Steve Bainbridge is so certain he&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">got an important new perspective on minimum wage laws that he <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">seems to be blind to reality and particularly allergic to dissent (at <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">least from me; see below).&nbsp; Of course, he might just have a grant <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">proposal or law journal article in the pipeline.<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&#8220;soapBoxDudeF&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">As Prof. B first stated in his post &#8220;<\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2006\/04\/drum_on_the_min.html\"><FONT face=\"Arial\" size=\"2\">Drum and the Minimum Wage<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&#8220;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">(April 11, 2006), and has now&nbsp;<\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2006\/04\/minimum_wage.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">expanded upon<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">, in a <EM><A href=\"http:\/\/www.tcsdaily.com\/\"><FONT color=\"#000000\">TCS<\/FONT><\/A><\/EM> column <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">titled &#8220;<\/FONT><A href=\"http:\/\/www.tcsdaily.com\/article.aspx?id=042006E\"><FONT face=\"Arial\" size=\"2\">Minimum Behavior<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&#8221; (April 20, 2006), he believes that &#8220;the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">minimum wage policy debate is one-sided&#8221; &#8212; proponents and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">opponents of higher minimum wages have been focusing only &#8220;on <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">the effect of such a hike on the supply of jobs by employers.&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Steve believes that &#8220;<\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;an equally important question&#8221; is <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">&#8220;what effect does a minimum wage hike have on the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">demand for jobs by <\/FONT><FONT face=\"Arial\" size=\"2\">potential employees?&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">To that insight, Prof. B. adds (as repeated at <EM>TCS<\/EM>) that:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">&#8220;it is critical to recognize that the minimum wage debate <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">is mainly a debate about how much working <I>teenagers<\/I><I> <\/I><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">and twenty-somethings in their first job ought to make.&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">[<EM>Hallelujah!<\/EM>&nbsp; <EM>Sorta!<\/EM>&nbsp;Although it remains <FONT color=\"black\">in his original <\/FONT><A href=\"http:\/\/www.professorbainbridge.com\/2006\/04\/drum_on_the_min.html\"><FONT color=\"black\">post<\/FONT><\/A><FONT color=\"black\">,&nbsp;Steve <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\">has, <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\">to his credit,&nbsp;at least deleted the assertion <FONT face=\"Arial\"><FONT size=\"2\">&#8220;the minimum <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">wage <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">debate is not really a debate about how much <\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\">money the <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">work<\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">ing <\/FONT><\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\"><FONT color=\"black\">poor make&#8221; from his <EM>TCS <\/EM><\/FONT><A href=\"http:\/\/www.tcsdaily.com\/article.aspx?id=042006E\"><FONT color=\"black\">column<\/FONT><\/A><FONT color=\"black\">.&nbsp; We happily take <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/04\/17#a6494\"><FONT color=\"black\">credit<\/FONT><\/A> <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT face=\"Arial\"><FONT size=\"+0\"><FONT color=\"black\" size=\"2\">for that change, and for saving Prof. B, <FONT face=\"Geneva,Arial,Sans-Serif\">from further embarrass-<\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">ment over that sentence.&nbsp; On the other hand, he added to the&nbsp;<\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">TCS piece that&nbsp;<\/FONT><\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT color=\"black\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">whether California should have a minimum wage <\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT color=\"black\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">law at all is <\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT color=\"black\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">a &#8220;contested proposition.&#8221;&nbsp;&nbsp; The &#8220;working poor&#8221;<\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT color=\"black\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">better not count on Steve Bainbridge in their battle for better <\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT size=\"+0\"><FONT color=\"black\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">wages.]<\/FONT><\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT size=\"+0\"><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/bainbridgePic.gif\" alt=\"bainbridgePix\" \/><\/FONT><\/DIV><\/DIV><\/FONT><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">Steve&#8217;s&nbsp;big contribution to the minimum wage debate<\/FONT>, therefore, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">is <\/FONT><FONT face=\"Arial\" size=\"2\">to ask whether raising the wage is likely to cause more youths <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">to drop out of high school.&nbsp; Steve believes that teens actually <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">will base their decision to stay in school on marginal differences <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">in the minimum wage. Thus, his legislative recommendation is <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">twofold: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">(a) have a differential lower minimum wage for those who <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">have not completed a high school degree, [which]&nbsp;should <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">result in <\/FONT><FONT face=\"Arial\" size=\"2\">a lower dropout rate;&#8221; and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">(b) have &#8220;An indexed <\/FONT><FONT face=\"Arial\" size=\"2\">minimum wage, <\/FONT><FONT face=\"Arial\" size=\"2\">which grew steadily <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">and no faster than inflation, [which] would avoid <\/FONT><FONT face=\"Arial\" size=\"2\">the potential <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">for biasing the choice between work and school&#8221; in <\/FONT><FONT face=\"Arial\" size=\"2\">the year <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">that a large increase is given to make up for eroded real <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">purchasing power.<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;&nbsp;&nbsp; &#8220;spiltwine&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">The <EM>f\/k\/a<\/EM> Gang (from Yabut and to <EM>ethicalEsq<\/EM> to Jack Cliente and<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><EM>dagosan<\/EM>)&nbsp;wonder what Steve is smoking, while sipping his favorite <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">wine.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">As for the facts, which Prof. B. surely knows, as he has read at <\/FONT><FONT face=\"Arial\"><FONT size=\"2\">least <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\">one BLS report, plus <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;<A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/04\/17#a6494\"><FONT face=\"Arial\" size=\"2\">bainbridge speeds past the working poor<\/FONT><\/A>,&#8221;&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">our <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">post on the topic, dated April <\/FONT><FONT face=\"Arial\" size=\"2\">17, 2006:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">48% of the &#8220;young workers&#8221; Steve is talking about are 20 or older.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">The study he uses does not tell us how many of them are heads <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">of <\/FONT><FONT face=\"Arial\" size=\"2\">household or have dependent children, nor if they are in their <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">first <\/FONT><FONT face=\"Arial\" size=\"2\">jobs, as he asserts &#8212; nor whether they are trying to work <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">while <\/FONT><FONT face=\"Arial\" size=\"2\">studying for a better-paying career.&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Over 1.5 million hourly workers in the USA are over age 20 and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">earn <\/FONT><FONT face=\"Arial\" size=\"2\">the minimum wage <\/FONT><FONT face=\"Arial\" size=\"2\">or less.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/graphClimb.gif\" alt=\"graphClimb\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">Raising the minimum <EM>wage has a ripple effect<\/EM> for million of workers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">hovering just above the minimum.&nbsp;
