What were <a href=\"http:\/\/www.klalawfirm.com\/main.html\">Knox Lemmon Anapolsky LLP<\/a>, lawyers for the California Milk Processors Board, thinking when they sent a heavy-handed cease-and-desist letter to Alaskan artist and breastfeeding adovocate Barbara Holmes?  The letter claimed that her hand-lettered baby <a href=\"http:\/\/en.wiktionary.org\/wiki\/onesie\">onesies<\/a> and t-shirts asking &#8220;<em>got breastmilk?<\/em>&#8221; infringed on the Milk Board&#8217;s &#8220;got milk?<span><sup>\u00ae<\/sup><\/span>&#8221; trademark. <em>(See <\/em>&#8220;&#8216;<a href=\"http:\/\/www.adn.com\/matsu\/story\/474936.html\">Got milk&#8217; lawyers huff at Talkeetna artist&#8217;s parody<\/a>&#8221; (<em>Anchorage Daily News<\/em>, July 25, 2008); <em>via <a href=\"http:\/\/overlawyered.com\/2008\/07\/got-breastmilk\/\">Overlawyered<\/a>.com; and see &#8220;<a href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2008\/07\/got-lawsuits.html\">Legal Blog Watch<\/a>;&#8221; <\/em><a href=\"http:\/\/languagelog.ldc.upenn.edu\/nll\/?p=414\"><em>Language Log<\/em><\/a>; and ) According to <a href=\"http:\/\/backwoodslawyer.justia.net\/firmprofile-1049609.html\">Paul Bratton<\/a>, her &#8220;<em><a href=\"http:\/\/backwoodslawyer.blogspot.com\/2008\/07\/california-milk-processors-board-goes.html\">Alaska Backwoods Lawyer<\/a><\/em>&#8220;:<\/p>\n<blockquote>\n<blockquote><p><em>Holmes has been given a deadline of July 22nd to ship to CMPB &#8220;all &#8216;got breastmilk?&#8217; onesies and t-shirts&#8221;; destroy or remove all depictions of the offending items; and account for all profits generated by the sale of the items <\/em>[Ed. Note: a total of either 6 or 16 shirts]<em>.<\/em><\/p><\/blockquote>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/www.mountntopdesigns.com\/resources\/_wsb_146x149_burned+mnts.+sign.jpg\" alt=\"\" width=\"69\" height=\"71\" \/> Click to see Barbara Holmes&#8217; &#8220;one-woman operation&#8221; <a href=\"http:\/\/www.mountntopdesigns.com\/\"><em>Mountntop Designs<\/em><\/a>, where you can see a lot of her products and learn more about her.  Her <a href=\"http:\/\/www.mountntopdesigns.com\/4.html\">baby bugs clothing<\/a> page does not have the Got Breastmilk? design.<\/p><\/blockquote>\n<p><span><\/span><\/p>\n<p align=\"left\">Given the over-weaning ubiquity of the internet and the gleeful cattiness (and adolescent prurience) of the blawgisphere, the Board&#8217;s lawyers must have known that coming down hard on a sympathetic &#8220;Little Guy&#8221; like Holmes, with so little apparent legal justification and no competitive urgency, would earn them universal ridicule and condemnation. (see, <em>e.g<\/em>., <em>The Legal Watercoole<\/em>r, &#8220;<a href=\"http:\/\/legalwatercooler.blogspot.com\/2008\/07\/attorney-needed-course-in-pr.html\">Attorney needed course in P.R.<\/a>;&#8221; and <em>Info\/Law<\/em>, &#8220;<a href=\"http:\/\/blogs.law.harvard.edu\/infolaw\/2008\/07\/29\/the-most-thorough-trademark-policing-ever\/\">The most thorough trademark policing ever<\/a>&#8220;)  Are they just churning for billable dollars or out of their client&#8217;s control?  Maybe not.<\/p>\n<p>At their <a href=\"http:\/\/www.klalawfirm.com\/main.html\">website<\/a>, Knox Lemmon proclaims: <span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pennysm.gif\" alt=\"penny sm\" \/><\/span><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pennysm.gif\" alt=\"penny sm\" \/><\/span><\/p>\n<blockquote>\n<blockquote><p>&#8220;Our practice encompasses business counseling and business litigation. Our business counseling lawyers work closely with our business litigators to exchange ideas and develop strategies for success. This close working relationship between our business counselors and business litigators <em>benefits our clients&#8217; interests because it takes account of the practical realities facing today&#8217;s businesses<\/em>.  (emphasis added)<\/p><\/blockquote>\n<\/blockquote>\n<p>Let&#8217;s accept their bragging as true: CMPB&#8217;s trademark lawyers know what they&#8217;re doing.  They knew the near-frivolous C&amp;D letter to the Alaskan artist concerning breastmilk would generate a gigantic response among the legal community and the press.  