fctlich sitzen, sich ausruhen, entspannen sollen – und dabei eine Tasse Kaffee trinken\u2019.”<\/p>\n

\u201cSo the whole idea seemed really good, and Paul Lenz went off to the responsible authority in Hanover, the \u2018Department of Order\u2019 (‘Ordnungsamt’). He just wanted to know what was required for a small street vendor\u2019s cart on bicycle wheels. Here\u2019s what Lenz says about his visit to the authorities in Hanover: \u2018I made inquiries at the Department of Order. The first question they asked was whether we had a private toilet. At first I didn\u2019t know what they were talking about. They meant we had to have a toilet that was twenty meters from the cooking area, so that customers could go to the toilet at any time. And the cooking area would need a floor. And a roof. And four walls. And in addition, two portable sinks with hot running water. One for cleaning vegetables and one for washing hands\u2019.\u201d<\/p>\n

\u201eKlingt doch eigentlich ganz gut. Also ab zum Ordnungsamt in Hannover. Paul Lenz will schon mal wissen, was er f\u00fcr die Suppenk\u00fcche auf dem Fahrrad denn so alles braucht. Lenz \u00fcber den Besuch beim Amt: \u201aIch habe mich dann beim Ordnungsamt erkundigt. Und die erste Frage war, ob wir eine Personaltoilette haben. Da wusste ich zuerst einmal nicht, was das ist. Das ist eine Toilette, die 20 Meter von der K\u00fcche entfernt sein muss, damit man jederzeit auf Toilette gehen kann. Und eine K\u00fcche braucht einen Boden, ein Dach und vier W\u00e4nde, und obendrein noch zwei mobile Waschgelegenheiten mit flie\u00dfend warmen Wasser. Eine f\u00fcrs Gem\u00fcse und die andere f\u00fcr die H\u00e4nde\u2019.”<\/p>\n

You just set up everything on the edge of the street, with a large pot and a gas burner and small containers with different kinds of ingredients. \u201eJetzt haben die beiden eine tolle Idee gehabt: Ehefrau Lin macht sich mit einer Suppenk\u00fcche auf dem Fahrrad selbst\u00e4ndig, ein bisschen so wie in Thailand. \u201cAccording to the regulations, that kind of new name on a sign is a \u2018facility\u2019 and requires official approval.<\/p>\n
\u201cThe authorities ask, in effect, \u2018Who do you think you are, that you feel you don\u2019t need our permission?\u2019 Take the shop owner next door. He also had a sign, and needed to apply for a building permit to change it.<\/p>\n
\u201cWolf Koechling of \u2018Lacoste Sportswear No. 1\u2019 knows the situation even better. He said to us, \u2018I inquired about the procedure for changing the name on the sign. I was told that if I wanted to change the current name, ‘Sportswear No. 1’, to ‘Sportswear No. 2’, for example, I\u2019d have to submit a whole new building permit application just to change that one number\u2019.\u201d<\/p>\n

\u201cAn application for a building permit is needed, just to put a new name on a shop sign. We wanted to ask the Department of Buildings in the Nordfriesland county administration in Husum why that was necessary. It was this department that was demanding that an application for a building permit be submitted.<\/p>\n
\u201cBut they wouldn\u2019t tell us why a building permit was required. Not on camera, please. Only in writing. All right, here\u2019s the way it is. There are certain state construction ordinances, and these contain a lot of regulations. So, listen and pay attention: \u2018Structural facilities are facilities connected to the ground and manufactured from building products. A connection to the ground occurs also in the case of a facility that rests on the ground by virtue of its own weight or is moveable in a limited way on permanent tracks or when the facility is, according to the purpose for which it is to be employed, intended to be used predominantly fixed in place.\u2019 Who knows if anyone really understands what that means?\u201d<\/p>\n
