It seems to <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">Your Editor, however, that some of us have far better reasons for <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">complaining than others.  Indeed, most of us should be pointing <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">our fingers at ourselves, and at most of Middle- and Upper-Class <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">America (and the residents of similarly affluent nations), before we <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">complain about petroleum companies that are <\/font><font face=\"Arial\" size=\"2\">profiting too much <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">or poli<\/font><font face=\"Arial\" size=\"2\">ticians who are doing too little. (See,<em> e.g.,<\/em> <\/font><font size=\"2\"><font face=\"Arial\"><em>Washington Post<\/em>, <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Arial\">&#8220;<\/font><\/font><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/content\/article\/2006\/04\/25\/AR2006042501900.html\"><font color=\"#000000\" face=\"Arial\" size=\"2\">Bush Calls For Probe Of Rising Gas Prices<\/font><\/a><font face=\"Arial\" size=\"2\">,&#8221; <\/font><font face=\"Arial\" size=\"2\">April 26, 2006)<\/font><\/p>\n<\/blockquote>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p><font face=\"Arial\" size=\"2\">               <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/gasNozzleG.gif\" alt=\"gasNozzleG\" \/>  When it comes to products that we all use and need, the marketplace<\/font><font face=\"Arial\" size=\"2\"> makes all of us very interdependent.  Excessive demand is bound <\/font><font face=\"Arial\" size=\"2\">to<\/font><font face=\"Arial\" size=\"2\"> create painfully high prices for both sinners and saints. <\/font> <font face=\"Arial\" size=\"2\">Energy Gluttons<\/font><font face=\"Arial\" size=\"2\"> cause pain for everyone <\/font><font face=\"Arial\" size=\"2\">in the marketplace &#8212; for themselves <em>and<\/em> for the Energy Thrifty, who cannot escape the marketplace results of their wastrel countrymen (and fellow inhabitants of Earth). <\/font><font face=\"Arial\" size=\"2\">In my not-particularly-humble <font face=\"Arial\" size=\"2\">opinion, the following folk are a<\/font>mong the<\/font><font face=\"Arial\" size=\"2\"> people who should <em>not<\/em> be complaining very loudly about high gasoline<\/font><font face=\"Arial\" size=\"2\"> prices:<\/font><\/p>\n<blockquote>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<blockquote><p><font face=\"Arial\" size=\"2\">&#8211; anyone who purchased or leased an automobile for <\/font><br \/>\n<font face=\"Arial\" size=\"2\">personal or family use in <\/font><font face=\"Arial\" size=\"2\">the past decade that achieves <\/font><\/p>\n<p><font face=\"Arial\" size=\"2\">less than 30 mpg <\/font><font face=\"Arial\" size=\"2\">on the highway (exception: the truly <\/font><br \/>\n<font face=\"Arial\" size=\"2\">poor who bought as gas-efficient a used car as possible)<\/font><br \/>\n<font face=\"Arial\" size=\"2\">&#8211; anyone who purchased a home in the past decade <\/font><\/p>\n<p><font face=\"Arial\" size=\"2\">that has more than 500 square feet per resident (that <\/font><\/p>\n<p><font face=\"Arial\" size=\"2\">number is probably too high, but I&#8217;m trying to be lenient)<\/font><\/p>\n<blockquote><p><font face=\"Arial\" size=\"2\"><em><font color=\"red\">afterthought<\/font><\/em> (April 29, 2006):  As if it needs to <\/font><br \/>\n<font face=\"Arial\" size=\"2\">be <\/font><font face=\"Arial\" size=\"2\">said, this list should include:<\/font><br \/>\n<font face=\"Arial\" size=\"2\">&#8211; anyone who travels by private jet<\/font><\/p><\/blockquote>\n<\/blockquote>\n<p><font face=\"Arial\" size=\"2\">                                                                             <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/55mphsignn.gif\" alt=\"55 limit n\" \/> <\/font><\/p>\n<blockquote><p><font face=\"Arial\" size=\"2\">&#8211; anyone who has not made serious, <em>good faith<\/em> efforts to <\/font><br \/>\n<font face=\"Arial\" size=\"2\">engage in car-pooling for getting to work or schlepping the <\/font><br \/>\n<font face=\"Arial\" size=\"2\">kids to and from school or social activities <\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8211; anyone who has not slowed down to 55 mph, in order to <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">improve gas mileage up to 15% (see our post <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/05\/21#a3850\" rel=\"nofollow\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">gas pain?