<\/FONT><FONT face=\"Arial\" size=\"2\">ethics&nbsp;whore &#8212; or <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">a dupe of the above &#8212; to assert <\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">that contigency fees should relate <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">to the risk being taken by the lawyer <\/FONT><FONT face=\"Arial\" size=\"2\">in a particular <\/FONT><FONT face=\"Arial\" size=\"2\">case.&nbsp; I don&#8217;t <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">know if the tort lawyers really believe their own propaganda, but<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">they do profess this belief, while reminding the world that they &#8220;earn&#8221; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">their above-hourly-fee premimum <EM>precisely<\/EM> because they are taking <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">the huge risk of working hard, and&nbsp;fronting litigation expenses, without <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">being <\/FONT><FONT face=\"Arial\" size=\"2\">compensated at all, or enough.<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> The main components of the risk are, of course, how <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">likely the client is to succeed with the claim, how much <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">is likely to be awarded and collected, and how much work <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">and resources the law firm is likely to put into the case.&nbsp;The <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">risk is lower, and the fee should therefore be lower, when <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">the case is likely to be a winner with a big jackpot, and when <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">relatively fewer hours and dollars will be expended to win.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;slicingThePieF&#8221;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">When legal ethics experts espouse&nbsp;the&nbsp;link between the reasonable-<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">ness of a contingency fee and the perceived risk <\/FONT><FONT face=\"Arial\" size=\"2\">at the time the fee&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">arrangement is being entered, they are called captives of evil forces or&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">simply insensitive simpletons who will destroy the American justice <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">system and deprive the injured Little Guy of competent legal counsel&nbsp;&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">(see, for example, this Jan. 2004<FONT color=\"black\"> <\/FONT><A href=\"http:\/\/www.actonvision.com\/Legal1_News19_04\/Law9F.htm\"><FONT color=\"black\">article<\/FONT><\/A><FONT color=\"black\"> from the <EM><A href=\"http:\/\/www.miami.com\/mld\/miamiherald\/business\/7623715.htm\"><FONT color=\"black\">Miami Herald<\/FONT><\/A><\/EM>,<\/FONT> and this <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.citizen.org\/pressroom\/release.cfm?ID=1495\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\">press release<\/FONT><\/A>&nbsp;by Public Citizen, for sample p\/i rhetoric).&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">The p\/i bar points to the ubiquitous use <\/FONT><FONT face=\"Arial\" size=\"2\">of what appears to be &#8212; but <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">they&nbsp;no longer acknowldge to be &#8212; a standard percentage rate in most <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">jurisdictions, and the lack of disciplinary action against such fees.&nbsp; That <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">is supposed to settle the debate.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &nbsp;<img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/mushroomsG.gif\" alt=\"mushroomsG\" \/><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Well, before I give up, I thought I would point out again just <EM>who<\/EM> &#8212; besides <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">people like Lester Brickman, Derek Bok, Howard Phillips, and myself,&nbsp;plus &nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">lots&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">of state and federal judges <\/FONT><FONT face=\"Arial\" size=\"2\">&nbsp;&#8212; <\/FONT><FONT face=\"Arial\" size=\"2\">is on record saying that risk is central <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">in evaluating the reason<\/FONT><FONT face=\"Arial\" size=\"2\">ableness of a contingency fee.&nbsp;
