Smith<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">may find out in a few weeks (March 22), when his <em>Noisy Bather<\/em> <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">lawsuit comes before Denver District Court Judge <a href=\"http:\/\/www.courts.state.co.us\/district\/02nd\/judges\/2distmmullins.htm\"><font color=\"#000000\">Ronald Mullins<\/font><\/a>. <\/font>(<a href=\"http:\/\/www.denverpost.com\/search\/ci_3530220\"><em><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Denver Post<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, &#8220;Lawsuit: Baths swamp sleep&#8221;,\u00a0by Mike McPhee,\u00a0 <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Feb. 21, 2006; <\/font><a href=\"http:\/\/www.overlawyered.com\/2006\/02\/sued_for_taking_baths_too_earl.html#comments\"><em><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Overlawyered.com<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, &#8220;Early Bather Lawsuit,&#8221; Feb. 27, <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">2006)<\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\" \/><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/p>\n<p style=\"margin-right: 0px\">\u00a0<\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">As usual, <\/font><a href=\"http:\/\/www.overlawyered.com\/2006\/02\/sued_for_taking_baths_too_earl.html#comments\"><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Walter Olson<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> has summed up the case pithily:\u00a0 <img loading=\"lazy\" decoding=\"async\" height=\"60\" alt=\"WOlson\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2006\/11\/WOlson.gif\" width=\"55\" \/><\/font><\/div>\n<blockquote>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;Shannon Peterson, a special education teacher in the Arvada, <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Colo. public schools, &#8220;can&#8217;t believe she&#8217;s being sued for bathing <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">before leaving for work.&#8221; But the elderly couple who lives upstairs <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">from her Denver condo unit have been complaining about noisy <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">pipes, and unfortunately for Ms. Peterson they happen to have a <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">son, Sheldon Smith, who&#8217;s an attorney at the large law firm of <\/font><a href=\"http:\/\/www.hollandhart.com\/index.cfm\"><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Holland and Hart<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">. <\/font><\/div>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/p>\n<p style=\"margin-right: 0px\">\u00a0<\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">\u00a0\u00a0<font size=\"1\"> <img decoding=\"async\" alt=\"SheldonHSmith\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/SheldonHSmith.gif\" \/> <\/font><\/font><\/div>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"1\">\u00a0\u00a0\u00a0\u00a0<em><a href=\"http:\/\/www.hollandhart.com\/peopleprofile.cfm?IDName=PersonID&amp;ID=5093\"><font color=\"#000000\">Sheldon Smith<\/font><\/a>, Esq.\u00a0 <\/em><\/font><\/font><font size=\"1\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;Represented by their son, the Smiths &#8216;sued Peterson just before <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Christmas, citing the &#8216;reckless and negligent use of her bathtub.&#8221;&#8217;\u00a0 <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Before that, the younger Smith had fired off a letter to Peterson, <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">saying her &#8216;intransigence &#8230; and tortuous conduct have resulted <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in incredible sleep deprivation for Mr. and Mrs. Smith. Your obstin<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">acy has ruled the day. That will now cease.&#8217;\u00a0\u00a0\u00a0 <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"1\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">According to the <em>Denver Post<\/em>, his demand letter insisted that <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that Peterson not run water in her bathtub before 8 a.m.&#8221;\u00a0\u00a0<\/font><\/p>\n<p style=\"margin-right: 0px\" \/><\/font><\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\" \/><\/div>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" alt=\"showerTubF\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/showerTubF.gif\" \/>\u00a0 <\/font><font face=\"Arial\" size=\"2\"><\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Peterson told the<em> Denver<\/em>\u00a0<em>Post<\/em>:\u00a0\u00a0 <\/font><\/div>\n<blockquote>\n<p style=\"margin-right: 0px\">\u00a0<\/p>\n<div dir=\"ltr\" style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;I&#8217;ve done everything I can think of to work this out,&#8221; she said. <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;I&#8217;ve had maintenance men remove all my tile and insulate the <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">pipes. I&#8217;ve had sound engineers measure my unit and others in <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the building. Nothing&#8217;s abnormal. Even the homeowners&#8217; board <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">investigated and told the Smiths they should install sound barriers <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">in their unit.&#8221;<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">\u00a0<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">\u00a0<\/p>\n<p style=\"margin-right: 0px\">\u00a0<\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The <em>Post<\/em> reported that &#8220;the homeowners&#8217; association stepped into the fray <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and wrote Smith a letter that his request didn&#8217;t comply with the building&#8217;s rules.