<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> and <\/font><br \/>\n<font size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\">the FTC Consumer <font color=\"black\">Alert <\/font><\/font><\/font><a href=\"http:\/\/www.ftc.gov\/bcp\/conline\/pubs\/alerts\/fuelalrt.htm\" rel=\"nofollow\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">How to Improve Gas Mileage<\/font><\/a><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, May<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">2005).<\/font><\/p><\/blockquote>\n<blockquote><p> <font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\">&#8211; anyone who has enough disposable income<\/font> to buy one or <\/font><br \/>\n<font face=\"Arial\" size=\"2\">more $5 <\/font><font face=\"Arial\" size=\"2\">cups of coffee daily, or who only drinks water pur-<\/font><br \/>\n<font face=\"Arial\" size=\"2\">chased <\/font><font face=\"Arial\" size=\"2\">in small bottles.<\/font><\/p><\/blockquote>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">On the topic of high gasoline prices, the people in the first two categories <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">above should consider offer<\/font><font face=\"Arial\" size=\"2\">ing apologies rather than complaints.  It&#8217;s their <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">Ameri<\/font><font face=\"Arial\" size=\"2\">can dream that is fueling our energy nightmare.  [Yes, of course, there <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">are exceptions, and people who do not have meaningful choices, due to their <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">particular situations. See my customary <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/01\/23#a3130\"><font color=\"black\">implied disclaimers<\/font><\/a>.]<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/graphClimb.gif\" alt=\"graphClimb\" \/><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">My own neighborhood is high-density urban, with a broad spectrum of <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">social and financial strata intermingled.  Residents go from the down-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">and-out living in Single Occupancy Rooms at the YWCA and YMCA (who <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">often don&#8217;t have vehicles), to college kids living in small apartments, but <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">driving <\/font><font face=\"Arial\" size=\"2\">$50,000 cars (many of which are gas-guzzlers); to the working poor <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">with rusty old cars living in tiny apartment units; to professional families and <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">ancient widows <\/font><font face=\"Arial\" size=\"2\">living in large, poorly-insultated, pre-Civil War houses, and <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">driving any <\/font><font face=\"Arial\" size=\"2\">thing from Priuses, and Mini-Coopers, to large SUVs and full-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">sized, <\/font><font face=\"Arial\" size=\"2\">granny-drivin&#8217; <\/font><font face=\"Arial\" size=\"2\">GM <\/font><font face=\"Arial\" size=\"2\">cars.  <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">Frankly, some of my neighbors have not earned the right to complain <em>very <\/em><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><em>loudly<\/em> about high energy prices. The fact that &#8220;everybody does it,&#8221; shouldn&#8217;t make irresponsible <\/font><font face=\"Arial\" size=\"2\">lifestyle choices acceptable.   The fact that we do some recycling should not get our consciences off the hook.  And, it shouldn&#8217;t take the current voter revolt to get &#8220;conservative&#8221; politicians like local U.S. Representative John Sweeney (R-Clifton Park, <\/font><font face=\"Arial\" size=\"2\">NY) to support CAFE mileage standards for the very first time.  [see <a href=\"http:\/\/www.wnyt.com\/x7907.xml?ag=x156&amp;sb=x183\">this story<\/a>]<\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2008\/04\/logo.gif\" height=\"74\" width=\"92\" \/><strong><em> update<\/em><\/strong> (Earth Day 2008):  Many of the above links relating to your ecological footprint are no longer working.  For a related exercise, I suggest checking out your Carbon Footprint, which is a measure of the impact our activities have on the environment in terms of the amount of greenhouse gases we produce. It is measured in units of carbon dioxide. Earth Day (or any day) is a good time to <a href=\"http:\/\/www.carbonfootprint.com\/calculator.aspx\">calculate your carbon footprint<\/a>. That means that at present rates of consumption,&#8221; we would need 1.39 Earths to insure that future generations are at least as well off&#8221; as the average inhabitant of Earth is now.<\/font><\/p>\n<p><font face=\"Arial\" size=\"2\">&#8211; However, if <font face=\"Arial\" size=\"2\">everyone on the planet consumed as much as North Americans, we <\/font><font face=\"Arial\" size=\"2\">would need <em>8 Earths<\/em> to insure that future generations are at least as well off as we are now.<\/font><\/font><\/p>\n<blockquote>\n<blockquote><p><font face=\"Arial\" size=\"2\"><br \/>\n<\/font><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\">&#8211; That&#8217;s because, North America has an Ecological Footprint per capita that is <strong>5.93 times <\/strong><\/font><font face=\"Arial\" size=\"2\"><strong>greater<\/strong> than the amount of biocapacity available per person on a sustainable <\/font><font face=\"Arial\" size=\"2\">basis globally.   <\/font><\/font><\/p><\/blockquote>\n<p><font face=\"Arial\" size=\"2\"><br \/>\n<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"> <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/gasNozzleF.gif\" alt=\"gasNozzleF\" \/> &#8211; More than 90% of America&#8217;s immense Ecological Footprint comes from its use of fossil energy.  <font face=\"Arial\" size=\"2\">&#8220;As was noted in the 2004 <em><font face=\"Arial\">Footprint of Nations<\/font><\/em><font face=\"Arial\"> report, wealthier nations tend <\/font><\/font><font face=\"Arial\" size=\"2\"><font face=\"Arial\">to run negative ecological balances, largelybecause of the high degree of cor<\/font><\/font><font face=\"Arial\" size=\"2\"><font face=\"Arial\">relation between affluence (expenditures) and fossil fuel consumption.&#8221; <\/font><\/font><\/font><\/p>\n<\/blockquote>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><font face=\"Arial\" size=\"2\">Thanks to our large cars and homes, only two nations &#8212;  the United Arab Emirates and Kuwait &#8212; have per capita &#8220;ecological deficits&#8221; (negative ecological balances) greater than that of the United States. We got to hear how &#8220;drivers are trying to <\/font><\/p>\n<p><font face=\"Arial\" size=\"2\"><br \/>\n<\/font><font face=\"Arial\" size=\"2\">adapt&#8221; to high gas prices, with Langan&#8217;s Assistant Sales Manager, Jeff Keene, <\/font><\/p>\n<p><font face=\"Arial\" size=\"2\"><br \/>\n<\/font><font face=\"Arial\" size=\"2\">saying, \u201cWe&#8217;re seeing a lot of people wanting to get out of SUV&#8217;s.\ufffd\u201d Keene added:<\/font><\/p>\n<p><font face=\"Arial\" size=\"2\"><br \/>\n<\/font><font face=\"Arial\" size=\"2\">\u201cThey come in specifically looking for the mileage but also for the all wheel drive.\u201d  <\/font><\/p>\n<p><font face=\"Arial\" size=\"2\"><br \/>\n<\/font><font face=\"Arial\" size=\"2\">Langan Motor Car sells Audis (and Porsches). This morning (April 30), the npr Saturday Weekend Edition had a piece you can hear <a href=\"http:\/\/www.npr.org\/templates\/story\/story.php?storyId=5370990\">here<\/a>, that basically says people are still complaining, Lattes in hand.  On April 27,<em> npr<\/em> <a href=\"http:\/\/www.npr.org\/templates\/story\/story.php?storyId=5365439\"><font color=\"black\">Q&amp;A on gasoline prices<\/font><\/a>, that does a good job of explaining the why&#8217;s and how&#8217;s of oil and gasoline pricing, and that included the following:<\/font><\/p>\n<blockquote>\n<p align=\"left\"><font face=\"Arial\" size=\"2\"><strong>Is there any evidence that people are starting to change their habits in response to higher prices? <\/strong><\/font><\/p>\n<p align=\"left\"><font face=\"Arial\" size=\"2\"> <\/font><\/p>\n<p align=\"left\"><font face=\"Arial\" size=\"2\">When you ask drivers at the gas station, &#8220;Are you trying to conserve?,&#8221; they invariably say they are.
