Reese <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">is mature for her age and smart, and gets along well with all the Cliente <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">kids (with the exception of the eldest, Sadie, who has just discovered <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">boys and is often sulking).  Reese has two younger siblings, who <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">occasionally assist Reese or perform babysitting chores that are less<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">taxing.   <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The Clientes pay Reese $6\/hr., which is as much as any babysitter gets <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in their community.  The younger Morrispoons get $3 and $4 an hour, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">because they have less experience and are given less reponsibility.<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/witherspoonAsWoods.gif\" alt=\"WitherspoonAsWoods\" \/>  <\/font><font size=\"1\">r<em>eese<\/em><\/font><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Jackie Cliente faxed me over the following letter that she received today <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">from Reese, asking how she should respond:<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<\/blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">                                                                    March 20, 2006<\/font><\/p>\n<blockquote>\n<p dir=\"ltr\">&nbsp;<\/p>\n<blockquote><\/blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><strong>Mr. and Mrs. Cliente<\/strong>,<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">I&#8217;ve been very happy being your babysitter, but hope we could talk <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">about my fees. I really think you will love my ideas.   A few days<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">ago, my parents came back from a conference they attended <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">called <em><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/06#a3622\">LaxThink<\/a><\/em>.  They got lots of ideas about how dad could charge <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">for his lawyer services and mom for her accounting services, to get <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">out of the &#8220;nasty rut of hourly billing&#8221; (because clients really hate <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">paying by the hour, they told me).<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"> <font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">They learned that many clients feel a <em>lot<\/em> better when they <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/17#a821\"><font color=\"black\">pay <em>more<\/em><\/font><\/a> <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">money for services, because they feel they are getting more value. <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Dad is a really sensitive guy (for a lawyer), and he explained to me <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">how important <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3700\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">price sensitivity<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> is when setting your fees. (Some guy <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">named <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/21#a3701\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Ron<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> is the expert, he must be a baker or chef, because he <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">talks about prices for sweets, and ice cream and pop corn.)  <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/elefantC.gif\" alt=\"ElefantC\" \/>  <a href=\"http:\/\/www.myshingle.com\"><font color=\"black\" size=\"1\"><em>carolyn<\/em><\/font><\/a> <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Mom told me that they were really excited about the idea of <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;differential billing&#8221;&#8211; charging more for doing some things things that <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">are harder or more valuable and useful to the client (like stuff my little <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">sibs probably couldn&#8217;t do, but I can).  I went online to do some research <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and a very nice attorney named <\/font><a href=\"http:\/\/www.myshingle.com\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Carolyn<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, who is a mother, and writes <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">kind of a <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">gossip column about lawyers, says differential billing is &#8220;<\/font><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">a <\/font><\/p>\n<p dir=\"ltr\"><font size=\"2\"><font face=\"Arial\"><u>great suggestion<\/u>.&#8221;<\/font><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"> <font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">She gives credit to a man with a great name &#8212; <a href=\"http:\/\/lawdepartmentmanagement.typepad.com\/law_department_management\/\">Rees<\/a>! &#8212; who talls about <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">it in a post at <\/font><a href=\"http:\/\/lawdepartmentmanagement.typepad.com\/law_department_management\/2006\/03\/different_billi.html\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">his website<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">.  Rees describes the concept as &#8220;Different <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">billing rates for the same lawyer, according to the task\u2019s usefulness to <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the client.&#8221;<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">                                                                                            <em><font color=\"black\" size=\"1\"> <\/font><\/em><a href=\"http:\/\/lawdepartmentmanagement.typepad.com\/law_department_management\/\"><em><font color=\"black\" size=\"1\">rees<\/font><\/em><\/a>  <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/reesM.gif\" alt=\"reesM\" \/><\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> To be honest, Rees might be a worrywort.  He says his idea  <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">is &#8220;<em>Logistically a nightmare and beset with subjectivity<\/em>.&#8221;  But, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">you know and trust me, and you love your children <em>so<\/em> much, that <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">I&#8217;m certain we can agree on &#8220;a billing system that matches fees <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">charged to worth delivered.&#8221; <\/font><\/p>\n<\/blockquote>\n<blockquote>\n<blockquote><\/blockquote>\n<\/blockquote>\n<\/blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Here are some of the things that I do or might do while babysitting that <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">I believe are especially valuable and useful for you as parents and for <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">your children.  Next to each is my proposed &#8220;value-added fee.&#8221;<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Get Chubby Cathy to bed with only 1 snack [$5]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Show 4th-grader Mikey a Memory Trickfor vocabulary and multiplication tables (invaluable for standardized tests)       [$20]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Keep Mikey from staring at my chest  [$12]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Secretly decode IM messages between<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> Sadie and her girlfriends [$10]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Stop Sadie from sneaking out her window to<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> meet boyfried Butch   [$50]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Stop Butch from climbing into Sadie&#8217;s<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> bedroom window [$70]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Mediate X-box sharing schedule  [$10]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Keep my younger brother from eating all<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> your cookies and ice cream  [$6]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Stop Jack Jr. from beating Mikey to a pulp [$15]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\">&nbsp;<\/p>\n<ul>\n<li><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Rescue baby Anny from swimming pool [$500]<\/font><\/li>\n<\/ul>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">There are, of course, lots of other very useful things that I <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">do that are lots more valuable than just watching tv and <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">putting the kids to bed on time.   