lawsuits, but they seriously <\/FONT><FONT face=\"Times New Roman\">need <\/FONT><FONT face=\"Times New Roman\">to <EM>define the term<\/EM>.&nbsp; As we have <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/discuss\/msgReader$2140?mode=topic&amp;y=2004&amp;m=9&amp;d=15\">noted<\/A> often (<EM>e.g<\/EM>., this <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2003\/09\/07#a253\">post<\/A>, and Comments <\/FONT><A href=\"http:\/\/declarationsandexclusions.typepad.com\/weblog\/2004\/09\/yes_virginia_at.html\"><FONT face=\"Times New Roman\">here<\/FONT><\/A><FONT face=\"Times New Roman\"> and <\/FONT><A href=\"http:\/\/www.legalunderground.com\/2004\/09\/the_acs_blog_is.html#comments\"><FONT face=\"Times New Roman\">here<\/FONT><\/A><FONT face=\"Times New Roman\">): a claim can be meritless but not frivolous<\/FONT><FONT face=\"Times New Roman\">.&nbsp;&nbsp;
