{"id":5118,"date":"2004-11-07T20:59:12","date_gmt":"2004-11-08T00:59:12","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/11\/07\/oh-that-shakespeare-he-just-s"},"modified":"2011-08-05T14:58:16","modified_gmt":"2011-08-05T18:58:16","slug":"oh-that-shakespeare-he-just-slays-me","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/11\/07\/oh-that-shakespeare-he-just-slays-me\/","title":{"rendered":"oh, that Shakespeare, he just slays me!"},"content":{"rendered":"<blockquote>\n<div><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Thanks to a Google search listed on our\u00a0<a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stats\/referers\"><span style=\"color: black\">Referer <\/span><\/a>page, I discovered three new-to-me\u00a0items relating to\u00a0Shakespeare and the &#8220;Kill All the Lawyers&#8221; quote.\u00a0 A thoughtful &#8220;middle&#8221; position on just what Shakespeare meant is offered by Kory Swanson, Vice President of the <\/span><a href=\"http:\/\/www.johnlocke.org\/about\/\"><span style=\"font-family: Times New Roman,Times,Serif;color: black;font-size: x-small\">John Locke Foundation<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">, and is discussed in <\/span><a href=\"http:\/\/www.carolinajournal.com\/issues\/display_story.html?id=962\"><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\">&#8220;<em>Let&#8217;s Kill All the Lawyers&#8221; and Other Insights from the Bard<\/em><\/span><\/span><\/a><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><em>: Shakespeare&#8217;s multi-layered commentary on the law,<\/em> by <\/span><\/span><a href=\"http:\/\/www.carolinajournal.com\/cjcolumnists\/display_author.html?id=72\"><span style=\"font-family: Times New Roman,Times,Serif;color: #000000;font-size: x-small\">Teresa Nichols<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> (<em>Carolina Journal Online<\/em>, July 31, 2003).\u00a0 According to Nichols, Swanson concludes that\u00a0&#8220;Shakespeare truly intended the phrase to be a portrayal of corrupt lawyers and the laws they pervert as the true enemies to sound government, justice, and freedom.&#8221;\u00a0 (your Editor&#8217;s take on Shakespeare and Lawyers can be found <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$950\"><span style=\"font-family: Times New Roman,Times,Serif;color: black\">here<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;color: black\">)<\/span><\/span><\/div>\n<div><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> <\/span><\/div>\n<div><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">On the less-thoughtful other hand, I finally read &#8220;<em><a href=\"http:\/\/www.michbar.org\/journal\/article.cfm?articleID=401&amp;volumeID=30&amp;viewType=archive\">In Defense of Shakespeare<\/a><\/em>: An Open Letter to All Lawyers Who Think Shakespeare Said &#8220;Let&#8217;s Kill All the Lawyers.&#8221;\u00a0by John Mayer (&#8220;a management consultant in the legal environment&#8221;).\u00a0 Here are the opening and closing sentences of the article from the <em>Michigan Bar Journal<\/em> (Feb. 2002)\u00a0:<\/span><\/div>\n<blockquote>\n<div><em><span style=\"font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\"><strong>I<\/strong><span style=\"color: #000000\">t was dismaying to hear a participant in a panel discussion at last year\u2019s State Bar Annual Meeting refer to enduring popular disaffection with our profession by saying: \u2018\u2018Shakespeare said, \u2018Let\u2019s kill all the lawyers.\u2019\u2019\u2019 These words should never pass the lips of any lawyer, much less an advocate of national repute.<\/span><\/span><\/span><\/em><\/div>\n<div><em><span style=\"font-family: Times New Roman;font-size: x-small\">. . . <\/span><\/em><\/div>\n<div><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><em>But Shakespeare did not say: \u2018\u2018Let\u2019s kill all the lawyers.\u2019\u2019 Dick the Butcher said it. And anyone who says Shakespeare said it does the legal profession harm. And anyone knowing it to be false who says Shakespeare said it does the legal profession intentional harm. <\/em><\/span><\/div>\n<\/blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/theaterkingsm.gif\" alt=\"theater king sm\" \/> Oh, my!