{"id":5192,"date":"2004-12-13T23:57:57","date_gmt":"2004-12-14T03:57:57","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/12\/13\/lani-guinier-could-clear-this"},"modified":"2011-08-05T14:58:08","modified_gmt":"2011-08-05T18:58:08","slug":"lani-guinier-could-clear-this-up","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/12\/13\/lani-guinier-could-clear-this-up\/","title":{"rendered":"lani guinier could clear this up"},"content":{"rendered":"<p><a name='a2913'><\/a><\/p>\n<blockquote><p>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">Earlier today, <\/FONT><A href=\"http:\/\/volokh.com\/#106867040980153099\"><FONT face=\"Times New Roman,Times,Serif\">Eugene Volokh<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">&nbsp;echoed <\/FONT><A href=\"http:\/\/bluemassgroup.typepad.com\/blue_mass_group\/2004\/12\/total_incompete.html\"><FONT face=\"Times New Roman,Times,Serif\">David Kravitz<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">&#8216;s complaint that the &#8220;mainstream press&#8221;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">has apparently falsely <\/FONT><A href=\"http:\/\/www.foxnews.com\/story\/0,2933,141228,00.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">accused<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;Harvard Law Prof. <\/FONT><A href=\"http:\/\/en.wikipedia.org\/wiki\/Lani_Guinier\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Lani Guinier<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;of failing to pay Social Security<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">taxes for a domestic worker in her employ.&nbsp; They decry the irresponsible, sloppy journalism and<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">suggest it means the mainstream press can&#8217;t be trusted on other issues.&nbsp;&nbsp; Both cover their butts<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">by asking to be corrected, if they are wrong about the facts from 1993.<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/journalist.gif\" alt=\"journalist\" \/> A few things bother me about this: <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Eugene and David make strong accusations <EM>without<\/EM> knowing the facts with certainty &#8212; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">they base them on their personal recollection from 11 years ago of what would have been <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">a secondary issue for Guinier.&nbsp;&nbsp; Based on memory, Kravitz decries <\/FONT><A href=\"http:\/\/www.finalcall.com\/artman\/publish\/article_1661.shtml\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Total Incompetence<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">.<\/FONT><\/DIV><br \/>\n<LI><FONT size=\"2\"><br \/>\n<DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">they are willing to tar the entire mainstream <\/FONT><FONT size=\"2\">press, when &#8212; <\/FONT><FONT size=\"2\">as with webloggers &#8212; some <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">journalists are far more careful than others; and <\/FONT><\/DIV><\/DIV><\/FONT><br \/>\n<LI><FONT size=\"2\"><br \/>\n<DIV><br \/>\n<DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">they <\/FONT><FONT size=\"2\">could <\/FONT><FONT size=\"2\">have held their (ideologically or politically loosened?) tongues until they&nbsp;got<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">more definitive <\/FONT><FONT size=\"2\">information: from&nbsp;Prof. Guinier herself or the assailled reporters.<\/FONT><\/FONT><\/DIV><\/DIV><\/DIV><\/FONT><\/LI><\/UL><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">1993 being the Dark Ages as far as online newspaper resources, I have not been able to confirm<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the facts here, either.&nbsp; I did find, however, the following excerpt in Prof. Guinier&#8217;s book <\/FONT><A href=\"http:\/\/www.amazon.com\/exec\/obidos\/ASIN\/0684811456\/ref=sib_rdr_dp\/104-1569557-1267912\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\"><EM>Lift Every Voice :<\/EM><\/FONT><\/A><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;<EM>Turning a Civil Rights Setback Into a New Vision of Social Justice <\/EM>(1998).&nbsp; At <\/FONT><A href=\"http:\/\/www.amazon.com\/gp\/reader\/0684811456\/ref=sib_vae_pg_36\/104-1569557-1267912?%5Fencoding=UTF8&amp;keywords=%22Social%20Security%22&amp;p=S015&amp;twc=3&amp;checkSum=Xrz2u7G7vn31OSLe4BRUe46AWLADw7oolu%2BNlunnhDY%3D#reader-page\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">page 36<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, she is describing<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">the very first press conference after her nomination was announced, and she says (emphasis added):<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8221;&nbsp;the weight of my description of how prior administrations had tolerated actual examples <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of intentional discrimination was more than the reporters wanted to hear that day.&nbsp;&nbsp; Afterwards, <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">my fellow nominees thanked me for what they took as a filibuster. <STRONG>From their perspective, I had&nbsp;<\/STRONG><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><STRONG>successfully distracted the press, whose interest in nonpayment of Social Security taxes could <\/STRONG><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><STRONG>not regain momentum&#8221;<\/STRONG><\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">So, the issue was out there, although I do not know the context and Guinier does not broach the topic<\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">again in the book.&nbsp; Prof. Volokh tells me that no articles that he has found from 1993 mention the tax issue. <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">It would be great if Prof. Guinier (who is still very good at getting press <\/FONT><A href=\"http:\/\/www.finalcall.com\/artman\/publish\/article_1661.shtml\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">coverage<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">) <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">could help us all with the facts &#8212; if the <\/FONT><FONT size=\"2\">mainstream press doesn&#8217;t <\/FONT><FONT size=\"2\">dig out some quotes by their morning <\/FONT><FONT size=\"2\">editions to silence the gleeful naysayers. <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman\" size=\"2\"><STRONG><EM><FONT color=\"red\">update <\/FONT><\/EM><\/STRONG>(Dec. 14, 2004): Prof. <A href=\"http:\/\/volokh.com\/archives\/archive_2004_12_14.shtml#1103041526\"><FONT color=\"black\">Volokh points<\/FONT><\/A> to a <A href=\"http:\/\/www.washingtonpost.com\/wp-dyn\/articles\/A62389-2004Dec13.html\">Correction<\/A> in today&#8217;s <EM>Washington Post<\/EM> that states:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">&#8220;A Dec. 12 article incorrectly said that Lani Guinier&#8217;s nomination to head the Justice Department&#8217;s <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">civil rights division under President Bill Clinton was withdrawn because of a &#8220;nanny problem.&#8221;
