{"id":4791,"date":"2004-04-17T20:34:27","date_gmt":"2004-04-18T00:34:27","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/04\/17\/making-sausage-and-lawblogs\/"},"modified":"2011-08-05T14:58:52","modified_gmt":"2011-08-05T18:58:52","slug":"making-sausage-and-lawblogs","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/04\/17\/making-sausage-and-lawblogs\/","title":{"rendered":"making sausage and lawBlogs"},"content":{"rendered":"<p><a name='a1263'><\/a><\/p>\n<p><P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Hey law students, I just&nbsp;<A href=\"http:\/\/andrewsinclair.org\/archive\/lexblog_launches.htm\">learned<\/A> from the weblog of <A href=\"http:\/\/andrewsinclair.org\/archive\/about_andrew_sinclair.htm\">Andrew Sinclair<\/A>&nbsp;(a 3L at Boston University Law School), that <A href=\"http:\/\/www.lexblog.com\/\">lexBlog<\/A>&nbsp;<U>is looking for volunteer interns<\/U>.&nbsp;&nbsp;An April 13 discussion board&nbsp;<A href=\"http:\/\/www.lawschooldiscussion.org\/students\/index.php\/topic,312.0\">posting<\/A> by Kevin O&#8217;Keefe asks: &#8220;Have other paying employment and looking for ways to enhance resume or to work towards part-time employment?&#8221; &nbsp;And replies:&nbsp;&#8220;Doing virtual volunteer work for new Internet company in the business of helping lawyers help people could be the answer.&#8221;&nbsp; <\/FONT><\/P><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">LexBlog interns would be:<\/FONT><\/P><br \/>\n<BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;helping publish content to blogs and in effect creating online magazines\/broadcast channels for leading lawyers around the country.&#8221;<\/FONT><\/P><\/BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/mouselawyersmall.jpg\" alt=\"mouse lawyer small\" \/>&nbsp; I know using volunteer interns is not inconsistent with creating high-quality content, but it does shed a different light on the <A href=\"http:\/\/www.lexblog.com\/packages\/packages_lexplus.html\">lexBlog&nbsp;claim<\/A> that <FONT face=\"Arial\" size=\"2\">&#8220;All content is regularly revised, updated and improved by a staff of lawyer-editors, to make sure that it&#8217;s the best it can be.<\/FONT>&#8220;<\/FONT><\/P><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">I&#8217;m not sure why, but this week-long&nbsp;angsting over&nbsp;the implications of lexBlog&#8217;s&nbsp;services&nbsp; reminds me of the <A href=\"http:\/\/www.illinoisbar.org\/Member\/feb97president.html\">cliche<\/A> about making laws and sausage.&nbsp;&nbsp; Like Peter Merholz, who <A href=\"peterme.com.\">coined<\/A> the word by&nbsp;cruelly butchering &#8220;weblog&#8221;, I <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/01\/21#a564\">continue<\/A> to believe&nbsp;that &#8220;blog&#8221; sounds far too much like&nbsp;the&nbsp;reaction one might have to watching sausage being made.&nbsp; Now, &#8220;lawBlog&#8221; is giving me agita, too.<\/FONT><\/P><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/redchecksmall001.gif\" alt=\"check red\" \/>&nbsp; Yesterday (04-16) <A href=\"http:\/\/bgbg.blogspot.com\/2004_04_11_bgbg_archive.html#108206801770325407\">Denise Howell<\/A>&nbsp;at B&amp;B&nbsp;updated <A href=\"http:\/\/bgbg.blogspot.com\/2004_04_11_bgbg_archive.html#108206801770325407\">her posting<\/A> on ghost-weblogs.&nbsp; Denise&nbsp;added: &nbsp;&#8220;I&#8217;m happy to say the conversation continued in my <A href=\"http:\/\/rateyourmusic.com\/yaccs\/commentsn\/blog_id=90000002214_and_blog_entry_id=1082068017\">comments<\/A>, where <A href=\"http:\/\/www.kevinokeefe.com\/\">Kevin<\/A> clarified that weblog material purchased from <A href=\"http:\/\/lexblog.com\/\">lexBlog<\/A> appearing on its clients&#8217; sites will be identified as such, so it won&#8217;t be anonymous ghostwriting but more like &#8216;value added.&#8217; That&#8217;s great, as is Kevin&#8217;s likely well-founded hope that once his clients experience blogging for themselves their garrulous nature will take its course.&#8221;&nbsp; <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">I agree with Denise that this is <STRONG>good news, <EM>if <\/EM>third-party content is <EM>clearly designated<\/EM> as such<\/STRONG> &#8212; that is, in a manner that will not leave the ordinary consumer confused as to the source of the materials.&nbsp;&nbsp;[See the <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/17#a1261\">discussion<\/A> earlier today on this page, in response to Jerry Lawson&#8217;s Comments and post.]&nbsp; I&#8217;m looking forward to seeing&nbsp;how&nbsp;lexBlog sites look and feel in operation. If any already exist, I hope Kevin will point us over.<\/FONT><\/DIV><\/LI><\/UL><\/LI><\/UL><br \/>\n<P><FONT face=\"Arial\" size=\"2\">I wonder what my good friend <EM><A href=\"http:\/\/declarationsandexclusions.typepad.com\/foolblog\/\">foolEsq<\/A><\/EM> would do after a week like this? . . <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/wine.gif\" alt=\"wine\" \/> . . It&#8217;s been around a long time. <\/FONT><\/P><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><STRONG>Your Editor<\/STRONG>:&nbsp; F<FONT face=\"Arial\" size=\"2\">ar from saying that lawyer ghost-writing is particularly a weblog problem, <STRONG>my entire point is that it has<\/STRONG> <STRONG>not previously been a problem with weblogs<\/STRONG> &#8212; which is why I want to help stop that practice before it becomes entrenched or accepted<\/FONT><\/FONT><\/P><br \/>\n<BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">If you are too busy to actually maintain a weblog, you perhaps shouldn&#8217;t try to become a <STRONG>weblog editor-poseur<\/STRONG><FONT face=\"Verdana\"> <\/FONT><\/FONT><\/P><\/BLOCKQUOTE><\/BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Verdana\">I&#8217;m also pleased to note that 3L <STRONG>Andrew Sinclair<\/STRONG> has accepted my invitation to join this discussion, with a thoughtful post <A href=\"http:\/\/andrewsinclair.org\/archive\/lexblog_spurs_ethics_debate.htm\">at his weblog<\/A>.&nbsp;&nbsp; Andrew opines, <EM>inter alia<\/EM>, that:<\/FONT><\/FONT><\/P><br \/>\n<BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Verdana\">&#8220;I might not want to see how Hillshire Farms makes their delicious Polish Sausage, but I want to see the ingredients listed on the package, and I definitely want food inspectors in there checking things out.
