{"id":5194,"date":"2004-12-14T15:40:17","date_gmt":"2004-12-14T19:40:17","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/12\/14\/guinier-getting-the-story-and"},"modified":"2011-08-05T14:58:08","modified_gmt":"2011-08-05T18:58:08","slug":"guinier-getting-the-story-and-the-correction-right","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/12\/14\/guinier-getting-the-story-and-the-correction-right\/","title":{"rendered":"guinier: getting the story (and the correction) right"},"content":{"rendered":"<p><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><strong><em>A<\/em><\/strong>s we noted in an update to our earlier <\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/12\/13#a2913\"><span style=\"font-family: Times New Roman,Times,Serif\">post<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\">, today, the <em>Washington Post<\/em> issued this <\/span><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A62389-2004Dec13.html\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Correction<\/span><\/a><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> concerning Harvard Law Professor Lani Guinier:<\/span><\/p>\n<blockquote>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;A Dec. 12 article incorrectly said that Lani Guinier&#8217;s nomination to head the Justice Department&#8217;s<\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> civil rights division under President Bill Clinton was withdrawn because of a &#8220;nanny problem.&#8221;<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">There was no such problem, and the Clinton White House withdrew the nomination because of<\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\"> controversy over Guinier&#8217;s legal writings.&#8221;<\/span> [via <a href=\"http:\/\/volokh.com\/archives\/archive_2004_12_07.shtml#1102965100\"><span style=\"color: black\">E. Volokh<\/span><\/a>]<\/span><\/p>\n<\/blockquote>\n<\/blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">In the wake of the withdrawal of the Kerik nomination, many newspapers ran articles noting that other<\/span><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"> nominees have had &#8220;nanny problems.&#8221;   <span style=\"color: black\">The <\/span><\/span><a href=\"http:\/\/www.foxnews.com\/story\/0,2933,141228,00.html\"><span style=\"font-family: Times New Roman,Times,Serif;color: black\">articles<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"color: black\"> taken<\/span> directly from a December 11 <\/span><a href=\"http:\/\/www.phillyburbs.com\/pb-dyn\/news\/27-12112004-415179.html\"><span style=\"font-family: Times New Roman,Times,Serif\">Associated<\/span><\/a><\/span><span style=\"font-size: x-small\"><a href=\"http:\/\/www.phillyburbs.com\/pb-dyn\/news\/27-12112004-415179.html\"><span style=\"font-family: Times New Roman,Times,Serif\"> Press<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\"> story correctly stated that Guinier&#8217;s nomination was withdrawn due to controversy over her <\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">supposed position on civil rights issues, and then mention a nanny problem<\/span><\/p>\n<blockquote>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;A look at three individuals [Zoe Baird, Kimba Woods, Lani Guinier] who withdrew their names as <\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">nominees by President Clinton for Cabinet and other <\/span><span style=\"font-size: x-small\">high-level posts because of similar political <\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">obstacles:<\/span><\/p>\n<p><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><strong>&#8220;Lani Guinier<\/strong><\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">: A Clinton classmate at Yale University Law School, she was Clinton&#8217;s choice to<\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\"> head <\/span><span style=\"font-size: x-small\">the Justice Department&#8217;s civil rights division. Clinton cited her legal writings on racial issues <\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">for dropping the <\/span><span style=\"font-size: x-small\">nomination.  <strong>She also had not paid taxes for a domestic worker<\/strong>.&#8221; (emphasis added)<\/span><\/span><\/p><\/blockquote>\n<\/blockquote>\n<p><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\">However, other articles, such as one from<span style=\"color: black\"> <\/span><\/span><a href=\"http:\/\/www.cbsnews.com\/stories\/2004\/12\/10\/home\/main660485.shtml\"><span style=\"font-family: Times New Roman,Times,Serif;color: black\">CBSNews<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;color: black\">, <\/span><a href=\"http:\/\/www.newsweek.co.uk\/id\/6700225\/\"><span style=\"font-family: Times New Roman,Times,Serif;color: black\">NewsweekUK<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;color: black\"> and the <\/span><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A57960-2004Dec11_2.html\"><em><span style=\"font-family: Times New Roman,Times,Serif;color: black\">Washington Post<\/span><\/em><\/a><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"color: black\">,<\/span> stated that it was <\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">unpaid <\/span><span style=\"font-size: x-small\">taxes for a domestic worker that <em>caused<\/em> Pres. Clinton to withdraw the nomination. <\/span><\/span><\/p>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><img loading=\"lazy\" decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/journalist.gif\" alt=\"journalist\" width=\"42\" height=\"53\" \/> Yesterday evening, we pointed out that we did not know the facts yet.   