They counted on it to achieve:<\/p>\n<blockquote><p><em>Their ultimate goal<\/em>: Informing anyone else planning to free-ride on the <a href=\"http:\/\/www.milkdelivers.org\/gotmilk\/index.cfm\">fabulous success<\/a> of the Got Milk? campaign &#8212; for commercial gain or make a point with stinging parody (as <a href=\"http:\/\/www.msnbc.msn.com\/id\/22223588\/\">PETA tried<\/a> to do last year) &#8212; that the Milk Board would protect its &#8220;<a href=\"http:\/\/www.gotmilk.com\/#\/gotmilkbrand\/\">beloved trademark<\/a>&#8221; with a vengeance.<\/p><\/blockquote>\n<p>If so, they might be right and have benefited their client.  But, that won&#8217;t stop me from concluding that this attack on Barbara Holmes and her onesies is silly as a matter of law and one more example that we&#8217;ve become an &#8220;overlawyered&#8221; nation.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/07\/461-3816692highlightprod_affiliate7.jpg\" alt=\"\" width=\"96\" height=\"72\" \/> <strong><em>I<\/em><\/strong>n his post &#8220;<a href=\"http:\/\/languagelog.ldc.upenn.edu\/nll\/?p=414\">got confusion?<\/a>,&#8221;  Linguistics professor <a href=\"http:\/\/www.rogershuy.com\/\">Roger Shuy<\/a> of <em>Language Log <\/em>asks and explains &#8220;[W]hat sort of claim could CMPB hope to make if it formally charges that &#8220;Got Breastmilk?&#8221; infringes its own trademark and will confuse consumers about the quality, nature, and origin of the product?:&#8221;<\/p>\n<blockquote>\n<blockquote><p>The three most common questions in trademark disputes are:<\/p>\n<p>* Do the two names sound alike?<br \/>\n* Do the two names mean the same thing?<br \/>\n* Do the two names look alike?<\/p>\n<p>In recent years some trademark cases also charge dilution, meaning that the reputation of the original mark has been diluted, tainted, blurred, or eroded by a second user, thereby causing consumers to be confused about the quality and origin of the products.<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>(In case you&#8217;ve somehow forgotten what the <em>Got Milk?<\/em> advertising campaign looks like, click to see samples of <a href=\"http:\/\/www.milknewsroom.com\/ads.htm\">Got Milk? Posters<\/a>, and check out the <a href=\"http:\/\/www.gotmilk.com\/#\/gotmilkbrand\/\">Official Got Milk? website<\/a>)<\/p><\/blockquote>\n<p>Professor Shuy walks us through the above questions and &#8212; even without himself having seen <a href=\"http:\/\/www.adn.com\/matsu\/v-gallery\/story\/474936.html?\/matsu\/v-enlarge\/story\/474936-a474935-t3.html\">a photo of Holmes&#8217; onesies<\/a> (a b&amp;w version appears above) &#8212; sure convinced me that the chance for confusion is next to zero.<\/p>\n<blockquote>\n<p align=\"center\">\n<blockquote><p><a href=\"http:\/\/www.milknewsroom.com\/ads.htm\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/07\/nav_newsroom_hdr.jpg\" alt=\"\" width=\"111\" height=\"58\" \/><\/a> . . . . <img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/07\/461-3816692highlightprod_affiliate7_2.jpg\" alt=\"\" width=\"104\" height=\"63\" \/> For one thing, the Milk Board&#8217;s trademark always uses the same distinctive font, which is a far cry from Holmes&#8217; hand-lettered batik inscription.<\/p><\/blockquote>\n<\/blockquote>\n<p>According to lawyer Bratton:<\/p>\n<blockquote><p>&#8220;This law firm is representing Ms. Holmes and is sending a reply asserting the artist\/advocate&#8217;s free speech rights, the fair use doctrine&#8217;s support for parodying of well-known trademarks, and the simple fact that encouraging mothers to breastfeed their infants cannot possibly create any real confusion or &#8216;tarnishment&#8217; of CMPB&#8217;s trademarks.&#8221;<\/p><\/blockquote>\n<p>As several commentators have pointed out, Barbara Holmes &#8212; who has stated &#8220;It&#8217;s silly, but scary at the same time&#8221; she said. &#8212; herself probably makes the best pithy response to the Milk Board&#8217;s trademark claim:<\/p>\n<blockquote>\n<blockquote><p><em>&#8220;They say I&#8217;m going to confuse milk consumers,&#8221; she said. &#8220;How can you get confused between a boob and a bottle of milk from the store? They&#8217;re two different kind of jugs.