{"id":5195,"date":"2004-12-15T07:42:05","date_gmt":"2004-12-15T11:42:05","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/12\/15\/should-we-disbar-nanny-scoffl"},"modified":"2011-08-05T14:58:08","modified_gmt":"2011-08-05T18:58:08","slug":"should-we-disbar-nanny-scofflaws","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/12\/15\/should-we-disbar-nanny-scofflaws\/","title":{"rendered":"should we disbar nanny-scofflaws?"},"content":{"rendered":"<p><font size=\"2\"><font face=\"Times New Roman,Times,Serif\"><em><strong>L<\/strong><\/em>ast night, Ted Koppell on<font color=\"black\"> <\/font><\/font><a href=\"http:\/\/abcnews.go.com\/Nightline\/\"><font color=\"black\" face=\"Times New Roman,Times,Serif\">Nightline<\/font><\/a><font face=\"Times New Roman,Times,Serif\"> focused on  &#8220;the reasons so many are willing to hire illegal employees.&#8221;<\/font><\/font><\/p>\n<blockquote><\/blockquote>\n<blockquote><p><font face=\"Times New Roman,Times,Serif\" size=\"2\">One guest kept &#8220;explaining&#8221; that the law is not enforced because it is &#8220;a weak law.&#8221;  I kept thinking:  It&#8217;s not<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> enforced because too many government lawyers have illegal domestic workers or have friends who do.  <\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Times New Roman,Times,Serif\">This morning, the <em>Baltimore Sun <\/em>continues that theme (&#8220;<\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/wp-admin\/\"><font face=\"Times New Roman,Times,Serif\" size=\"2\">Parents often turn a blind eye, hiring nannies illegally in U.S<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\">,&#8221; <\/font><\/font><font size=\"2\"><font face=\"Times New Roman,Times,Serif\"><font size=\"2\">by Ellen Gamerman, Dec. 15, 2004; free reg. req&#8217;d)<\/font>, saying:<\/font><\/font><\/p>\n<blockquote><p><font face=\"Times New Roman,Times,Serif\" size=\"2\">The issue of illegal nannies only seems to come up around Senate confirmation time. But in fact,<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> illegal nannies are commonplace in cities where affluent two-career couples are raising children. <\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\">Around Washington, people are especially aware of the political risks of employing an undocumented<\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\"> domestic worker, but that often doesn&#8217;t stop them from hiring them. <\/font><\/p>\n<p><font face=\"Times New Roman,Times,Serif\"><font size=\"2\">&#8220;I was just at a party, and we were <\/font><font size=\"2\">talking about the Kerik thing and two of our friends immediately<\/font><\/font><font face=\"Times New Roman,Times,Serif\"><font size=\"2\"> volunteered, &#8216;We&#8217;re never going to go <\/font><font size=\"2\">for a Cabinet position,'&#8221; says Jonathan Turley, a George Washington <\/font><\/font><font face=\"Times New Roman,Times,Serif\"><font size=\"2\">University law professor, referring <\/font><font size=\"2\">to the new D.C. code language used by those employing illegal domestic <\/font><\/font><font face=\"Times New Roman,Times,Serif\"><font size=\"2\">help. &#8220;You have very conservative, <\/font><font size=\"2\">l<\/font><font size=\"2\">aw-and-order parents who do not hesitate to violate federal law.&#8221;<\/font><\/font><\/p>\n<p><font face=\"Times New Roman,Times,Serif\" size=\"2\">&#8230; &#8221; The blurring of the law can present opportunity for illegal workers but also expose them to poor pay, physical <\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\">mistreatment and few protections. Still, while hiring an undocumented nanny is illegal, not everyone considers it <\/font><font face=\"Times New Roman,Times,Serif\"><font size=\"2\">a real crime.&#8221;<\/font><font size=\"3\"> <\/font><\/font><\/p><\/blockquote>\n<\/blockquote>\n<p><font face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/JailBirdneg.jpg\" alt=\"jailbird neg\" \/> [see Dec. 16, 2004, <em>update<\/em> below] Despite the <em>Washington Post&#8217;s <\/em>&#8220;<\/font><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A62389-2004Dec13.html\"><font color=\"#000000\" face=\"Times New Roman,Times,Serif\" size=\"2\">Correction<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\">&#8221; yesterday, stating that Lani Guinier &#8220;had no such [domestic <\/font><font face=\"Times New Roman,Times,Serif\"><font size=\"2\">worker] <\/font><font size=\"2\">problem,&#8221; the <em>Sun<\/em> notes that Law Professor Guinier &#8220;was Clinton&#8217;s pick to direct the Justice Department&#8217;s civil rights <\/font><\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\">division, and though Clinton cited her legal writings on race for ditching her nomination, she too failed to pay taxes <\/font><font face=\"Times New Roman,Times,Serif\" size=\"2\">on a domestic worker.&#8221;  (See our prior <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/12\/14#a2916\"><font color=\"#000000\" face=\"Times New Roman,Times,Serif\" size=\"2\">post<\/font><\/a><font face=\"Times New Roman,Times,Serif\" size=\"2\">.)<\/font><\/p>\n<blockquote>\n<ul>\n<li><font face=\"Times New Roman\"><font size=\"2\"><strong><em><font color=\"#ff0000\">update<\/font><\/em><\/strong> <font color=\"black\" face=\"Times New Roman,Times,Serif\">(Dec. 15, 3 PM) <\/font><\/font><a href=\"http:\/\/www.newsday.com\/news\/nationworld\/nation\/wire\/sns-ap-presidents-nanny-problems-corrective,0,6196212.story?coll=sns-ap-nation-headlines\"><font color=\"black\" face=\"Times New Roman,Times,Serif\" size=\"2\"><em>Newsday.com<\/em><\/font><\/a><font size=\"2\"><font face=\"Times New Roman,Times,Serif\"><font color=\"black\"> has issued a <em>Correction<\/em>, based on a release from a Harvard Law School spokesman concerning Prof. Guinier.
