<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to describe his approach to constitutional interpretation.&nbsp; Do he and Justice Scalia really think <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the Founders wanted a &#8220;dead&#8221; document?&nbsp; Does the phrase sound especially catchy?&nbsp; Give me <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a living constitution any day &#8212; with the original DNA, it will still live and grow.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Like Prof. Orin Kerr at VC, I find the term &#8220;<\/FONT><A href=\"http:\/\/volokh.com\/archives\/archive_2004_12_28.shtml#1104346631\"><FONT face=\"Times New Roman,Times,Serif\">Constitution in Exile<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">&#8221; to be pejorative.&nbsp; The phrase<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">conjures up deposed monarchists hoping to return someday in glory.<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> As I noted over at <A href=\"http:\/\/www.legalunderground.com\/2004\/12\/whos_more_funny.html\">Evan<\/A>&#8216;s place this morning, discussing <\/FONT><FONT face=\"Times New Roman,Times,Serif\"><EM>Anonymous Lawyer<\/EM>, the satirist<\/FONT><FONT face=\"Times New Roman,Times,Serif\"> is<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">(by definition) <EM>not <\/EM>condoning the actions of the subject institition or people.&nbsp; It&#8217;s <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">kind of scary that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">young lawyers and law students seem to need emoticons to get an author&#8217;s gist<\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.&nbsp; <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><EM><STRONG><FONT color=\"red\">update<\/FONT><\/STRONG><\/EM> [7 PM]:&nbsp; <EM>Special (Legal) Ed?<\/EM>&nbsp; In addition to emoticons, <A href=\"http:\/\/favorabledicta.blogspot.com\/2004\/12\/im-big-ole-texas-dummy.html\"><FONT color=\"black\">Energy Spatula seems<\/FONT><\/A> <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/failgrays.gif\" alt=\"fail gray s\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">to need captions <\/FONT><FONT face=\"Times New Roman\" size=\"2\">explaining the topic being <\/FONT><FONT face=\"Times New Roman\" size=\"2\">covered.&nbsp; <\/FONT><FONT face=\"Times New Roman\" size=\"2\">Apparently, I should have said<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">(slowly, with tiny words): &#8220;I am not talking about <\/FONT><FONT face=\"Times New Roman\" size=\"2\">whether <EM>AL <\/EM>is funny <\/FONT><FONT face=\"Times New Roman\" size=\"2\">or likeable <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">or good at what <\/FONT><FONT face=\"Times New Roman\" size=\"2\">he&#8217;s doing.&nbsp;&nbsp; The topic <\/FONT><FONT face=\"Times New Roman\" size=\"2\">of this blurb is whether a satirist&nbsp;agrees with<\/FONT><FONT face=\"Times New Roman\" size=\"2\">&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">the <\/FONT><FONT face=\"Times New Roman\" size=\"2\">conduct described.&#8221;&nbsp; [Midnight]:&nbsp; E.&nbsp;Spats is <A href=\"http:\/\/favorabledicta.blogspot.com\/2004\/12\/on-no-you-didnt.html\"><FONT color=\"black\">learning<\/FONT><\/A>!<\/FONT><\/FONT><\/DIV><\/DIV><\/LI><\/UL><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/quotationmarksleft.gif\" alt=\"quote marks left\" \/>&nbsp; With all due respect to Eugene Volokh and Mark Twain, Twain&#8217;s quip &#8220;History doesn&#8217;t&nbsp;<\/FONT><FONT face=\"Times New Roman\" size=\"2\">repeat itself, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">but it rhymes,&#8221; does not mean <\/FONT><FONT face=\"Times New Roman\" size=\"2\">the same thing as <A href=\"http:\/\/volokh.com\/archives\/archive_2004_12_28.shtml#1104346631\">Volokh&#8217;s &nbsp;observation<\/A> &#8220;Tomorrow&#8217;s problems <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">won&#8217;t <\/FONT><FONT face=\"Times New Roman\" size=\"2\">be identical to yesterday&#8217;s; but they may <\/FONT><FONT face=\"Times New Roman\" size=\"2\">be similar enough.&#8221;&nbsp; Rhyming has no necessary connection <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman\" size=\"2\">at all to the meaning of&nbsp;