&#8221;<\/em><\/p><\/blockquote>\n<p><strong><em>J<\/em><\/strong>udging from their <a href=\"http:\/\/www.antitrustreview.com\/archives\/805\">past practice<\/a>, this seem like the kind of case that would interest our friends David, Hanno and Manfred at the <a href=\"http:\/\/www.antitrustreview.com\/\"><em>Antitrust Review<\/em> weblog<\/a>.  Perhaps they could help us understand the intersection of Intellectual Property and Antitrust laws, and whether the Milk Board could reasonably claim that human breastmilk poses a competitive threat to the bovine variety.<\/p><\/blockquote>\n<p><img decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/07\/lemons.jpg\" alt=\"\" \/> If the gang at the Knox Lemmon law firm are into etymology as much as Prof. Yabut is, they might want to point out in rebuttal that <em>any<\/em> kind of jug makes people think of milk and\/or breasts. [The Got Milk? <a href=\"http:\/\/www.milkdelivers.org\/images\/pic-gotmilk.jpg\">campaign<\/a> has always featured both breasts and moustaches prominently in their ads.]  You see, the slang term &#8220;jugs&#8221; for breasts apparently was inspired by milk jugs &#8212; <em>but<\/em>, the word jug meaning a container for liquids seems to come from the early English word for maidservant.   As they say at <a href=\"http:\/\/www.etymonline.com\/index.php?term=jug\"><em>Etymology Online<\/em><\/a>:<\/p>\n<blockquote>\n<blockquote><p><a href=\"http:\/\/www.milkdelivers.org\/images\/pic-gotmilk.jpg\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/07\/pic-gotmilk.jpg\" alt=\"\" width=\"83\" height=\"70\" \/><\/a> . .  <a href=\"http:\/\/www.etymonline.com\/index.php?term=jug\">jug<\/a>:    &#8220;deep vessel for carrying liquids,&#8221; 1538, jugge, variant of jubbe, of unknown origin, perhaps from jug &#8220;a low woman, a maidservant&#8221; (mid-16c.) . . . . Although some wags have opined that JUG is an acronym for &#8220;Justice Under God,&#8221; I&#8217;m inclined to think the word comes from the Latin word &#8220;Jugum&#8221; (burden or yoke), which led to the following meanings of the <a href=\"http:\/\/www.bartleby.com\/61\/50\/J0075000.html\">word<\/a> (per  <em>The American Heritage<span><sup>\u00ae<\/sup><\/span> Dictionary of the English Language<\/em>: Fourth Edition.  <span>2000):<\/span><\/p>\n<p align=\"center\">jug n. 3. Slang A jail.<br \/>\njug v. 2. Slang. Got Time?<\/strong> A friendly warning from the <em>f\/k\/a<\/em> Gang: I&#8217;ve again learned an important lesson this week. To wit, unless you&#8217;ve got nothing to do but hang out in a pasture chewing your cud, there are two weblogs you need to avoid, <em><a href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2008\/07\/got-lawsuits.html\">Legal Blog Watch<\/a><\/em> and <em><a href=\"http:\/\/overlawyered.com\/2008\/07\/got-breastmilk\/\">Overlawyered.com<\/a><\/em>.  Bob and Carolyn at <em>LBW<\/em> and Walter and Fred <em>Overlawyered <\/em>simply stuff far too much interesting stuff into their blawgs every single day &#8212; finding the most intriguing law-related stories from across the internet. They&#8217;re much too distracting and titillating for anyone with a deadline or in a rush. And, if you&#8217;re trying to mend your procrastinatin&#8217; ways, stay away from the above-mentioned sites (and from <a href=\"http:\/\/blog.simplejustice.us\/\"><em>Simple Justice<\/em><\/a>, too).<\/p>\n<blockquote><p>one button undone<br \/>\nin the clerk\u2019s blouse I let her<br \/>\nsteal my change<\/p>\n<p>.. by George Swede &#8211; from <em>Almost Unseen<\/em> (Brooks Books, 2000)<\/p><\/blockquote>\n<p>The above post is a great example of how easily one can be led astray.  I&#8217;m not usually fixated on jugs &#8212; being a &#8220;leg man,&#8221; who is lactose intolerant, and addicted to caffeine rather than alcohol &#8212; but, Walter pointed me to this story, as did Carolyn, and I was hooked, spending far too much time chasing down this story and its penumbra.<\/p>\n<p>So, don&#8217;t say you weren&#8217;t warned.  If you can only afford one dalliance at a time, you better stick with <em>f\/k\/a<\/em> and stay away from that very seductive pair of bl<em>oo<\/em>gs.<\/p><\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>\u00ae . . .
