Day shouldn&#8217;t pass us by without our annual nod to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">the lawyer Abraham Lincoln.&nbsp; Two years ago, your Editor, in the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">post <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/12#a770\"><FONT color=\"#42aac8\">Fees and the Lawyer-Fiduciary<\/FONT><\/A>, said:<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/timemoneyabe.jpg\" alt=\"time money abe\" \/><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">I wonder how Abe Lincoln, Esq. would have defined the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">fiduciary duties of a lawyer when setting fees.&nbsp; I&#8217;m afraid <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">that many lawyers never consider fiduciary&nbsp;principles in <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">the context of fees.&nbsp; That oversight goes a long way toward <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">explaining how the legal profession managed to squander <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">the goodwill that was its legacy from honest Abraham <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Lincoln.&nbsp;&nbsp; <\/FONT><\/DIV><\/BLOCKQUOTE><FONT color=\"#42aac8\"><FONT color=\"#000000\"><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Similarly, we wonder how Lincoln would react to what we&#8217;ve called <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Arial\">the<EM>&nbsp;<\/EM><\/FONT><\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/04\/08#a3634\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\"><EM>&#8220;ethics aside&#8221;<\/EM><\/FONT><\/A><FONT size=\"2\"><FONT face=\"Arial\"><EM> approach<\/EM>&nbsp;of the gurus and&nbsp;cheerleaders of law firm <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">branding, marketing and alternative or value pricing.&nbsp; By equating the <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">legal profession with the making of widgets for marketing and pricing <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">purposes, and insisting that we have &#8220;<\/FONT><A href=\"http:\/\/thenonbillablehour.typepad.com\/nonbillable_hour\/2006\/02\/why_customer_no.html\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">customers, not clients<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">,&#8221; they <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">seem to forget the ethical and fiduciary duty lawyers have to fully inform <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\">the client <\/FONT><FONT size=\"2\">and to look out first for the client&#8217;s interests.&nbsp; <\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\"><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; price sensitivity<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">&nbsp;and let <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">us <\/FONT><FONT face=\"Arial\" size=\"2\">know what you <\/FONT><FONT face=\"Arial\" size=\"2\">think about lawyers who exploit the psychology of pricing, <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">leverage <\/FONT><FONT face=\"Arial\" size=\"2\">premium <\/FONT><FONT face=\"Arial\" size=\"2\">prices at the client&#8217;s most price insensitive moments, and <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">(after <\/FONT><FONT face=\"Arial\" size=\"2\">touting <\/FONT><FONT face=\"Arial\" size=\"2\">the glories of up-front pricing) manipulate Change Orders to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">achieve <\/FONT><FONT face=\"Arial\" size=\"2\">ever-higher &#8220;value pricing.&#8221;<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT size=\"2\"><FONT face=\"Arial\">&#8220;<EM>An exhorbitant fee should never be claimed<\/EM>.&#8221;<BR>&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <\/FONT><FONT face=\"Arial\" size=\"2\">Weblogging lawyers, and those considering starting a weblog,&nbsp;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">might want to consider the following quote <\/FONT><FONT face=\"Arial\" size=\"2\">from Abe Lincoln, taken from his <\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">1850 <\/FONT><A href=\"http:\/\/showcase.netins.net\/web\/creative\/lincoln\/speeches\/lawlect.htm\"><FONT face=\"Arial\" color=\"#000000\" size=\"2\">Notes for a Law Lecture<\/FONT><\/A><FONT face=\"Arial\" size=\"2\">.&nbsp; To modernize it, substitute &#8220;frequent weblog-<\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT size=\"+0\"><FONT face=\"Arial\" size=\"2\">ging,&#8221; for &#8220;extemporaneous speaking:&#8221;&nbsp; And yet there is not a more fatal error to <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">young lawyers than relying too much on speech-making.
