So, this evening, I&#8217;m hoping to post more traditional fare.  Given my continuing low level of energy and short attention span, I&#8217;ll be doing it in spurts.  So, please come back later for more (including, an update on our strange and inspiring &#8220;<a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/tisk-pt-4\/\">inadvertent searchee<\/a>&#8221; results; and new poetry by our Honored Guests from <em><a href=\"http:\/\/www.hsa-haiku.org\/frogpond.htm\">Frogpond<\/a>)<\/em>.<\/p>\n<p>Two subjects we first focused on in early 2004 were getting attention in cyberspace today:<\/p>\n<ol>\n<li>We asked back in March 2004 <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/03\/03\/is-legal-marketing-nonspoofable\/\">whether legal marketing is spoofable<\/a>.  Now, <a href=\"http:\/\/charonqc.wordpress.com\/2007\/10\/19\/marketing-for-dummies\/\"><em>Charon QC<\/em> posts Marketing for Dummies?<\/a> about an unusual marketing campaign at Eversheds (via <em>Blawg Review<\/em> <a href=\"http:\/\/davidmaister.com\/blog\/507\/Blawg-Review-131\">#131<\/a>); and, after the <em>ABAJournal<\/em> lists <a href=\"http:\/\/www.abajournal.com\/magazine\/50_ways_to_market_your_practice\/\">50 ways to market<\/a> your [small] law practice, <a href=\"http:\/\/gdgrifflaw.typepad.com\/home_office_lawyer\/2007\/10\/abas-50-ways-to.html\">Grant Griffiths thinks<\/a> they forgot a big one, and <em>Above the Law<\/em> wants to know which of the fifty you think are the <a href=\"http:\/\/www.abovethelaw.com\/2007\/10\/american_bar_association_50_wa.php\">most ridiculous<\/a>.<\/li>\n<li>Meanwhile, the <em>New York Times<\/em> asks and answers &#8220;<a href=\"http:\/\/www.nytimes.com\/2007\/10\/22\/technology\/22click.html?_r=1&amp;th=&amp;oref=slogin&amp;emc=th&amp;pagewanted=all\">How Many Site Hits? Depends Who\u2019s Counting<\/a>&#8221; (Oct. 22, 2007). Being humble and risk-averse, nonlawyer Maister &#8220;focused on issues relating to the business of law, rather than legal matters (which I am not qualified to judge.)&#8221;  [Of course, I&#8217;ve never noticed prior <em>Blawg Review<\/em> hosts making legal judgments.]  David presents recent posts on lawyer Marketing, Leadership, and Economics, and more.  I was intrigued by this blurb and clicked on through:<\/p>\n<blockquote>\n<blockquote>\n<p dir=\"ltr\">&#8220;<a href=\"http:\/\/goldenmarketing.typepad.com\/weblog\/2007\/10\/gary-boomer-on-.html\">Michelle Golden<\/a>, president of Golden Marketing is also an active member of the VeraSage Institute, which is committed to abolishing the billable hour. She reports on the advice given by another consultant on how to implement a value-pricing approach.&#8221;<\/p>\n<p dir=\"ltr\"><img decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2007\/10\/maisterfatsmokerc.jpg\" \/>   What I found sounded an awful lot like more value-billing b.s. (see <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/01\/28\/value-billing-and-lawyer-ethics\">this<\/a> and <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2007\/08\/18\/broadening-the-hourly-billing-debate-consider-yourself-your-clients-and-your-ethics\/\">that<\/a> prior post, for example), aimed at generating fees even higher than you can get from hourly billing (through what looks like price sensitivity manipulation).   Oh, and I wonder if I&#8217;m the only one who wonders what the heck <a href=\"http:\/\/www.webcpa.com\/article.cfm?articleid=25570&amp;pg=acctoday&amp;page=2\">this bit<\/a> of practical advice means: &#8220;Assign an intellectual capital task force.
