{"id":5135,"date":"2004-11-20T12:14:32","date_gmt":"2004-11-20T16:14:32","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/11\/20\/do-ads-subtract-big-ones-sure"},"modified":"2011-08-05T14:58:13","modified_gmt":"2011-08-05T18:58:13","slug":"do-ads-subtract-big-ones-sure-do","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/11\/20\/do-ads-subtract-big-ones-sure-do\/","title":{"rendered":"do ads subtract?  big ones sure do!"},"content":{"rendered":"<p><a name='a2741'><\/a><\/p>\n<blockquote><p>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">Denise Howell got it right: <\/FONT><A href=\"http:\/\/bgbg.blogspot.com\/2004\/11\/watching-blawgs-go-by.html\"><FONT face=\"Times New Roman,Times,Serif\">&#8220;Oy&#8221;<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> is her response to the pumped-up ads that Law.com<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">has required for entry into its new Weblog <\/FONT><A href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/about.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">Network<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\">.&nbsp; [The <\/FONT><A href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/about.html\"><FONT face=\"Times New Roman,Times,Serif\">eight weblogs<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> are all top-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">notch and I hope their authors will resist any urge for self-censoring to avoid displeasing <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">their <\/FONT><FONT size=\"2\">corporate sponsor.&nbsp; They <FONT color=\"black\">all <\/FONT><A href=\"http:\/\/www.mayitpleasethecourt.net\/journal.asp?blogid=513\"><FONT color=\"black\">insist<\/FONT><\/A><FONT color=\"black\"> that this new arrangement <\/FONT><A href=\"http:\/\/federalism.typepad.com\/crime_federalism\/2004\/11\/a_few_changes.html\"><FONT color=\"black\">won&#8217;t<\/FONT><\/A><FONT color=\"black\"> change <\/FONT><A href=\"http:\/\/volokh.com\/archives\/archive_2004_11_14.shtml#1100892260\"><FONT color=\"black\">them<\/FONT><\/A><FONT color=\"black\">.]<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">It&#8217;s a little ironic that one of the new Networkians Commented <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/discuss\/msgReader$404?mode=day\"><FONT face=\"Times New Roman,Times,Serif\">here<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\"> last year that <\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">&#8220;I don&#8217;t like the idea of law bloggers posting ads at their site. I don&#8217;t <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">know <\/FONT><FONT size=\"2\">whether it&#8217;s ethical or not, but it just looks cheap.&#8221; <\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\">(see <\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">the <EM>OJR<\/EM>&nbsp;<\/FONT><A href=\"http:\/\/www.ojr.org\/ojr\/business\/1015015782.php\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">article<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\"> &#8220;Will Microads Save Online Content? The next big <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">thing could be quite small,&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">written by Mathew Honan,&nbsp; praising inobtrusive text ads and panning banner ads.&nbsp; Despite our<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">initial visual confusion, Honan, is <\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\"><EM>not <\/EM><\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">Matt Homann, proprietor <\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">of the Law.com Network weblog <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\"><A href=\"http:\/\/thenonbillablehour.typepad.com\/nonbillable_hour\/2004\/11\/drum_roll_pleas.html\"><FONT color=\"black\">the&nbsp;[non]billable hour<\/FONT><\/A>).<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/bigeventneg.gif\" alt=\"big event neg\" \/>&nbsp; <\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">I hope weblog readers will urge Lisa Stone of law.<FONT color=\"black\">com&#8217;s&nbsp;<A href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2004\/11\/why_blogs.html\"><FONT color=\"black\">Legal Blog Watch<\/FONT><\/A>&nbsp;<\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\"><FONT color=\"black\">to<\/FONT>&nbsp;&nbsp;<\/FONT><\/FONT><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">lobby <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">on behalf of her Networkians to have the required ads greatly reduced in <\/FONT><FONT size=\"2\">size.&nbsp; Such <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">e-billboards are&nbsp;<\/FONT><A href=\"img\" name=\"496\" \/>&gt;<FONT face=\"Times New Roman,Times,Serif\" color=\"black\">tacky<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">&nbsp;and unnecessary &#8212; and may prove to turn off a lot <\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">of visitors <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">(and ex-visitors).&nbsp; The silly flipping rolodex ad that is featured on many <\/FONT><FONT size=\"2\">other law.com <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">pages today is even more annoying than <A href=\"http:\/\/www.eddixllc.com\/public_home1.asp\"><FONT color=\"black\">EDDix<\/FONT><\/A>&#8216; infamous <\/FONT><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">&#8220;confounded scrolling <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><A href=\"http:\/\/www.google.com\/url?sa=U&amp;start=5&amp;q=http:\/\/bgbg.blogspot.com\/2004\/07\/foremarket.html&amp;e=747\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">ticker thingy<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">.&#8221;<\/FONT><\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" size=\"2\">Law.com\/ALM knows that bigger is not better.&nbsp; The Network weblogs are stuck with<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">an ad that is 3.25 inches wide and 5 inches high at the <\/FONT><FONT size=\"2\">very top of their righthand margin. <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">There <\/FONT><FONT size=\"2\">are no such monstrosities on&nbsp;<FONT color=\"black\">Law.com <\/FONT><\/FONT><FONT color=\"black\"><FONT size=\"2\">own <\/FONT><FONT size=\"2\"><A href=\"http:\/\/www.law.com\/index.shtml\">homepage<\/A>.&nbsp; It&#8217;s Newswire page does <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">have a 2.75 inch ad, but it comes <EM>after <\/EM>links to the <\/FONT><FONT size=\"2\">important stories in the day&#8217;s edition.&nbsp; <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT color=\"black\"><FONT face=\"Times New Roman,Times,Serif\"><FONT size=\"2\">It is only on its non-substantive Index page and <\/FONT><FONT size=\"2\">on its new Weblog Network pages, that <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\" size=\"2\">the 3.25 inch Big Box ads are found.&nbsp; I think we can&nbsp;deduce the real answer to Law.com&#8217;s<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">question <\/FONT><A href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2004\/11\/why_blogs.html\"><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">&#8220;Why Blogs?&#8221;<\/FONT><\/A><FONT face=\"Times New Roman,Times,Serif\" color=\"black\">.<\/FONT><\/FONT><\/DIV><\/FONT><\/DIV><\/LI><\/UL><FONT face=\"Times New Roman\"><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><STRONG><EM><FONT color=\"red\">p.s.<\/FONT><\/EM><\/STRONG>&nbsp; <FONT size=\"2\">There&#8217;s an interesting <A href=\"http:\/\/www.firstamendmentcenter.org\/analysis.aspx?id=14394\"><FONT color=\"black\">piece on lawyer ads<\/FONT><\/A><FONT color=\"black\"> at First Amendment Center.&nbsp; In it, John Bates of<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><I><A href=\"http:\/\/www.firstamendmentcenter.org\/faclibrary\/case.aspx?case=Bates_Arizona\"><FONT color=\"black\">Bates v.