\u00a0 I sure hope Mayer hasn&#8217;t been forced to watch the 1992 movie &#8220;<\/span><a href=\"http:\/\/www.michbar.org\/journal\/article.cfm?articleID=401&amp;volumeID=30&amp;viewType=archive\"><em><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">Let&#8217;s Kill All the Lawyers<\/span><\/em><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">,&#8221; written and directed by <\/span><a href=\"http:\/\/www.imdb.com\/name\/nm0784374\/\"><span style=\"font-family: Times New Roman,Times,Serif;color: black;font-size: x-small\">Ron Senkowski<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">.\u00a0 The movie got a pretty good <\/span><a href=\"http:\/\/www.anchoragepress.com\/archives\/document7058.html\"><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">review<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\"> in the <em>Anchorage Press<\/em>, by Ed Carroll, July 23-29, 1998 \/ Vol. 7, Ed. 29.\u00a0 Carroll says that three very disparate groups will be pleased by the film, and asserts: &#8220;Every lawyer should see this movie. Every down-and-out conspiracy freak who believes a lawyer ruined their lives should see this movie. Above all, fans of small independent film should see <em>Let\u2019s Kill All the Lawyers.&#8221; <\/em> He adds:<\/span><\/div>\n<blockquote><p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;Senkowski himself was a law student, working in a law firm, before the stifling quest for money turned his idealism toward filmmaking. The movie has an insider\u2019s sensibility. <\/span><\/p>\n<div dir=\"ltr\">\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;The satire works entirely on the surface for lawyer-bashers, who will see their own \u201clawyer-equals-subhuman-pond-scum\u201d fantasies played out before them in a weasly, criminally unscrupulous and funny romp. For those who choose to forget that the unfettered practice of law is essential to any worthwhile democracy, the unrepentant lawyers created here will sustain their destructive anger for weeks. But, as that Saturday morning cartoon used to warn, if you\u2019re not careful, you might learn something.\u00a0 . . .<\/span><\/p>\n<p><span style=\"font-family: Times New Roman,Times,Serif;font-size: x-small\">&#8220;The plot, in a nutshell, sees the protagonist law student freak out, drop out, and create a mythical, beautiful avenging angel who will either convert the bad lawyers to nice, well-adjusted lawyers, or torture them to a fitting end.&#8221; <\/span><\/div>\n<\/blockquote>\n<p><span style=\"font-family: Geneva,Arial,Sans-Serif;font-size: x-small\"><span style=\"font-family: Times New Roman,Times,Serif\">I couldn&#8217;t find the film at Amazon.com, but it sounds like fun.\u00a0 Indeed, Carroll says it is &#8220;an opportunity for lawyers to laugh at themselves with a portrayal that flies far above the epidemic of dipshit lawyer jokes. &#8221;\u00a0 As we noted <\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/11\/05#a2665\"><span style=\"font-family: Times New Roman,Times,Serif;color: black\">yesterday<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\">, that laughter\u00a0will <\/span><a href=\"http:\/\/www.dcbar.org\/for_lawyers\/washington_lawyer\/november_2004\/president.cfm\"><span style=\"font-family: Times New Roman,Times,Serif;color: black\">upset<\/span><\/a><span style=\"font-family: Times New Roman,Times,Serif\"> DC Bar President John C. Keeney, Jr., but I won&#8217;t be reporting you to Bar <\/span><span style=\"font-family: Times New Roman,Times,Serif\">Counsel. <\/span><\/span><\/p>\n<ul>\n<li><span style=\"font-family: Times New Roman;font-size: x-small\">Trivia: <a href=\"This was the first film to use the now common Avid digital editing system.\"><span style=\"color: black\">IMBD<\/span><\/a> says the Senkowski\u00a0movie &#8220;was the first film to use the now common Avid digital editing system.&#8221;<\/span><\/li>\n<li><span style=\"font-family: Times New Roman;font-size: x-small\">By the way, according to <em>Entertainment Law Digest<\/em>, a <a href=\"http:\/\/www.entlawdigest.com\/story.cfm?storyID=2053\"><span style=\"color: black\">lawsuit <\/span><\/a>was filed when the producer of a movie called <em>Let&#8217;s Kill All the Lawyers <\/em>failed to have the film ready as promised in Spring 1997 &#8212; Barrister Films, Ltd. v.
