A few days ago<\/A>, we told you the tale of our Schenectady Spider-man’s<\/FONT><\/DIV>

jail break.  Edwin Ortiz got out of a recreation yard fence and did some <\/FONT><\/DIV>
\n
fancy <\/FONT>rooftop jumping to make his escape.  Somehow, Ortiz’s escape <\/FONT><\/DIV>
\n
was not discovered for two hours — despite his having been marked <\/FONT><\/DIV>
\n
down as “counted” <\/FONT>six times on his tier, after he supposedly returned <\/FONT><\/DIV>
\n
from recreation.<\/FONT><\/DIV>
\n

\"tiny Ortiz was a known flight risk and had been on <\/FONT>“extraordin-<\/FONT><\/DIV>

ary <\/FONT>watch,” according to Sheriff Harry.Buffardi, who faces <\/FONT>re-<\/FONT><\/DIV>

The names of the responsible guards were finally released on Wednesday, <\/FONT><\/DIV>
\n

Sheriff Harry <\/FONT><\/A>Buffardi<\/FONT><\/A> announced that he had fired Deputies Gerald Treacy <\/FONT><\/DIV>

and <\/FONT>Jayme Paul, after they completed interviews with the State Depart-<\/FONT><\/DIV>
\n
ment of Corrections.  Non-criminal, disciplinary actions were also filed alleg-<\/FONT><\/DIV>
\n
ing <\/FONT>that they <\/FONT>failed to make proper counts and engaged in other actions that <\/FONT><\/DIV>
\n
wasted <\/FONT>time and energy in discovering the escape.   Paul failed to notice that <\/FONT><\/DIV>
\n
Ortiz escaped from the rec yard and was not among those returning <\/FONT>from the <\/FONT><\/DIV>
\n
yard.  Paul also went through the gate from which Ortiz made <\/FONT>his <\/FONT>escape, but <\/FONT><\/DIV>
\n
never noticed that Ortiz left it “grossly deformed.”  <\/FONT>Teacy <\/FONT>reported that he saw\/<\/FONT><\/DIV>
\n
counted Ortiz six times after <\/FONT>Ortiz had escaped, and <\/FONT>then delayed reporting <\/FONT><\/DIV>
\n
the disappearance once he re<\/FONT>alized Ortiz was not <\/FONT>present.<\/FONT><\/DIV>
\n
<\/FONT> <\/DIV>

When he was interviewed<\/A> after being re-captured, Ortiz said it wasn’t  <\/FONT><\/DIV>
\n
Deputy Paul’s fault for not noticing his absence or getaway.<\/FONT><\/DIV>

According to Gazette<\/EM> reporter Steven Cook:<\/FONT><\/DIV>

“There were supposed to be six inmates on Ortiz’s<\/FONT><\/DIV>

tier, Buffardi emphasized. <\/FONT><\/DIV>
\n
<\/FONT> <\/DIV>
\n
” ‘I don’t think it’s a difficult or tremendous burden <\/EM><\/FONT><\/DIV>
\n
for us to require a count to six people,<\/EM>‘ Buffardi said.”<\/FONT><\/DIV><\/BLOCKQUOTE>

The County Sheriff’s Benevolent Association said it wouldn’t have com-<\/FONT><\/DIV>
\n
ments on the firing until after the Department of Corrections issued its <\/FONT><\/DIV>
\n
report.  Paul and Treacy were not available for comments, but could grieve <\/FONT><\/DIV>
\n
the disciplinary charges and take them to an arbitrator.   Buffardi said he <\/FONT><\/DIV>
\n
did not want to make it sound like the deputies did not usually do their jobs, <\/FONT><\/DIV>
\n
but that there was enough “gross negligence” to warrant firing them.  Paul <\/FONT><\/DIV>
\n
was hired in April 2004; Treacy has been on the job for 5 years.<\/FONT><\/DIV>
\n

Joseph Suhrada, a Republican county legislator and frequent critic <\/FONT><\/DIV>

of the sheriff, said Treacy and Paul were being used as scapegoats <\/FONT><\/DIV>

to take heat for the sheriff. Suhrada also questioned why it wasn’t <\/FONT><\/DIV>
\n
until two hours after Ortiz was noticed missing that surrounding police <\/FONT><\/DIV>
\n
agencies were alerted to the escape.  “Whoever made that decision <\/FONT><\/DIV>
\n