However, the following cryptic <\/span><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\">statement in Lani Guinier&#8217;s book <\/span><a href=\"http:\/\/www.amazon.com\/exec\/obidos\/ASIN\/0684811456\/ref=sib_rdr_dp\/104-1569557-1267912\"><em><span style=\"font-family: Times New Roman,Times,Serif;color: #000000\">Lift Every Voice<\/span><\/em><\/a><span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">, at <\/span><a href=\"http:\/\/www.amazon.com\/gp\/reader\/0684811456\/ref=sib_vae_pg_36\/104-1569557-1267912?%5Fencoding=UTF8&amp;keywords=%22Social%20Security%22&amp;p=S015&amp;twc=3&amp;checkSum=Xrz2u7G7vn31OSLe4BRUe46AWLADw7oolu%2BNlunnhDY%3D#reader-page\"><span style=\"font-family: Times New Roman,Times,Serif;color: #000000;font-size: x-small\">page 36<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">, describing <\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">the very first press conference<\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> after her nomination was announced, suggests that there <em>might<\/em> have been some kind of unpaid employee<\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> tax issue &#8212; or, at least, that reporters were broaching the issue with the new nominees:<\/span><\/p>\n<blockquote>\n<blockquote><p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8221; the weight of my description of how prior administrations had tolerated actual examples<\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> of intentional discrimination was more than the reporters wanted to hear that day.   Afterwards, <\/span><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"> my fellow nominees thanked me for what they took as a filibuster. <strong>From their perspective,  I had<\/strong><\/span><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><strong> successfully distracted the press, whose interest in nonpayment of Social Security taxes could <\/strong><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><strong>not regain momentum&#8221; <\/strong>(emphasis added)<\/span><\/span><\/p><\/blockquote>\n<\/blockquote>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Your Editor then expressed a hope that Professor Guinier might set the record straight.  Well, she did write the<\/span><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"> following <\/span><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A62368-2004Dec13.html\"><span style=\"font-family: Times New Roman,Times,Serif\">letter to the editor<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\">, which appeared in today&#8217;s <em>Washington Post<\/em>:<\/span><\/span><\/p>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\"><strong><span style=\"font-size: x-small\">Still Getting My Story Wrong    (<\/span><\/strong><span style=\"font-size: x-small\">Tuesday, December 14, 2004; Page A26 )<\/span><\/span><\/p>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\"><em><span style=\"font-size: x-small\">I have been committed since 1993 to correcting the public&#8217;s confusion about my ideas. It continues <\/span><\/em><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em>to be an uphill battle, made more difficult by inaccurate media reports.<\/em><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em> The Clinton White House withdrew my nomination in 1993 to be assistant attorney general for civil <\/em><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em> rights in response to controversy about my academic writings on democracy. The controversy was fueled by a media firestorm that reported many of my ideas &#8212; and me &#8212; out of context. <\/em><\/span><\/p>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em>I was disheartened to read that some Post reporters are now writing a revisionist history that lets the <\/em><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em>media off the hook in 1993 and instead asserts inaccurately that my nomination was withdrawn because <\/em><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em>of concerns about domestic help<\/em> [&#8220;<\/span><a href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A57960-2004Dec11_2.html\"><span style=\"font-family: Times New Roman,Times,Serif;color: #000000;font-size: x-small\">White House Puts Blame on Kerik<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">; Nominee Initially <\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Denied Having <\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Hired an Illegal Immigrant, Officials Say,&#8221; front page, Dec. 12].<\/span><\/p>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">LANI GUINIER<\/span><\/span><\/p>\n<\/blockquote>\n<\/blockquote>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">I&#8217;m glad that Prof. Guinier corrected the Post&#8217;s misstatement concerning the cause of her dismissal.  However, I&#8217;m disappointed that <em>she did not choose to deny or confirm whether there had been unpaid Social Security<\/em><\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> taxes.  Her letter alone does not seem to support the Post&#8217;s Correction assertion that &#8220;there was no such <\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">problem&#8221; &#8212; <em>unless<\/em> the Post is distinguishing between a &#8220;nanny&#8221; problem and a &#8220;domestic worker&#8221; problem.<\/span><\/p>\n<blockquote>\n<p dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em>G<\/em>etting the facts right is very important, as is giving a correct overall impression in a story.  Wordsmiths from<\/span><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> the <em>Washington Post<\/em> <\/span><span style=\"font-family: Times New Roman,Times,Serif\"><span style=\"font-size: x-small\">and the <\/span><span style=\"font-size: x-small\">Harvard Law School faculty are certainly able to do both, if they want to.  Do they?  Will they? To my dismay, I have somehow been swept up in another media controversy challenging my integrity in defiance of the facts. Other media outlets have since issued corrections.
