Yet, until revealed <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">this morning by Ben Cowgill, l<\/FONT><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">exBlog&#8217;s <\/FONT><A href=\"http:\/\/kansasfamilylawblog.lexblog.com\/\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\"><EM>Kansas Family Law Blog<\/EM><\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;included <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\">some very prominent lawyer weblogs in a blogroll labelled &#8220;<EM>LexBlog network,<\/EM>&#8221; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\">although they have no connection of any sort with lexBlog.&nbsp; See <\/FONT><\/FONT><FONT face=\"Arial\" size=\"2\"><EM>Ben Cowgill <\/EM><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>on Legal <\/EM><\/FONT><FONT face=\"Arial\" size=\"2\"><EM>Ethics<\/EM>,&nbsp;&#8220;<A href=\"http:\/\/cowgill.blogs.com\/legalethics\/2006\/03\/is_your_blog_pa.html#comment-15078944\">Is your blog part of the &#8216;LexBlog network&#8217;?<\/A> (you might <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">be sur<\/FONT><FONT face=\"Arial\" size=\"2\">prised by <\/FONT><FONT face=\"Arial\" size=\"2\">the answer),&#8221; March 16, 2006.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;questionDudeS&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">In a Comment in reply, Kevin seems to suggest that the situation caught him <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">by sur<\/FONT><FONT face=\"Arial\" size=\"2\">prise, <\/FONT><FONT face=\"Arial\" size=\"2\">and says:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;It was an oversight that a blogroll was labeled a network as <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">opposed to lawyer or other blogs.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Two years ago, Kevin&#8217;s &#8220;oversight&#8221; led him to leave out (see <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/12#a1200\">this<\/A> prior post)<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the core notion in <\/FONT><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.amazon.com\/exec\/obidos\/tg\/detail\/-\/073820756X\/qid=1081793936\/sr=1-1\/ref=pd_ka_1\/102-4810311-4254502?v=glance&amp;s=books\"><FONT color=\"black\">Rebecca Blood<\/FONT><\/A>&#8216;s conclusion that weblogs really <\/FONT><FONT face=\"Arial\" size=\"2\">do build <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">reputations quickly &#8212; the need for hands-on self-education:&nbsp;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;By maintaining a weblog that is tightly focused on a particular <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">subject, these weblog editors educate themselves by searching <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the Web daily for news and information pertinent to their area of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">expertise, exercising judgment in weighing the relevance or impor-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">tance of what they find, and articulating their thoughts on links that <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">they decide to include, either by summarizing the article or&nbsp;by analy-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">zing the material presented.&nbsp; &nbsp;It is what experts do, and this practice <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">will speed anyone&#8217;s progress&nbsp;to that end.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Similar &#8220;oversight&#8221; apparently caused Kevin to leave out of his lexBlog promos, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">back in 2004, the fact that all third-party materials on a lexBlog weblog would be <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\">marked as <\/FONT><FONT size=\"2\">being provided from a different source.&nbsp; (see <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/15#a1238\">our post<\/A> and the conces-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><FONT size=\"2\">sion <\/FONT><FONT size=\"2\">drawn out by Denise Howell&#8217;s probing questions at&nbsp;<\/FONT><\/FONT><A href=\"http:\/\/bgbg.blogspot.com\/2004_04_11_bgbg_archive.html#108206801770325407\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\"><EM>Bag &#8216;n&#8217; Baggage<\/EM><\/FONT><\/A><FONT face=\"Arial\" size=\"2\">)&nbsp; Of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">course, it is not the least bit clear to me that merely sticking a copyright symbol <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">with another entity&#8217;s name after such third-party content&nbsp;will, as Kevin asserted,<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&#8220;make clear that the [lexBlog] lawyer did not write it.&#8221;&nbsp; <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/honest.gif\" alt=\"honest\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">When it comes to marketing his products, then, it often appears that Kevin needs <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">far more &#8220;<\/FONT><A href=\"http:\/\/www.bartleby.com\/61\/29\/O0192900.html\"><FONT face=\"Arial\" size=\"2\">oversight<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&#8221; &#8212;&nbsp;&#8220;<EM>Watchful care or management; supervision<\/EM>,&#8221;&nbsp; in order <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">to&nbsp;avoid such embarassing oversights &#8212; &#8220;An unintentional omission or mistake.&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">(<EM>Amer<\/EM><\/FONT><FONT face=\"Arial\" size=\"2\"><EM>ican Heritage Dictionary<\/EM>, 4th ed., 2000)&nbsp; <\/FONT><FONT face=\"Arial\" size=\"2\">Perhaps&nbsp;hiring a&nbsp;marketing\/ethics <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">consiglieri might be a good idea &#8212; someone who can draw Kevin&#8217;s attention to <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">practices or claims that are likely to be seen as misleading or deceptive. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">One place for the new consiglieri to start might be the marketing of lexBlog&#8217;s <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/www.lexblog.com\/law-blog-packages-5-lexpremium.html\">lexPremium<\/A> <\/FONT><FONT face=\"Arial\" size=\"2\">service, which begins by asserting that providing third-party content <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">will: <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/lexPR.gif\" alt=\"lexPR\" \/><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM>Solidify reputation as trusted expert<\/EM>&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">This is the plan that will utterly solidify your reputation as a trusted <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">expert in your field and locale.
