With such clear-thinking laptop liberators as Mr. Sargas, ou<font color=\"black\">r liberal <\/font><\/font><a href=\"http:\/\/en.wikipedia.org\/wiki\/Thermidorian\"><font color=\"black\" face=\"Times New Roman,Times,Serif\" size=\"2\">Thermidorian<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\"><font face=\"Times New Roman,Times,Serif\"><font color=\"black\"> <\/font>Revolution must be right <\/font><font face=\"Times New Roman,Times,Serif\">around<\/font> the corner.<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Mike Cernovich has been thinking about <\/font><a href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2004\/12\/blogger_ethics.html\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">Blogger Ethics<\/font><\/a><font face=\"Times New Roman,Times,Serif\"> in the context of lawstudents writing on their weblogs about law professors.  But, other than the question of privacy<font size=\"2\"> expectations, Mike&#8217;s hortatory &#8220;should&#8221; advice comes down to <em>don&#8217;t do it, because your professor might retaliate<\/em>.   This approach doesn&#8217;t even rise to the status of <\/font><\/font><a href=\"http:\/\/www.onelook.com\/?w=etiquette&amp;ls=a\"><font color=\"black\" face=\"Times New Roman,Times,Serif\" size=\"2\">etiquette<\/font><\/a><font color=\"black\" face=\"Times New Roman,Times,Serif\" size=\"2\">,much less <\/font><a href=\"http:\/\/en.wikipedia.org\/wiki\/Ethics\"><font color=\"black\" face=\"Times New Roman,Times,Serif\" size=\"2\">ethics<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\"><font color=\"black\">, which has to do with right and wrong, obligations and duty.   For the<\/font> record:<\/font><a href=\"http:\/\/www.bartleby.com\/61\/11\/C0831150.html\"><font color=\"#000000\" face=\"Times New Roman,Times,Serif\" size=\"2\"> CYA<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\"> and Lawyer Suicide Avoidance Tactics (LSAT) are <em>not <\/em>Ethics.<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font size=\"2\">Any law student weblogger who doesn&#8217;t realize he or she<font color=\"black\"> <\/font><\/font><a href=\"http:\/\/www.discourse.net\/archives\/2004\/12\/is_class_bloggable_how_about_private_chats.html\"><font color=\"black\" size=\"2\">needs<\/font><\/a><font color=\"black\" size=\"2\"> to be circumspect<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> with what is said on a weblog (whether anonymous or not) doesn&#8217;t have the common sense needed to be a lawyer.<\/font><\/li>\n<li><font face=\"Times New Roman,Times,Serif\" size=\"2\">Any weblogger who doesn&#8217;t have the courage to write about significant matters<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> of principle, values or tactics, when his or her opinion differs from that of a professor<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> or other authority figure, may not have the fortitude it takes to be anything more than<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> a mediocre lawyer.<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>  Overlawyered.com&#8217;s update on the California case of <em><a href=\"http:\/\/appellatecases.courtinfo.ca.gov\/search\/dockets.cfm?dist=1&amp;doc_id=60237&amp;div=1\">Rinaldi v. Pisano<\/a> <\/em>notes that an      <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/holyfamily.gif\" alt=\"holy family\" \/><\/font><\/p>\n<p dir=\"ltr\"><a href=\"http:\/\/www.overlawyered.com\/archives\/001860.html\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">emotional distress case against a divorce lawyer<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\"> has been rejected by the <\/font><a href=\"www.courtinfo.ca.gov\/courts\/courtsofappeal\/1stDistrict\/\"><font color=\"#000000\" face=\"Times New Roman,Times,Serif\" size=\"2\">1st District Court of Appeal<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\">.  <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">I hope the client&#8217;s attorney is correct that the theory is still a viable one, even though the facts here do <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">not support the claim.  In my own practice (representing children and acting as a mediator), I have seen <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">divorce lawyers frequently press their clients to raise issues, or use tactics, in custody and visitation <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">disputes that serve only one purpose &#8212; increasing lawyer billing time &#8212; while they have only one sure <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">effect: causing great emotional distress for the children and both parents.
