{"id":4632,"date":"2003-12-19T12:59:39","date_gmt":"2003-12-19T16:59:39","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2003\/12\/19\/a-few-stocking-stuffers-for-l"},"modified":"2011-08-05T15:00:35","modified_gmt":"2011-08-05T19:00:35","slug":"a-few-stocking-stuffers-for-legal-consumers","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2003\/12\/19\/a-few-stocking-stuffers-for-legal-consumers\/","title":{"rendered":"A Few Stocking-Stuffers for Legal Consumers"},"content":{"rendered":"<p><a name=\"a394\"><\/a><\/p>\n<div><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/RedLightBulb.gif\" alt=\"Light Bulb\" \/> <strong><em><span style=\"font-family: Times New Roman,Times,Serif\">good ideas<\/span><\/em><\/strong> <\/span><\/div>\n<blockquote>\n<div style=\"text-align: left\"><span style=\"font-family: Arial;font-size: x-small\">A number of recent developments should bring joy to consumers of legal services &#8212; especially, if they are copied throughout the nation.\u00a0 Let&#8217;s hope that these efforts to increase consumer options (and maybe save them a few dollars) are infectious<\/span><\/div>\n<\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;color: red;font-size: x-small\"><strong>California Court of Appeal Creates <em>Step by Step <\/em>Guide for the Self-Represented in Civil Appeals<\/strong><\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">As reported at the <a href=\"http:\/\/www.selfhelpsupport.org\/index.cfm\">Self Help Support<\/a> website, The California Court of Appeal in San Diego has recently released an online\u00a0manual for <em>pro se<\/em> litigants (and &#8220;attorneys with little or no appellate experience&#8221;) who are bringing civil appeals &#8212; <a href=\"http:\/\/www.courtinfo.ca.gov\/courts\/courtsofappeal\/4thDistrictDiv1\/4dca_proper.htm\"><strong><span style=\"font-family: Arial;font-size: x-small\">The California Court of Appeal Step-by-Step<\/span><\/strong><\/a>. <\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">The manual described the civil appellate process and the related Rules of Court in simple terms.\u00a0\u00a0 The Introduction states:<\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial;font-size: x-small\"><\/span><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">The process of appealing a civil case is presented as a series of steps. Many of the steps <\/span><span style=\"font-family: Arial;font-size: x-small\">are in the form of questions that you need to answer in the order shown. This manual <\/span><span style=\"font-family: Arial;font-size: x-small\">answers some questions and guides you in answering others. <\/span><span style=\"font-family: Arial;font-size: x-small\">At the end of each chapter are the forms for the Fourth Appellate District, Division One, <\/span><span style=\"font-family: Arial;font-size: x-small\">that are most often used in appeals and are referred to in the chapter. Each form has <\/span><span style=\"font-family: Arial;font-size: x-small\">instructions and a blank for you to use in your appeal if you wish to do so and are filing <\/span><span style=\"font-size: x-small\"><span style=\"font-family: Arial\">in Division One of the Fourth Appellate District. <\/span><\/span><\/span><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<p align=\"left\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">For filing, briefing, and\/or arguing your appeal, think about hiring an attorney if you are <\/span><span style=\"font-family: Arial;font-size: x-small\">able to do so. Bringing a case to the Court of Appeal without an attorney is hard work <\/span><span style=\"font-family: Arial;font-size: x-small\">and takes a good deal of time. If you are self-represented, you are held to the same level <\/span><span style=\"font-family: Arial;font-size: x-small\">of work as if you were an attorney. In most cases, you have only one chance to have the <\/span><span style=\"font-family: Arial;font-size: x-small\">court hear your case. In addition, you must follow all of the court\u2019s rules and <\/span><span style=\"font-size: x-small\"><span style=\"font-family: Arial\">procedures. <\/span><span style=\"font-family: Arial\"> If you do not, your case may be <\/span><\/span><span style=\"font-size: x-small\"><span style=\"font-family: Arial\">dismissed.<\/span><\/span><\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<div><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;color: red;font-size: x-small\"><strong>Va. County Requires Mediation Orientation for All Cases<\/strong><\/span><\/span><\/div>\n<p><span style=\"font-family: Arial;font-size: x-small\"><\/span><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">Effective Dec. 1, 2003, in order to encourage the consideration of mediation as a dispute resolution option in every case, all civil litigants in Chesterfield County (Virginia) Circuit Court are required to complete\u00a0a <em>Mediation Orientation Certification Form <\/em>and indicate their interest in participating in a mediation orientation session.