I think we could work <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">them out as they happen, comparing their value to <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">similar items in the list.  As you know, I really love <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">your children, but you have raised them to be very asser-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">tive and distrustful of authority figures.  That makes my <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">job especially hard.<\/font><\/p>\n<blockquote>\n<blockquote>\n<p dir=\"ltr\">&nbsp;<\/p>\n<\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Please let me know if this Differential Billing idea is accept-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">able to you, before our next babysitting night.  Of course, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">I would reduce my normal per-hour fee from $6 to $4 per hour, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">if we adopt the value-added schedule.<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Reese<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">XOX<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Jackie is pretty upset by this turn of events.  She thinks paying top-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">notch hourly fees already compensates Reese for her extra experi-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">ence and talents.  She also thinks Reese&#8217;s younger siblings could <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">easily perform some of the &#8220;value-added&#8221; services, at least with a <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">bit of good supervision.<\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Jack Cliente is intrigued.  He&#8217;s a master bricklayer, and is thinking <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">he might be able to charge a lot more money for some of the move-<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">ments that are needed in placing and setting a brick than for others &#8212; <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">with the total ending up a lot higher.  He also pointed out to Jackie <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that she might try this approach herself as a medical expert witness.  <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Right now, she gets paid by the hour for her time at court.  But Jack<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">thinks there are some crucial moments in her testimony that can <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">make or break a case and might be worth a share of the damages <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">won &#8212; or, at least an enormous bonus.    <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">                                                                                   <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/LegallyBlondeG.gif\" alt=\"LegallyBlondeG\" \/><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">                                                                                         <em><a href=\"http:\/\/www.amazon.com\/gp\/product\/B00005O5CM\/qid=1142972122\/sr=1-1\/ref=sr_1_1\/102-9892500-1392132?s=dvd&amp;v=glance&amp;n=130\"><font color=\"#000000\" size=\"1\">legally billed?<\/font><\/a><\/em><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">            &#8220;tinyredcheck&#8221; &#8220;<em>Make a Killing with Value Billing<\/em>&#8221; <\/font><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\">      <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\">                                                        <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Jack, of course, figures that neither general contractors nor trial <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">lawyers are likely to agree to this kind of value billing.  He wonders <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">if any legal clients would fall for it.  As parents hiring a babysitter, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the Clientes say they are not about to agree to value-added premium <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">fees. Since other parents in town are not likely to fall for this ploy <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">either, they&#8217;re not worried about losing her to the competition. That&#8217;s why many <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">informed consumers have rebelled against the customary <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">real estate agent percentage when selling a home.  It&#8217;s also <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">why a lot of probate courts have questioned or put a dollar <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">limit on probate fees based on the overall value of the estate.  <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Two final points: As discussed in this <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/01\/04#a453\"><strong><font color=\"#42aac8\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">post<\/font><\/strong><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, the <em>special <\/em><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><em>privileges<\/em> <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">come with our <em>professional license presume<\/em>: <\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">1) That since clients cannot adequately evaluate the <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">quality of the service, they must trust those they consult; <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and 2) That the client&#8217;s trust presupposes that the practitioner&#8217;s <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">self-interest is overbalanced by devotion to serving both the <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">client&#8217;s interest and the public good. <\/font><\/p>\n<\/blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/checkedBoxS.gif\" alt=\"checkedBoxS\" \/>  As agent of reality, and consumer advocate, I must often tell my <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">colleagues <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">two things they don&#8217;t want to hear: <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">First, in general,<em> attorney services are worth a whole lot less<\/em> (add a lot <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">less value) now that consumers can read and write and technology makes <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">it possible to provide legal services far more quickly and efficiently (or through <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">self-help); and <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Second, there are over <em>one million attorneys<\/em> in the USA and they are all looking <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to make a buck. <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">These factors can&#8217;t be avoided by coming up with new ways to &#8220;sell&#8221; and &#8220;price&#8221; <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the product or to push back market forces and the tide of history.<\/font><\/p>\n<\/blockquote>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">Put another way (in <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/01\/28#a623\"><font color=\"black\">Value Billing and Lawyer Ethics<\/font><\/a>): We&#8217;re getting a little annoyed by <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">the &#8220;<em>ethics aside<\/em>&#8221; approach of the gurus and evangelists <font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of law firm branding, marketing <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and alternative or value pricing.  They offer the easily-<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">tempted lawyer a paradise of premium <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">clients and fees, with increased profits, while <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">never probing the ethical and fiduciary duties <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of the lawyer to insure that the client is <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">fully informed, treated fairly (and without manipula-<\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">tion) and, in the end, charged a fee <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that is reasonable for competent and diligent services.<\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">. . .
