Florida Bar<\/FONT><\/EM>, (#05-1046, 547 U.S. ___, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">March 27, 2006), ending the fight of the St. Lauderdale law firm <A href=\"http:\/\/www.papeandchandler.com\/\"><FONT color=\"black\">Pape &amp; Chandler<\/FONT><\/A> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">to use the head of a Pit-Bull in its logo, along with the&nbsp;phone number 1-800-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><FONT face=\"Arial\">PIT-BULL, in its marketing.&nbsp; The firm specializes <\/FONT><FONT face=\"Arial\">in motorcycle accident cases.&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\">(see&nbsp;<\/FONT><A href=\"http:\/\/today.reuters.com\/news\/newsArticle.aspx?type=domesticNews&amp;storyID=2006-03-27T154047Z_01_N10293793_RTRUKOC_0_US-COURT-LAWYERS-PITBULL.xml&amp;archived=False\"><FONT size=\"2\">Reuters<\/FONT><\/A><FONT size=\"2\">,&nbsp;&#8220;Court rejects lawyers&#8217; appeal over pit bull ads,&#8221; <FONT face=\"Arial\">Mar 27, 2006)<\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pitBullLogo.gif\" alt=\"pitBullLogo\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">We<FONT face=\"Arial\" size=\"2\">&#8216;ve been covering this case <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/05\/10#a1468\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">since<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> May 2004. You can find our discussion <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/11\/17#a5315\"><FONT face=\"Arial\" size=\"2\">here<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> <\/FONT><FONT face=\"Arial\" size=\"2\">of the <A href=\"http:\/\/www.floridasupremecourt.org\/decisions\/2005\/sc04-40.pdf\">opinion<\/A> of the Florida Supreme Court.&nbsp; The Court held:<\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/DIV><br \/>\n<DIV dir=\"ltr\"><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;These devices, which invoke the breed of dog known as the pit bull, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">demean all lawyers and thereby <\/FONT><FONT face=\"Arial\" size=\"2\">harm both the legal profession and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">the public&#8217;s trust and confidence <\/FONT><FONT face=\"Arial\" size=\"2\">in our system of justice.&#8221;<\/FONT><\/FONT><\/FONT><\/DIV><\/DIV><\/BLOCKQUOTE><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">On March 19, we <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/03\/19#a6250\">posted<\/A> the new <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\">pit-bull-less masthead of Pape &amp; Chandler &#8212; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the drawing had served as P&amp;C&#8217;s&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">ampersand.&nbsp; We asked whether lawyers now&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">feel <\/FONT><FONT face=\"Arial\" size=\"2\">more dignified and the public has&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">more respect for the profession and the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">justice <\/FONT><FONT face=\"Arial\" size=\"2\">system.&nbsp;&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">The highly persuasive legal, practical and policy argu<FONT face=\"Arial\" size=\"2\">ments <\/FONT><FONT face=\"Arial\" size=\"2\">of John Pape and Marc <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">Chandler, which had been<FONT color=\"black\"> <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/10\/07#a2450\"><FONT color=\"black\">accepted<\/FONT><\/A> by the Bar referee <\/FONT><FONT face=\"Arial\" size=\"2\">and presented to the High <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">Court by <\/FONT><A href=\"openDetails('smolla_sketch.htm')\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Rodney A. Smolla<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> (Univ. Richmond Law Dean),&nbsp;will <\/FONT><FONT face=\"Arial\" size=\"2\">not be heard. plus <FONT face=\"Arial\">the recent <\/FONT><FONT face=\"Arial\">advocacy of James J. <\/FONT><\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT size=\"+0\"><FONT face=\"Arial\"><A href=\"http:\/\/www.theconservativevoice.com\/article\/13254.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Kilpatrick<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">,&nbsp;and numerous editorials (<\/FONT><A href=\"http:\/\/www.sptimes.com\/2005\/11\/20\/Opinion\/Snarf_Growl_Meow.shtml\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">including<\/FONT><\/A><FONT size=\"2\"><FONT face=\"Arial\"> the <EM>St. Peters<\/EM><\/FONT><FONT face=\"Arial\"><EM>burg <\/EM><\/FONT><FONT face=\"Arial\"><EM>Times<\/EM>).<\/FONT>&nbsp;<\/FONT><\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT size=\"1\"><EM><\/EM><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;P&amp;C&#8221;&nbsp; Click&nbsp;<A href=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/gems\/ethicalesq\/PapeChandlerPitBull.gif\"><FONT face=\"Arial\">here<\/FONT><\/A><FONT face=\"Arial\"> to see one of P&amp;C&#8217;s offending&nbsp;pit bull ads.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">The question we asked when we <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/12\/17#a5551\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">reported<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> <\/FONT><FONT face=\"Arial\" size=\"2\">that Dean Smolla would be seeking <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">certiorari will not be answered for the time being:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Would the Court conclude that&nbsp;pious notions of <\/FONT><FONT face=\"Arial\" size=\"2\">&#8220;dignity&#8221; only make <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the legal profession look silly and are inadequate <\/FONT><FONT face=\"Arial\" size=\"2\">reasons for limiting <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">commercial speech and First Amendment rights <\/FONT><FONT face=\"Arial\" size=\"2\">of lawyers and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">consumers?<\/FONT><\/DIV><\/DIV><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">I&#8217;m afraid the professional Dignity Police have too many allies on the Supreme <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Court bench &#8212; or maybe, consumers and the First Amendment have too few.&nbsp;&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Treating the public like fools and acting pompously self-important&nbsp;<\/FONT><FONT face=\"Arial\" size=\"2\">(and above <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">mere commerce) is <EM>not<\/EM> the <\/FONT><FONT face=\"Arial\" size=\"2\">way to win respect for the legal profession.<\/FONT><\/FONT><FONT size=\"2\"><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">&#8220;tinyredcheck&#8221; As we have been reporting the past two years (see <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/03\/03#a6149\"><FONT face=\"Arial\">here<\/FONT><\/A><FONT face=\"Arial\"> and <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/09\/26#a4909\"><FONT face=\"Arial\">here<\/FONT><\/A><FONT face=\"Arial\">, for example), in the name of dignity and<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">consumer protection, the organized bar is trying to make <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">it harder and harder to advertise legal services.&nbsp; Letting the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><EM>Pape &amp; Chandler<\/EM> decision stand will surely encourage more <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">of this shameful activity.&nbsp; Those of us who care about the 1st <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">Amendment and consumer choice need to speak up and act, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\">before it is too late.&nbsp;