&#8221; <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Fortunately, Peterson is getting help from a friend, <a href=\"http:\/\/www.cobar.org\/directory\/displayind.cfm\"><font color=\"#000000\">lawyer<\/font><\/a> <a href=\"http:\/\/www.dowlinglegal.com\/\">J. Michael Dowling<\/a>,\u00a0 <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">From what I&#8217;ve read, I have to agree with Dowling&#8217;s assessment: <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;This is the most frivolous lawsuit I&#8217;ve seen in 30 years of <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">practicing law.&#8221;\u00a0<\/font>\u00a0<\/font><\/div>\n<blockquote>\n<blockquote><p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/p>\n<p dir=\"ltr\" style=\"margin-right: 0px\">\u00a0<\/p>\n<p dir=\"ltr\" style=\"margin-right: 0px\">\u00a0<\/p>\n<p><\/font><\/p><\/blockquote>\n<\/blockquote>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" alt=\"bathtubG\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/bathtubG.gif\" \/>\u00a0So far, coverage by <em>Overlawyered<\/em> has provoked a chorus of webloggers\u00a0<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">rightly decrying the lawsuit.\u00a0 It will be interesting to see if this negative publicity <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">gets all of the Smiths to back down.\u00a0 Of course, only Lawyer Smith has to worry <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">about violating professional ethics rules against bringing frivolous claims &#8212; claims <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that have no colorable basis in fact or law.\u00a0 <\/font><\/font><\/div>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img loading=\"lazy\" decoding=\"async\" height=\"42\" alt=\"showerHead\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2006\/11\/showHeadF.gif\" width=\"60\" \/>\u00a0At first, I thought Sheldon Smith might be a tenderfoot, too young to say &#8220;no&#8221; <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to his parents&#8217; request for legal assistance.\u00a0 But, his firm <\/font><a href=\"http:\/\/www.hollandhart.com\/peopleprofile.cfm?IDName=PersonID&amp;ID=5093\"><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">bio page<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> suggests <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that he&#8217;s in his mid-50s, and is a respected lawyer in his specialty of employee <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and executive benefits.\u00a0 (He&#8217;s worked as an adjunct faculty member at Denver Law <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">School and as a CLE presenter.)\u00a0 What I don&#8217;t understand is how his partners at the <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Rocky Mountain mega-firm of <\/font><a href=\"http:\/\/www.hollandhart.com\/\"><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Holland &amp; Hart<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">\u00a0could have let this matter get out of hand.<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">\u00a0<\/p>\n<p style=\"margin-right: 0px\">\u00a0<\/p>\n<div style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img loading=\"lazy\" decoding=\"async\" height=\"42\" alt=\"showerHead\" src=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/files\/2006\/11\/showHeadF.gif\" width=\"60\" \/>\u00a0\u00a0\u00a0\u00a0\u00a0Certainly, someone in H&amp;H&#8217;s <\/font><a class=\"PracAreaLink\" href=\"http:\/\/www.hollandhart.com\/practice.cfm?IDName=DeptID&amp;ID=100\"><font face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Real Estate Litigation<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> practice group could have told <\/font><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\">him how lame his claims are.\u00a0 Also, H&amp;H has an <a class=\"PracAreaLink\" href=\"http:\/\/www.hollandhart.com\/practice.cfm?IDName=DeptID&amp;ID=65\"><font color=\"#000000\">Alternative Dispute Resolution<\/font><\/a>\u00a0<\/font><\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">section that could have come up with\u00a0options <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">short of litigation and national infamy.\u00a0\u00a0 <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">More to the point, however, H&amp;H&#8217;s\u00a0<\/font><a class=\"PracAreaLink\" href=\"http:\/\/www.hollandhart.com\/practice.cfm?IDName=DeptID&amp;ID=54\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Water Rights<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">\u00a0<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">practice group boasts: &#8220;Our water <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">law practice involves commercial and other transac<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">tions that routinely require skilled <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">negotiations and first-rate administrative experience.&#8221;\u00a0\u00a0<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Couldn&#8217;t they, or <em>someone,<\/em> at H&amp;H have stopped this silly lawsuit?\u00a0 I have a feeling <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">that somebody there just might be leaning on Sheldon Smith right now.\u00a0 I sure <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">hope so.<\/font><\/font><\/font><\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font face=\"Arial\" size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/p>\n<blockquote>\n<p dir=\"ltr\" style=\"margin-right: 0px\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" alt=\"tiny check\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" \/> Once again, I&#8217;m learning legal practice tips too late.\u00a0 Forget about\u00a0<\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">noisy showers.\u00a0 When I moved into my first condo, in Alexandria, <\/font><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\">VA, two years out of law school, I could hear love-making from <em>three <\/em><\/font><\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">other condo units (above, below, and on the otherside of my bedroom <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">wall).\u00a0 Talk about keeping a lonely guy up.\u00a0 I wonder if H&amp;H had a D.C. <\/font><font face=\"Geneva,Arial,Sans-Serif\"
