Upon hearing <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">those assertions we had to ask the representative of the Florida <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Bar if he would rather take his chances with a pit bull or a lion, <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">we heard crickets on the other end of the phone.&#8221;  (emphasis <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">added):<\/font><\/p><\/blockquote>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">In addition to a pair of similar panthers (on an urn, I believe) in their masthead,<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">here&#8217;s the footer on the PP&amp;S website:<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">         <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/PanterPantherL001.gif\" alt=\"PanterPantherR\" \/>     <strong>PANTER PANTER &amp; SAMPREDO<\/strong>      <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/PanterPantherR001.gif\" alt=\"PanterPantherL\" \/><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p><a href=\"http:\/\/pview.findlaw.com\/cmd\/profileview?wld_id=1462929_1&amp;channel=&amp;print=1\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Arne C. Vanstrum<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> is Advertising Counsel for The Florida Bar.  We mentioned him <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/04\/08#a6423\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">a post<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> a couple days ago, when &#8212; with tongue meant to be in cheek &#8212; we asked <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">our readers to compare the ferocity-combativeness-quotient of the Panter website&#8217;s<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">panther images with the sleepy doggie head used in Pape &amp; Chandler&#8217;s campaign.<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Unfortunately, in the highly irrational and subjective world of the Bar&#8217;s Dignity Police, <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">it is darn hard to spoof reality.  <\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">We don&#8217;t know, of course, whether Mr. Vanstrum was revealing (confidential) infor-<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">mation about an actual investigation by FBA&#8217;s Advertising Counsel office.  Although <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\"><em>f\/k\/a<\/em> wouldn&#8217;t wish a disciplinary fight with the numbskulls of FBA and Florida&#8217;s high <\/font><\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Court on Brett and Mitchell Panter, there are a few advantages to having such an <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">investigation:<\/font><\/p>\n<p><font face=\"Arial\" size=\"2\">&#8220;PanterPantherLN&#8221;<\/font><\/p>\n<blockquote><p>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>  The Florida &#8220;bar&#8221; might wake up to the silliness of all this dignity regulation<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">(or more likely the vulnerability of many self-respecting and even respected <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">firms to arbitrary investigation and aggravation) and push for the adoption of <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">sound, modern (constitutional) advertising rules, such as those in the ABA <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Model Rules (2004), which states <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in <\/font><a href=\"http:\/\/www.abanet.org\/cpr\/mrpc\/rule_7_1.html\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Rule 7.1<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, the reasonable proscription:<\/font><\/p>\n<blockquote><p>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;A lawyer shall not make a false or misleading communication about <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the lawyer or the lawyer&#8217;s services. A communication is false or mis-<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">leading if it contains a material misrepresentation of fact or law, or <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">omits a fact necessary to make the statement considered as a whole <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">not materially misleading.&#8221;<\/font><\/p><\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and then cautions [<\/font><a href=\"http:\/\/www.abanet.org\/cpr\/mrpc\/rule_7_2_comm.html\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Comment<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> 3 to Rule 7.2] that &#8220;Questions of effectiveness <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and taste in advertising are matters of speculation and subjective judgment,&#8221; <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and warns that bans against &#8220;undignified&#8221; advertising &#8220;would impede the flow <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of information about legal services to many sectors of the public&#8221; and &#8220;assumes <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that the bar can accurately forecast the kind of information that the public would <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">regard as relevant.&#8221;<\/font><\/p>\n<p><font face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/PanterPantherRN.gif\" alt=\"PanterPantherRN\" \/><\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> The Florida Supreme Court might come to its senses. Or, maybe <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">seek insight from their Carolina brethren on the topic of <a href=\"http:\/\/www.panthers.com\/cheerleaders\/\">panthers<\/a>.  <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">[<a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/11\/22#a5355\">okay<\/a>, <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/04\/11#a6445\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">not likely<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">]<\/font><\/p>\n<blockquote><p>\n<font face=\"Arial\" size=\"2\">&#8211; This raises the question whether, like obscenity, <\/font><br \/>\n<font face=\"Arial\" size=\"2\">dignity is defined by local standards. <\/font><\/p><\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> The United States Supreme Court could accept a case with less emotional <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">baggage than one involving pit bulls, and re-assert free speech rights for <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">lawyer advertising that is neither misleading nor deceptive, but which merely <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">offends the ego, sense of dignity, or pocketbook of certain well-placed bar <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">members.  <\/font><\/p><\/blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">There is even one advantage here for the Panter Firm that Marc Chandler and John <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Pape did not have in their &#8220;pit bull&#8221; battle with the Florida Bar Association &#8212; any <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;panther&#8221; advertising investigation and litigation will almost by necessity help make <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;Panter&#8221; a household word (think satellite offices!).<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">                                                                            &#8220;panterPantherLN&#8221;  &#8220;panterPantherRN&#8221;<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Are there any lawyers in Florida thinking about launching new animal-related branding <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">or <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">marketing activities?  Before you do, you better get your species and breeds in <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">order and &#8212; <em>more important<\/em> &#8212; make sure you don&#8217;t have any powerful enemies in the  <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Florida Bar Association. They both call for Commentors<\/p>\n<p dir=\"ltr\">to be polite, however, for which I am grateful.
