{"id":4675,"date":"2004-01-25T21:07:33","date_gmt":"2004-01-26T01:07:33","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/01\/25\/nevada-high-court-upholds-jur"},"modified":"2011-08-05T15:00:29","modified_gmt":"2011-08-05T19:00:29","slug":"nevada-high-court-upholds-jury-trial-right-in-cases-under-5000","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/01\/25\/nevada-high-court-upholds-jury-trial-right-in-cases-under-5000\/","title":{"rendered":"Nevada high court upholds jury trial right in cases under $5000"},"content":{"rendered":"<p><a name='a603'><\/a><\/p>\n<p><P dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\" size=\"2\">According to an <A href=\"http:\/\/www.lasvegassun.com\/sunbin\/stories\/nevada\/2004\/jan\/23\/012310374.html\">article<\/A> in the <EM>Las Vegas Sun<\/EM>, <\/FONT><FONT face=\"Arial\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">(AP, Nevada high court upholds jury trial right in small cases, b<\/FONT><\/FONT><FONT face=\"Arial\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">y Brendan Riley, 01-23-04):<\/FONT><\/FONT><\/FONT><\/P><br \/>\n<BLOCKQUOTE><br \/>\n<P dir=\"ltr\" style=\"MARGIN-RIGHT: 0px\"><FONT face=\"Arial\"><FONT size=\"2\">&#8220;[T]he Nevada Supreme Court held Friday it&#8217;s unconstitutional for the Las Vegas Township Justice Court to deny jury trials in civil cases involving $5,000 or less. <\/FONT><\/P><\/BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<P><FONT size=\"2\">&#8220;The [5-1] split decision overturned lower court rulings in two cases that upheld the Justice Court policy adopted in 1999 as a way to &#8220;&#8216;preserve judicial resources.'&#8221; <\/FONT><\/P><\/BLOCKQUOTE><br \/>\n<P dir=\"ltr\"><FONT size=\"2\">The decision did not address, but would appear to draw into question, the ability to preclude juries in &#8220;small claims&#8221; matters, which are also filed in Justice Court (using secial procedures), and may include claims up to $5000.&nbsp;
