Only a few years later, though, the high Court made clear that lawyers enjoyed the same qualified freedom as others to advertise &#x2013; so long as what they promoted was not &#x201C;false, deceptive or misleading&#x201D; and did not offer products or services that were illegal. <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">The Muzzles are announced each year near Thomas Jefferson&#8217;s April <BR>13th birthday anniversary, &#8220;as a means to draw national attention to abridg-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Geneva,Arial,Sans-Serif\">ments of free<\/FONT> speech and press and, at the same time, foster an apprecia-<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">tion for those tenets of the First Amendment.&#8221;&nbsp;&nbsp;&nbsp; This year, there is a special <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.cvillepodcast.com\/2006\/04\/11\/muzzles\/\">podcast<\/A> of the Awards.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Taking aim at the Florida Supreme Court&#8217;s November 17, 2005 decision <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">in <\/FONT><A href=\"http:\/\/www.floridasupremecourt.org\/decisions\/2005\/sc04-40.pdf\"><EM><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Florida Bar v. <\/FONT><\/EM><\/A><A href=\"http:\/\/www.floridasupremecourt.org\/decisions\/2005\/sc04-40.pdf\"><EM><FONT face=\"Arial\" color=\"#000000\" size=\"2\">John Pape and Marc Chandler<\/FONT><\/EM><\/A><FONT face=\"Arial\" size=\"2\">, the Muzzles board <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">noted that lawyers have been granted First Amendment protection for <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">their advertisements.&nbsp; Nonetheless: <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/StaffordshireBullTerrier.gif\" alt=\"StaffBT\" \/><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;Florida specifically restricts attorney advertising that is &#8216;sensational&#8217; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">and that uses &#8216;slogans&#8217; even to convey factually accurate appeals to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">prospective clients.&nbsp; It was on this basis that the Florida Supreme <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Court ruled in November, 2005, that two Fort Lauderdale lawyers, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">John Pape and Marc Chandler, must stop airing a TV commercial that <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">featured a pit bull in a spiked collar and listed the firm&#x2019;s phone number, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">1-800-PIT-BULL.&nbsp; Such an ad, wrote Chief Justice Barbara Pariente, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">implied that lawyers would &#8216;get results through combative and vicious <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">tactics that will maim, scar or harm the opposing party.&#8217; &nbsp;Given the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">inherently vicious nature of the pit bull, added the Florida high court, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">if such ads were permitted &#8216;images of sharks, wolves, crocodiles and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">piranhas could follow.&#8217;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;PitBullLogo&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">In response, The Thomas Jefferson Center concluded:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;Regardless how one feels about the tastefulness of such advertising, <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the claim that prospective clients could be misled to their detriment by <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the pit bull commercial seems outlandish.&nbsp; None of the recognized <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Constitutional exceptions to the status of attorney advertising seem to <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">apply here. For failing to recognize the First Amendment rights of lawyers <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to use unconventional appeals in seeking legal business, the Florida <\/FONT><\/EM><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\">Supreme Court earns a 2006 Jefferson Muzzle.&#8221;<\/FONT><\/EM> <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/JeffersonCenter.gif\" alt=\"JeffersonCenter\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">No other courts were on the 2006 Muzzles List.&nbsp; Here are the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">13 awardees:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\">1) President George W.
