Kilpatrick<\/FONT>&nbsp;<FONT size=\"2\">describes the battle of the <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Ft. Lauderdale motorcycle injury lawyers with the Florida Bar, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">asking: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">First question: How do you feel about trial lawyers? <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">Second question: How do you feel about pit bull dogs? <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">May the one breed lawfully adopt an image of the other? <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/dogblack.gif\" alt=\"dog black\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">The Supreme Court will step into this touchy question if it <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">agrees to hear an appeal brought by two Fort Lauderdale <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">lawyers against the Florida Bar. <\/FONT><\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Kilpatrick rightly notes that &#8220;Some close questions of First Amendment <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">law make it a tough case to call.&#8221;&nbsp;&nbsp; However:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">&#8220;The Florida lawyers are eloquently represented in the U.S. Supreme <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">Court by professor Rodney A. Smolla of the University of Richmond <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">School of Law. In his petition for review he argues persuasively that <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">lawyers should not be punished for advertising &#8220;that is not false, <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">fraudulent, deceptive, or misleading in any sense.&#8221; Good point. Is <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">the amorphous &#8220;dignity of the profession&#8221; an interest so overriding <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">that it trumps a First Amendment right of commercial speech? Good <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">question.&#8221; <\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Although noting that &#8220;<FONT face=\"Arial\" size=\"2\">Lawyers have had a tough time of it at least since Luke <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">wrote his gospel 2,000 years ago,&#8221; Kilpatrick concludes:&nbsp;<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;<FONT size=\"1\"><EM>Hoya Jack<\/EM><\/FONT> <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/GUJackMugG.gif\" alt=\"GUJackMugG\" \/><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">&#8220;My own thought comes down to this: If I want to sue my doctor <\/FONT><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\"><FONT size=\"2\">for a botched operation, give me a pit bull lawyer every time.
