Wallace<\/span><\/a> gave <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">his own <\/span><span style=\"font-family: Arial;font-size: x-small\">definition of &#8220;podcast.&#8221;<\/span><\/div>\n<\/blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"> <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Carolyn Elefant broached some important issues in a <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">the post <a href=\"http:\/\/legalblogwatch.typepad.com\/legal_blog_watch\/2006\/03\/reporting_ethic.html\"><span style=\"font-family: Arial;color: #3f3f37;font-size: x-small\">Reporting Ethics Violations May Cost You Your Job<\/span><\/a> <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">this week (commenting on &#8220;<a href=\"http:\/\/www.abanet.org\/journal\/redesign\/03ethics.html\">Ethical but Unemployed<\/a>&#8221;\u00a0in the <em>ABA <\/em><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><em>Journal<\/em>). <\/span><\/div>\n<blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">&#8220;So long as lawyers must risk their jobs to report ethics <\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">violations, they won&#8217;t.\u00a0 It&#8217;s unclear why\u00a0 courts would rather <\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">have lawyers make a choice between financial well being <\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">and compliance with the Model Code (which requires lawyers <\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">to report ethics violations) than to afford protection to lawyers <\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">who do the right thing.\u00a0 \u00a0There&#8217;s something not entirely ethical <\/span><\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"><span style=\"font-family: Arial;font-size: x-small\">about that.&#8221;<\/span><\/span><\/div>\n<\/blockquote>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">I agree with her sentiment that the courts should be more open to <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">retaliatory firing cases based on ethical whistleblowing.\u00a0 However, <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">similar to our thoughts in <\/span><a rel=\"nofollow\" href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/22#a1333\"><span style=\"font-family: Arial;color: #000000;font-size: x-small\">More on the Silent Associate<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\">, last April,<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">we can&#8217;t condone silence based on the fear of losing a job.\u00a0 (and,<\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">see, <\/span><a rel=\"nofollow\" href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/30#a1405\"><span style=\"font-family: Arial;color: #000000;font-size: x-small\">the ethics of the Whatever Generations<\/span><\/a><span style=\"font-family: Arial;font-size: x-small\">)\u00a0 Also, it&#8217;s hard to <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">imagine wanting to stay at a firm where you believe that raising <\/span><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\">ethical issues might get you fired. <\/span><\/div>\n<div dir=\"ltr\"><\/div>\n<div dir=\"ltr\"><span style=\"font-family: Arial;font-size: x-small\"> &#8220;soapboxDudeF&#8221;<\/span><\/div>\n<div dir=\"ltr\"><\/div>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>When she says &#8220;we have to talk&#8220;, most guys get worried.
