{"id":4672,"date":"2004-01-23T11:53:53","date_gmt":"2004-01-23T15:53:53","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/01\/23\/do-law-clients-want-enthusias"},"modified":"2011-08-05T15:00:30","modified_gmt":"2011-08-05T19:00:30","slug":"do-law-clients-want-enthusiasm-or-machismo","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/01\/23\/do-law-clients-want-enthusiasm-or-machismo\/","title":{"rendered":"Do Law Clients Want Enthusiasm or Machismo?"},"content":{"rendered":"<p><a name='a579'><\/a><\/p>\n<p><P dir=\"ltr\" align=\"right\"><FONT face=\"Arial\"><FONT size=\"2\"><STRONG><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pirate.jpg\" alt=\"pirate\" \/>&nbsp; <\/STRONG><\/FONT><\/FONT><FONT face=\"Times New Roman,Times,Serif\" size=\"2\"><STRONG><EM>your kind of lawyer?<\/EM><\/STRONG><\/FONT><\/P><br \/>\n<P dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\"><STRONG>Evan Schaeffer<\/STRONG> at <STRONG><A href=\"http:\/\/riverbendlaw.typepad.com\/notes_from_the_legal_unde\/2004\/01\/law_firm_metaph.html\">Notes from the (Legal) Underground<\/A><\/STRONG>&nbsp;shoots&nbsp;our Southwest-Airlines-as-law-firm&nbsp;metaphor out of the skies this morning (see yesterday&#8217;s <\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/01\/22#a577\"><FONT face=\"Arial\" size=\"2\">post<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">).&nbsp; He doesn&#8217;t think&nbsp;law firm clients&nbsp;would be &#8220;accepting of the warm-and-fuzzy-advocate&#8221; suggested by the successful airline&#8217;s approach to doing business.&nbsp; They would instead choose&nbsp;the <\/FONT><A href=\"http:\/\/www.airforce.com\/index_fr.htm?section=missions&amp;page=space\/index.htm&amp;loc=3\"><FONT face=\"Arial\" size=\"2\">air force<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;image.&nbsp;&nbsp; I&#8217;m not at all sure that clients would prefer military-style discipline, cost-overruns, and collateral damage over a firm&nbsp;that gets the job done&nbsp;economically but enthusiastically, with morale high and customer satisfaction&nbsp;the first priority.&nbsp; <\/FONT><\/P><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Of course, a lot depends on just what&nbsp;service the clients needs, and Evan might be right about many personal injury clients, who are his specialty.&nbsp; I went to his law firm site to see what image <\/FONT><A href=\"http:\/\/www.riverbendlaw.com\/\"><FONT face=\"Arial\" size=\"2\">Schaeffer &amp; Lamere<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> was projecting.&nbsp;&nbsp;Instead of warrior soldier graphics, I found dignified sepia-tones and genteel images.&nbsp; I guess Evan lets his Mars side show while weblogging and litigating.&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><FONT face=\"Arial\" size=\"2\">On a more serious note, I checked out Evan&#8217;s <A href=\"http:\/\/www.riverbendlaw.com\/pi FAQ page 1.htm\">Personal Injury FAQ<\/A> page and made a discovery that clients should not be at all happy about &#8212; although S&amp;L &#8220;<SPAN style=\"mso-fareast-font-family: 'MS Mincho'\"><FONT face=\"Arial\"><FONT size=\"2\">will not take your case unless we think it has a good chance of success,<\/FONT><\/FONT><\/SPAN>&#8221; it &#8220;typically&#8221; charges a&nbsp;33.3% fee,&nbsp;with 40% taken for &#8220;more complex kinds of cases.&#8221;&nbsp; The spoils of victory are indeed&nbsp;great for the swashbuckling esquire &#8212; and, when a standard contingency fee is used, <EM>not<\/EM> related to the <EM>risk<\/EM> incurred by the lawyers.&nbsp; I wish all personal injury clients got to read <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2003\/06\/03#a21\">this<\/A> or <A href=\"http:\/\/www.prairielaw.com\/articles\/article.asp?channelId=29&amp;subId=124&amp;articleId=1336\">this<\/A> before signing&nbsp;their contingency fee agreements.&nbsp; It may not be entertaining reading, but it is educational.&nbsp;<\/FONT><\/LI><\/UL><\/p>\n","protected":false},"excerpt":{"rendered":"<p>&nbsp; your kind of lawyer?