\u00a0 According to a\u00a0<a href=\"http:\/\/www.courts.state.va.us\/drs\/resolutions\/december2003.pdf\">court newsletter<\/a> announcing and describing the program <\/span><\/span><\/p>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<blockquote><p><span style=\"font-family: Arial;font-size: x-small\"><\/span><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\"> The M<em>ediation Orientation Certification Form <\/em>requires that Counsel certify to the court that they have discussed with their client the availability of mediation and also indicate the client\u2019s willingness to participate in or opt out of an orientation session. A copy of the <em>Mediation Orientation Certification Form <\/em>will be provided to counsel by the Court.\u00a0 . . . Pro se parties will also be required to complete and return the form to the court. If at least one party indicates a willingness to mediate, the court will refer the case to a mediation orientation session. The Court may also on its own motion enter an Order of Referral.<\/span><\/span><\/p><\/blockquote>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">A procedure is included that would allow a litigant to opt out of the mediation orientation.\u00a0\u00a0 This is meant to be model program that could, if successful, be\u00a0spread statewide.\u00a0\u00a0(Thanks to <span style=\"font-family: Arial;font-size: x-small\"><a href=\"http:\/\/swvalaw.blogspot.com\/2003_12_14_swvalaw_archive.html#107179724067892655\">Steve Minor<\/a> for the pointer. 12-18-03)<\/span><\/span><\/span><\/div>\n<p><span style=\"font-family: Arial;font-size: x-small\"><\/span><\/p>\n<ul><span style=\"font-family: Arial;font-size: x-small\"><\/p>\n<li><span style=\"font-family: Arial;font-size: x-small\">Besides needing well-trained and motivated &#8220;neutrals&#8221; to conduct the orientation\u00a0and mediation sessions, the program will need the good faith participation of all lawyers involved &#8212; including a fair, objective description of the mediation process and its potential benefits and disadvantages for the client.\u00a0 If one does not already exist, I<\/span> <span style=\"font-family: Arial;font-size: x-small\">hope a well-written brochure describing mediation will be made available to attorneys to help inform their clients.<\/span><\/li>\n<p><\/span><\/ul>\n<p><span style=\"font-family: Arial;font-size: x-small\"><br \/>\n<\/span><\/p>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;color: red;font-size: x-small\"><strong>Florida Bar Committee Rejects ABA Changes to Model Rule on Fees<\/strong><\/span><\/span><\/div>\n<div dir=\"ltr\">\n<\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">Stating that Florida Bar &#8220;contingent fee requirements are much more extensive than the ABA model rule,&#8221;\u00a0the Bar&#8217;s Special Committee on Revision of Rules rejected the ABA&#8217;s new Model Rule 1.5 (<strong><a href=\"http:\/\/www.flabar.org\/tfb\/TFBComm.nsf\/840090c16eedaf0085256b61000928dc\/b08fd9c0754b9f6c85256cf700577362?OpenDocument\">Final Report<\/a><\/strong>, at 40) (thanks to <\/span><span style=\"font-family: Arial;font-size: x-small\"><a href=\"http:\/\/www.sunethics.com\/news_item_2.htm\">sunEthics.com<\/a><\/span><span style=\"font-family: Arial;font-size: x-small\"> for the pointer).\u00a0\u00a0\u00a0The Bar&#8217;s Board of Governors will take final action on the Report at the end of January, 2004, before forwarding any recommended rule changes to the state Supreme Court. \u00a0As we <\/span><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2003\/06\/30\"><span style=\"font-family: Arial;font-size: x-small\">reported<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\"> on June 30, 2003, Arizona also rejected the ABA&#8217;s weakening of protection for clients in contingency fee arrangement.<\/span><\/span><\/div>\n<p><span style=\"font-family: Arial;font-size: x-small\"><\/span><\/p>\n<div dir=\"ltr\">\n<ul><span style=\"font-family: Arial;font-size: x-small\"><\/p>\n<li><span style=\"font-size: x-small\"><span style=\"font-family: Arial\"><span style=\"color: black\">Through <\/span><span style=\"color: blue\"><strong><a href=\"http:\/\/www.flabar.org\/divexe\/rrtfb.nsf\/8bf68c7a6fda323085256bc800648cce\/d879f37d40cdf92485256bbc004b2fc3?OpenDocument\">Rule 4-1.5(f)<\/a><\/strong><\/span><\/span><span style=\"color: #00008b\"><span style=\"font-family: Arial;color: black\"> of the Rules Regulating the Florida Bar,\u00a0clients entering into contingency fee arrangements have greater protection\u00a0than in any other state, including\u00a0a Statement of Client&#8217;s Rights for Contingency Fees (stating, among other things, that there is no set percentage fee and that the client has the right to negotiate the fee level), a 3-day &#8220;cooling off&#8221;
