You hired a lawyer . . Now it&#8217;s his fortune.&#8221;<\/em> <\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"> <\/span><span style=\"font-family: Arial;font-size: x-small\">It was a pretty funny lawyer joke, but two Colorado bar groups were so offended that\u00a0they&#8217;ve forced the <\/span><a href=\"http:\/\/denver.bbb.org\/\"><span style=\"font-family: Arial;font-size: x-small\">Denver\/Boulder branch<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> of the <strong>Better Business Bureau<\/strong> to pull\u00a0its 15-second &#8220;check with us first&#8221;\u00a0 tv ad from the air.\u00a0 The BBB&#8217;s sin: daring to suggest that consumers might obtain useful information about lawyers from the Bureau.<\/span><\/p>\n<div><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">According to an <\/span><a href=\"http:\/\/www.rockymountainnews.com\/drmn\/business\/article\/0,1299,DRMN_4_2726407,00.html\"><span style=\"font-family: Arial;font-size: x-small\">article<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> from the <em>Rocky Mountain News<\/em>, the <\/span><a href=\"http:\/\/www.denbar.org\/\"><span style=\"font-family: Arial;font-size: x-small\">Denver<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> and <\/span><a href=\"http:\/\/www.cobar.org\/\"><span style=\"font-family: Arial;font-size: x-small\">Colorado<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> bar associations, brought their complaints before the BBB&#8217;s new advertising and ethics committee, complaining that &#8220;the ad was offensive and demeaning to their profession.&#8221;\u00a0\u00a0(&#8220;BBB pulls ad after flak from attorney groups,&#8221; by John Accola, 03-13-04) (thanks to <\/span><a href=\"http:\/\/www.overlawyered.com\"><span style=\"font-family: Arial;font-size: x-small\">W.O<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\">. for the pointer)\u00a0 The article reports that,<\/span><\/div>\n<blockquote>\n<p style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">&#8220;With 12 members voting, the committee advised the BBB to pull the ad and reword the narrative. One suggestion called for revising the &#8220;You hired a lawyer&#8221; line to &#8216;You hired the <em>wrong<\/em> lawyer.'&#8221;<\/span><\/p>\n<\/blockquote>\n<p style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">The local BBB president complied, noting:<\/span><\/p>\n<blockquote>\n<p style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">&#8220;I don&#8217;t agree with them . . . but I don&#8217;t want to go around ticking people off,&#8221; said Jean Herman, president and chief executive of the Denver\/Boulder BBB. &#8220;I have to respect their opinion.&#8221;<\/span><\/p>\n<\/blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">As if this doesn&#8217;t make the legal profession look bad enough, <\/span><a href=\"http:\/\/www.denbar.org\/staff.htm\"><span style=\"font-family: Arial;font-size: x-small\">Greg Martin<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\">, deputy executive director of both bar groups, declared that they\u00a0would <em>not<\/em> even approve the modified narrative, &#8220;You hired the <em>wrong<\/em> lawyer,&#8221; saying <\/span><\/div>\n<blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"> &#8220;[O]ur goal was not to have that ad on TV anymore.&#8221;\u00a0\u00a0\u00a0\u00a0..<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/SmallSharkgrayflip.jpg\" alt=\"smallest shark gray flip\" \/> <\/span><\/div>\n<\/blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">The <em>RMN <\/em>article states, &#8220;Martin said poking fun of bad lawyers isn&#8217;t the same as disparaging, say, bad plumbers. . . . The BBB isn&#8217;t in a position to judge crooked lawyers from the honest ones, Martin said.&#8221;<\/span><\/div>\n<blockquote>\n<blockquote>\n<div style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial\"><span style=\"font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/SmallSharkgray.jpg\" alt=\"smallest shark gray\" \/> <strong>&#8220;For them to hold themselves out as having some special knowledge about attorneys is really inappropriate.&#8221;<\/strong><\/span><\/span><\/div>\n<\/blockquote>\n<\/blockquote>\n<div><span style=\"font-family: Arial;font-size: x-small\">Martin emphasized that Colorado&#8217;s lawyers are highly regulated.\u00a0 I bet he did <em>not<\/em> point out, as <\/span><a href=\"http:\/\/www.halt.org\"><span style=\"font-family: Arial;font-size: x-small\">HALT<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> did in its 2002 <\/span><a href=\"http:\/\/www.halt.org\/reform_projects\/lawyer_accountability\/report_card\/coloradorc.pdf\"><span style=\"font-family: Arial;font-size: x-small\">Report Card<\/span><\/a><span style=\"font-family: Arial\"><span style=\"font-size: x-small\">, that Colorado has <span style=\"color: #292526\">&#8220;the seventh worst investigation rate in the nation,&#8221; looking into less than 10% of grievances filed.<\/span><\/span><\/span><\/div>\n<ul>\n<li><span style=\"font-family: Arial;font-size: x-small\">The effectiveness of the ads almost certainly bothered the Colorado\u00a0lawyers\u00a0&#8212; there was a fourfold increase in consumer inquiries last month on legal services, compared to February 2003 (from 158 to 639 requests for a &#8220;reliability report&#8221;).\u00a0 But, I have to credit spokesman Martin for his frankness about their primary purpose &#8212; the bar groups want no monitoring of lawyer conduct and client\u00a0complaints by nonlawyer organizations (especially not respected ones).