That&#8217;s based on a statement from <\/font><font face=\"Arial\" size=\"2\">Scalia&#8217;s spokeswoman, who said Nino used a &#8220;hand off the chin gesture,&#8221; <\/font><font face=\"Arial\" size=\"2\">which Italians commonly use to show displeasure.  <\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/ScaliaDissents.gif\" alt=\"ScaliaDissent\">  Hmmm. She&#8217;s got a point: No one<i> ever<\/i> uses the middle finger to show displeasure.<\/font><\/p>\n<\/blockquote>\n<p dir=\"ltr\"><font size=\"-0\"><font size=\"-0\"><font face=\"Arial\" size=\"2\">Scalia might want you to believe that his little Sicilian chin action was harm<\/font><\/font><\/font><font face=\"Arial\" size=\"2\">less, <\/font><font face=\"Arial\" size=\"2\">but <i>a lot<\/i> depends on the atti<\/font><font size=\"2\">tude displayed along with the gesture.<font face=\"Arial\"> [Both of my sainted Southern Italian-born grandmothers could definitely make it look obscene.] <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Arial\">It&#8217;s too bad the Justice apparently bullied the <\/font><font face=\"Arial\">photographer who captured the moment into keeping it unpublished.  No, it wasn&#8217;t someone from the<i> Herald<\/i> &#8212; it was a photographer for the Archdiocese of Boston newspaper,<i> The Pilot<\/i>.<\/font><\/font><font face=\"Arial\" size=\"2\">   <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">[<i><b><font color=\"#ff0000\">update<\/font><\/b><\/i>: March 28, 2006): As expected the Boston Archdiocese Newspaper, <i><a href=\"http:\/\/www.rcab.org\/Pilot\/HomePage.html\">The Pilot<\/a><\/i>, won&#8217;t print the Scalia &#8220;gesture-message&#8221; photo. The <i>American Heritage Dictionary<\/i> says that<a href=\"http:\/\/www.bartleby.com\/61\/64\/G0196400.html\" rel=\"nofollow\"><font color=\"#000000\"><i> goombah<\/i><\/font><\/a> is slang for &#8220;A companion or associate, especially an older friend who acts as a patron, protector, or adviser.&#8221;  The term is usually applied by Italian-Americans to other Italian-Americans. Although Scalia disdains to cite to foreign legal sources, he quotes from Luigi Barzini&#8217;s <i><a href=\"http:\/\/www.amazon.com\/gp\/product\/0684825007\/qid=1143665876\/sr=1-1\/ref=sr_1_1\/102-9892500-1392132?s=books&amp;v=glance&amp;n=283155\"><font color=\"#000000\">The Italians<\/font><\/a><\/i> (at 63), in his own defense.  Barzini says:   <\/font><\/font><\/font><\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><font size=\"-0\"><font size=\"-0\"><font size=\"-0\"><font face=\"Arial\" size=\"2\"> &#8220;The extended fingers of one hand moving slowly back and forth under the raised chin means: &#8216;I couldn&#8217;t care less. It&#8217;s no business of mine. To be honest, that does not offend me half as much as his half-assed, dishonest defense of himself.
