Garvan Murtha<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, Chief Judge of <\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the U.S. District Court, Vermont,&nbsp;seems far too lenient to lawyer-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">felons.&nbsp; We gave examples from two recent cases. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"1\">&nbsp;<img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/scalesv.gif\" alt=\"scales over\" \/><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Well, he&#8217;s done it again, in the Andrew J. <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3407\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Capoccia Debt Reduction<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">fraud case &#8212; giving a one-month sentence to Thomas J. Daly, who <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">was one of the three main actors in a scheme that has left thousands <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of clients with ruined financial histories&nbsp;and over $25 million in futile <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">claims for misappropriated monies by the Capoccia Law Centers of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Albany, N.Y., and&nbsp;(after Capoccia&#8217;s disbarment), its successor&nbsp;Law <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Centers of <EM>Consumer Protection<\/EM>, in Bennington, Vermont. <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The <\/FONT><A href=\"http:\/\/www.rutlandherald.com\/apps\/pbcs.dll\/article?AID=\/20060202\/NEWS\/602020381\/1002\/NEWS01\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Rutland Herald<\/FONT><\/EM><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&nbsp;reported yesterday (&#8220;Lawyer Admits Guilt in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Fraud,&#8221; Feb. 2, 2006):<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;A former lawyer for a bankrupt debt-reduction firm in Bennington <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">is heading for a month in federal prison on fraud and tax evasion <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">charges.&nbsp; &#8216;I am so sorry,&#8217; Thomas J. Daly, 44, of Bennington, told <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Judge J. Garvan Murtha on Wednesday in U.S. District Court in <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Rutland. &#8216;I did commit these crimes. I&#8217;m sorry for it&#8217;.&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8221; &#8216;You certainly played a role in the victimization of the people who <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">depended on you to do something for them'&#8221; Murtha told Daly . . <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;The judge then sentenced Daly to one month in prison followed <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">by three years of supervised release, with three months of that time <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to be served on house arrest. In addition, Daly was ordered to pay <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">$200,000 restitution.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; &#8220;emptypocketsS&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;In his plea agreement, Daly acknowledged that he accepted nearly <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">$200,000 in bonuses &#x2014; in addition to his $200,000 salary &#x2014; at a <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">time when clients were demanding refunds of at least $1 million and <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">creditors of the firm were seeking even more.&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;The money for the bonuses came from an escrow account and the <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">firm&#8217;s general accounts. According to federal prosecutors, Daly knew <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">or should have known that the firm was not capable of supporting those <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">payments, given that the firm had been embezzling client money to pay <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">its day-to-day expenses.&#8221;<\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">As with the sentencing of his disbarred co-conspirator <\/FONT><A href=\"http:\/\/www.boston.com\/news\/local\/vermont\/articles\/2005\/12\/29\/sinnott_sentenced_to_three_months_in_prison?mode=PF\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Howard Sinnott<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&nbsp;in<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">December, Daly&#8217;s role in this complicated, well-planned rip-off of consumers <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">who were trying to avoid bankruptcy (and the subsequent hiding of millions of <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">dollars sought by NYS and the federal government to compensate the victims <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and creditors), was blamed on a personal flaw.&nbsp;&nbsp;Here, Daly&#8217;s defense counsel&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">told the court&nbsp;&#8220;that his client&#8217;s life had been ravaged by alcoholism, contributing <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">greatly to his legal problems.&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">According to today&#8217;s <\/FONT><A href=\"http:\/\/timesunion.com\/AspStories\/story.asp?storyID=446715&amp;category=BUSINESS&amp;newsdate=2\/3\/2006\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Albany Times Union<\/FONT><\/EM><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, Andrew J. Capoccia the disbarred&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">mastermind of the debt reduction scheme (explained in a <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$3407\">prior post<\/A>), is expected&nbsp;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to be sentenced today by Judge Murtha. &nbsp;(&#8220;Capoccia faces sentencing today,&#8221; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Feb. 3, 2006).&nbsp; Although Capoccia, who was convicted after trial last year, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">could receive up to 20 years, Judge Murtha&#8217;s wrist-slaps to his co-conspirators <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">suggests we may see more &#8220;professional courtesy&#8221;
