This week, Evan&#8217;s <EM>Legal Underground<\/EM> has been discussing ways to&nbsp;<\/FONT><A href=\"http:\/\/www.legalunderground.com\/2004\/12\/improving_law_s.html\"><FONT face=\"Times New Roman,Times,Serif\">improve law school education<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">so <\/FONT><FONT size=\"2\">that graduates are&nbsp;better prepared&nbsp; to immediately practice law, and will&nbsp;(it is assumed) <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">therefore have <\/FONT><FONT size=\"2\">options other than law firms for their first jobs.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">According to <\/FONT><A href=\"http:\/\/www.law.harvard.edu\/news\/today\/\"><EM><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Harvard Law Today<\/FONT><\/EM><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> Dean <\/FONT><A href=\"http:\/\/www.law.harvard.edu\/dean\/bio.php\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Elena Kagan<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;has &#8220;launched a curricular review to re-examine <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">how law is taught &#8212; for the first time since HLS Dean Christopher Langdell introduced the current <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">curriculum in the 1870s.&#8221;&nbsp;&nbsp;(by Beth Potier, at 7, Dec. 2004; story not available online)&nbsp; <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">The article states:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/dinosatnightsm.gif\" alt=\"dinos at night sm\" \/> &#8220;It&#8217;s time to say, &#8216;Is this really what students should be taking? Are they learning the set&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">of <\/FONT><FONT size=\"2\">competencies that they need to master in order to go out and be great lawyers in today&#8217;s <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">world?&nbsp;&nbsp; <\/FONT><FONT size=\"2\">How has the world changed in the last 100 and some years? she says.&nbsp; Kagan is <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">confident that <\/FONT><FONT size=\"2\">the multiyear review will turn up an intensified focus on international and <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">comparative law, <\/FONT><FONT size=\"2\">something relevant to all practicing lawyers today.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Just as Langdell&#8217;s 19th-century curriculum became the model for most modern law study in <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">America, so will the eyes of the nation&#8217;s legal scholars be on Harvard as it again rethinks <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">how <\/FONT><FONT size=\"2\">it trains lawyers.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;If we do our jobs well in this area, we&#8217;ll be creating a law school curriculum not just for <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">Harvard <\/FONT><FONT size=\"2\">but for legal education in general,&#8221; Kagan says.&nbsp; &#8220;It&#8217;s the great fun of this job, <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">but it&#8217;s also the <\/FONT><FONT size=\"2\">great responsibility of it.&#8221;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">Beyond the insitutional hubris in her remarks, it seems that Dean Kagan is talking about finding new <EM>subject <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM>areas<\/EM>&nbsp;rather than finding ways to make law school a practical source of training (Note: there are good <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">arguments that legal education, especially at elite schools, should be about&nbsp;honing legal reasoning and <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">communicating skills, and general principles, rather than the nuts-and-bolts&nbsp;of everday practice.)&nbsp;&nbsp;&nbsp; <EM>I&#8217;m <\/EM><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><EM>skeptical that a curricular review dominated by law school administrators and professors will come up <\/EM><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\"><EM>with proposals that might significantly reduce the demand for law schools and law professors.<\/EM>&nbsp;&nbsp; Any <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">impetus for reducing the number of classroom semesters and switching to a series of apprentice-like clerking <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">and clinic options will probably have to come from the Bar itself.&nbsp; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<P dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Times New Roman,Times,Serif\"><\/FONT><br \/>\n<UL><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I wanted to suggest that&nbsp;thoughtful ideas for improving&nbsp;the training of new lawyers be directed to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Dean Kagan&#8217;s office or the appropriate committee or project head.&nbsp; However,&nbsp;the online <\/FONT><A href=\"http:\/\/www.law.harvard.edu\/administration\/directory.php\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">HLS Directory<\/FONT><\/A><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">lists, but gives <EM>no<\/EM> contact information for the Dean&#8217;s Office, merely linking back to the same Dean&#8217;s <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Welcome page that sends you to the Directory for Contact Information.&nbsp;