<\/span><\/li>\n<\/ul>\n<div><span style=\"font-family: Arial;font-size: x-small\">The facts of the BBB situation show just how extreme the bar&#8217;s position is.\u00a0 T<span style=\"font-family: Arial;font-size: x-small\">he BBB specifically says that it <a href=\"http:\/\/complaints.bbb.org\/Welcome.asp#dont\">does not handle<\/a> &#8220;Complaints raising issues concerning the <em>competency<\/em> of doctors, dentists, licensed therapists, veterinarians, and <em>lawyers<\/em>.&#8221;\u00a0 Instead, in order to &#8220;Help consumers make informed pre-purchase decisions,&#8221; the BBB <a href=\"http:\/\/www.denver.bbb.org\/complaint.html\">handles <em>marketplace issues<\/em><\/a>, that is<\/span><\/span><\/div>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<div style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">&#8220;Complaints involving marketplace activities &#8212; misleading advertising, improper selling practices, non-delivery of goods or services, misrepresentation, un-honored guarantees or warranty, unsatisfactory service, credit\/billing problems, contracts not fulfilled, etc., are handled by the Better Business Bureau where the company is located.&#8221;<\/span><\/span><\/div>\n<\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<div style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">In performing this role,<\/span><\/div>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<div style=\"margin-right: 0px\" dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/handshakemf001.gif\" alt=\"handshake\" \/> &#8220;BBB does not take either side in a dispute. Instead, we work to facilitate communication between the company and the consumer, to help both sides come to a satisfactory resolution to the complaint.&#8221;\u00a0 It does:<\/span><\/span><\/div>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<ul><span style=\"font-family: Arial;font-size: x-small\"><\/p>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Advocate mediation to resolve disputes <\/span><\/div>\n<\/li>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Award only two levels of ratings to businesses \u2013\u00a0 \u201cUnsatisfactory\u201d or \u201cSatisfactory\u201d <\/span><\/div>\n<\/li>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Emphasize preventative steps to avoid a dispute, not just remedial steps after it has occurred <\/span><\/div>\n<\/li>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Gather and deliver information about buyers\/sellers in an objective manner <\/span><\/div>\n<\/li>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Give all sides in a dispute a fair and reasonable chance to cure\/resolve <\/span><\/div>\n<\/li>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Help consumers make informed pre-purchase decisions <\/span><\/div>\n<\/li>\n<li>\n<div style=\"margin-right: 0px\"><span style=\"font-family: Arial;font-size: x-small\">Keep records on all sorts of transaction-related disputes over a three-year period <\/span><\/div>\n<\/li>\n<p><\/span><\/ul>\n<\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/p>\n<div><span style=\"font-family: Arial;font-size: x-small\">In contrast to this practical, informal process aimed at resolving disputes, the bar associations have two basic suggestions for a client with a complaint: (1) try to work it out with your lawyer; and (2) file a formal complaint.\u00a0\u00a0 Of course, the<a href=\"http:\/\/www.cobar.org\/CFwebFiles\/Content\/dspGeneralEntityData.cfm?GeneralID=688\"> Denver bar advises <\/a>clients who do turn to the formal complaint process that &#8220;If you file a request for investigation, <span style=\"text-decoration: underline\">this would put you in an adversary position with your attorney and you would want to hire another attorney<\/span>.&#8221;<\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<div><span style=\"font-family: Arial;font-size: x-small\">Given the <a href=\"http:\/\/www.halt.org\/reform_projects\/lawyer_accountability\/report_card\/\">well-documented failure<\/a> of the lawyer discipline systems nationwide to provide adequate relief to unsatisfied clients, local bar groups <em>should<\/em> be doing all they can to\u00a0establish or cooperate with\u00a0less formal methods, such as those provided by the BBB. <\/span><\/div>\n<ul>\n<li><span style=\"font-family: Arial;font-size: x-small\">To oppose such processes &#8212; and especially to fear the use of data banks that help consumers make better-informed choices among lawyers &#8212; makes it clear that lawyers put their own interests above those of their clients.\u00a0 That is <em>not funny<\/em> at all.<\/span><\/li>\n<li><span style=\"font-family: Arial;font-size: x-small\">In case your are wondering, the Colorado BBB does have quite a few <a href=\"http:\/\/65.88.28.17\/scripts\/cgiip.exe\/WService=wsbroker1\/relmall\/resultsden.html?search_company_records=640&amp;s1=tob2_yes&amp;xbureau=denver\">lawyer members<\/a>, who willingly subscribe to its code (often as a useful marketing tool).\u00a0 For example, the 15-lawyer business firm, <a href=\"http:\/\/www.minorbrown.com\/\">Minor and Brown, PC.<\/a><\/span><\/li>\n<\/ul>\n<p><span style=\"font-family: Arial;font-size: x-small\"><em><span style=\"color: red\"><strong>Update<\/strong> (03-17-04)<\/span>:<\/em> In a well-crafted post on this topic,<em> <\/em><a href=\"http:\/\/www.overlawyered.com\/archives\/000922.html\">Overlawyered.com<\/a> notes, &#8220;Now suppose that some other profession or industry &#8212; medicine, say &#8212; were to assert that its mysteries are so esoteric, and its success in self-regulation so complete, that lay observers should not presume even to compare notes with each other on their bad experiences with it.
