( <\/FONT><A href=\"http:\/\/www.blawgchannel.com\/2004\/11\/tasteful_and_em.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"#000000\" size=\"2\">Ernie<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&nbsp;touted the &#8220;tasteful&#8221; ads earlier this month.)&nbsp; <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">I&#8217;d like&nbsp;to highlight two issues:&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/wolfdudeneg.gif\" alt=\"wolf dude neg\" \/>&nbsp; &nbsp;<STRONG>Ross Fishman says<\/STRONG>:&nbsp; &#8220;[Y]ou comment skeptically that this will inevitably lead to&#8221;&#x2026;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">higher profits for <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">some lawyers, without an increase in the quality of legal services&#8221;? Well, yes, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">that&#8217;s our goal.&nbsp; <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">We&#8217;re an ad agency, not Legal Aid; we can&#8217;t practice law or control the quality <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">of the legal <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">services of our clients. Our specific goal is to generate significantly higher profits for <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">some <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">lawyers &#8212; our clients &#8212; just as mega-ad agency Leo Burnett&#8217;s goal has long been to generate <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">more sales and higher profits for Pillsbury using the Dough Boy. Hey, it&#8217;s the American way.&#8221;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">&nbsp;&nbsp;<\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&nbsp;winter nears &#x2013;<BR>&nbsp;&nbsp;&nbsp;in the dog&#8217;s eyes<BR>&nbsp;&nbsp;&nbsp;the wolf<BR><\/DIV><\/BLOCKQUOTE><\/FONT><\/FONT><br \/>\n<P><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<FONT color=\"#ff0000\">&nbsp;&nbsp; <\/FONT><\/FONT><\/FONT><A href=\"http:\/\/www.theheronsnest.com\/haiku\/0412a1906\/thn_issue.c1.html\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#ff0000\" size=\"1\">Billie Wilson<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"> <\/FONT><\/P><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\"><STRONG>Your Editor&#8217;s Reply<\/STRONG>:&nbsp;&nbsp; An ad agency may not have a special duty toward the legal client, but lawyers<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">certainly do.&nbsp; &nbsp;Consumers can readily tell&nbsp;whether Pillsbury biscuits are worth their premium price<\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">, and&nbsp;lose <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">little giving it a&nbsp;try.&nbsp; &nbsp;But, the average&nbsp;consumer of legal services cannot readily judge quality or price, which<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">is one reason why&nbsp;clients are given fiduciary protection.&nbsp;&nbsp;A lawyer&#8217;s using PR image-making (and faux empathy)<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">to <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">create a platform for higher fees, unrelated to the quality of services, does not jibe with my concept of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">fiduciary responsibility.&nbsp; Unlike the legal profession, Pillsbury has never claimed to put its customers&#8217; interests first and has never <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">sworn to do so.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>&nbsp; <STRONG>Ross<\/STRONG> notes that <EM>Lawyers Weekly<\/EM>, despite its excellent work, may not always &#8220;get every single<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">fact correct,&#8221; but confirms that &#8220;Lorne [MacLean, the ad client in the story] had just spun <\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">off his divorce <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">practice from his partner.&#8221;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><EM>the wolf too<BR>peeks out his hole&#8230;<BR>autumn dusk<\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV><FONT face=\"Times New Roman,Times,Serif\" color=\"#ff0000\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><A href=\"http:\/\/cat.xula.edu\/issa\/searchissa.php?sorter=date&amp;s_string=the+wolf+too&amp;season=&amp;s_date=\"><STRONG><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#ff0000\" size=\"1\">Issa<\/FONT><\/STRONG><\/A><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"1\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#ff0000\">,<\/FONT> translated by D.
