{"id":4397,"date":"2006-02-22T19:16:31","date_gmt":"2006-02-22T23:16:31","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2006\/02\/22\/the-arkansas-bar-irks-me\/"},"modified":"2011-08-05T14:54:08","modified_gmt":"2011-08-05T18:54:08","slug":"the-arkansas-bar-irks-me","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2006\/02\/22\/the-arkansas-bar-irks-me\/","title":{"rendered":"the Arkansas Bar irks me"},"content":{"rendered":"<p><a name='a6067'><\/a><\/p>\n<blockquote><p>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Later this evening, I will post on the topic of our implicit attitudes and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">biases.&nbsp; First, though, I want to mention one very ex<\/FONT><FONT face=\"Arial\" size=\"2\">plicit attitude\/bias <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">that I have: I do not respect bar associations that put <\/FONT><FONT face=\"Arial\" size=\"2\">the interests of the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">lawyers before those of clients (see <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3744\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">bar &amp; guild<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">) &#8212; <\/FONT><FONT face=\"Arial\" size=\"2\">especially when lawyers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">are merely being asked to give clients information <\/FONT><FONT face=\"Arial\" size=\"2\">that is important to their <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">selection of counsel.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/100DollarBill.gif\" alt=\"100DollarBill\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Today, my bad attitude goes <\/FONT><FONT face=\"Arial\" size=\"2\">out to the <A href=\"http:\/\/www.arkbar.com\/index.html\">Arkansas Bar Association<\/A>. Why?<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Via <\/FONT><A href=\"http:\/\/cowgill.blogs.com\/legalethics\/2006\/02\/arkansas_bar_re.html\"><EM><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Ben Cowgill<\/FONT><\/EM><\/A><FONT face=\"Arial\" size=\"2\">, I learned that the Arkansas Bar&#8217;s House of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Delgates voted by a two-to-one margin to reject a <A href=\"http:\/\/www.arkbar.com\/whats_new\/new_LIABILITY_INSURANCE.html\">proposed <\/A><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">rule requiring&nbsp;lawyers in active practice to certify <\/FONT><FONT face=\"Arial\" size=\"2\">whether <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">they <\/FONT><FONT face=\"Arial\" size=\"2\">carry professional liability insurance.&nbsp; As Ben reported: <\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">The proposal had been drafted by the Bar&#8217;s Profession-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">alism Task Force and had received a strong endorsement <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">from the Bar&#8217;s Board of Governors.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Arkansas is the first state that has rejected the concept <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">of mandatory reporting of professional liability insurance <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">since the ABA recommended a <A href=\"http:\/\/www.abanet.org\/cpr\/clientpro\/Model_Rule_InsuranceDisclosure.pdf\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Model Court Rule<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;on Insur-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">ance Disclosure,&nbsp;in August of 2004.<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">The rejected rule is a weak form of disclosure &#8212; made to the Court <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">and not directly to clients.&nbsp; Ben lists eleven states that now require <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">disclosure along with annual registration statements: AZ, DE, IL, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">KS, MI, NE, NV, NM, NC, VA and WV.&nbsp; There are also five states <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">requiring notification of clients: AK, NH, OH, PA and SD.&nbsp; In addi-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">tion, as Ben notes in his comprehensive review, &#8220;<FONT face=\"Arial\" size=\"2\">Oregon is still the <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">only state which requires all members of the Bar to maintain profes-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><FONT face=\"Arial\" size=\"2\">sional liability insurance.&#8221;&nbsp; Find state-by-state details from the ABA <\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><A href=\"http:\/\/www.abanet.org\/cpr\/clientpro\/malprac_disc_chart.pdf\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">here<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">.<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">We&#8217;ve long <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2003\/07\/18#a117\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">supported<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> mandatory disclosure to clients.&nbsp; Click <\/FONT><A href=\"http:\/\/www.halt.org\/about_halt\/press_releases\/2004\/pdf\/GA_Mandatory_Disclosure.pdf\"><FONT face=\"Arial\" size=\"2\">here<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> for <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">the submission of the legal reform group <\/FONT><A href=\"http:\/\/www.halt.org\/\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">HALT<\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> to the Georgia&nbsp;State <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Bar (Nov. 4, 2004), explaining the benefits of mandatory disclosure <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">rules, and the need for notifying each client or potential client. HALT <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">gives one statistic that would surely surprise most members of the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">public &#8212; and lawyers, too &#8212; the national average of lawyers who carry <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">professional liability insurance is 40%.&nbsp; It is no surprise that disclosure <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">rules have motivated many formerly &#8220;naked&#8221; lawyers to purchase pro-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">fessional liability <\/FONT><FONT face=\"Arial\" size=\"2\">insurance.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><EM><STRONG>p.s<\/STRONG><\/EM>.
