They would then set <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">up a statewide system of assigned counsel to handle any conflicts.&#8221; <\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Last February, this <\/FONT><A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/02\/18#a3288\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">weblog voiced<\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> the opinion that &#8220;indigent defendants are far more likely <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to receive consistently competent representationin a system with fulltime public defenders <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">(with statewide monitoring and funding) than from situations that rely heavily on assigned <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">counsel.&nbsp;&nbsp;<SPAN> (And see, David Feige&#8217;s excellent Slate article &#8220;<A href=\"http:\/\/www.slate.com\/Default.aspx?id=2106248&amp;\"><FONT color=\"#000000\">Public Offenders<\/FONT><\/A>,&#8221; where he says <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\">that <SPAN>only<\/SPAN><SPAN>a comprehensive public defender system, not one relying heavily on <\/SPAN><SPAN>assigned counsel, <\/SPAN><\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">will provide adequate service.&nbsp;)&nbsp; <A href=\"http:\/\/www.abanet.org\/legalservices\/sclaid\/defender\/brokenpromise\/downloads\/ma.pdf\"><EM><FONT color=\"black\">Gideon&#8217;s Broken Promise<\/FONT><\/EM><\/A>, the ABA 2005 report on indigent <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">defense, states that national standards for indigent defense favor fulltime public defenders, <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">whenever the population and caseload can support them.<\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\"><\/FONT><\/SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The New York indigent defense &#8220;system&#8221; has been organized and funded on the county <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">level since <EM>Gideon v. Wainright<\/EM>.&nbsp; Many private attorneys count heavily on the assigned <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">counsel cases they received under this system and fought hard for a rate hike, finally&nbsp;<\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">passed in 2004, that brought fees long stuck at $25 to $75 per hour to $60 to $95 dollars&nbsp;<\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">per hour.&nbsp; It is somewhat ironic, but the impetus for this change is reaction of the sixty-two <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\"><FONT size=\"2\"><SPAN><SPAN>counties&nbsp;<\/SPAN><\/SPAN><SPAN><SPAN>to the rate hike.&nbsp; The <EM>TU<\/EM>&nbsp;reports that,&nbsp;without additional State funds to help pay <\/SPAN><\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">for the hike:<\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT><\/SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Arial\" size=\"2\">&#8220;emptypocketsS&#8221;<\/FONT>&nbsp;<\/SPAN><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><\/SPAN><\/SPAN><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;They opted instead to set up in-house offices, which were not subject to the <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">higher rates, to save money. the state&#8217;s 62 counties have established more than <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">122 individualized programs to defend the poor, with no cohesion, unified standards <\/FONT><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV dir=\"ltr\"><SPAN><SPAN><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">or consistent format, said Ray Kelly&#8230;.&#8221;<\/FONT><\/SPAN><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Indeed, just last week, the <\/FONT><A href=\"http:\/\/www.dailygazette.com\"><EM><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"2\">Schenectady Gazette<\/FONT><\/EM><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> reported that &#8220;Eighteen months after it <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">began operations, the Schenectady County&#8217;s Conflict Defender Office has helped save <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">taxpayers more than $100,000 in outside attorney fees, a review shows. (Jan. 29, 2006, <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">p. B2).<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Don&#8217;t be surprised if this trend spreads across the nation, as more and more assigned <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">counsel (who are in private practice)&nbsp;push for higher fees.&nbsp; The <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$1949\"><FONT color=\"black\">Bar Advocates<\/FONT><\/A> in Mass-<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">achusetts are clearly afraid that the fee hikes they coerced from the Legislature last year <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">may result in the establishment of public defender offices that will take away work they <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">consider to be &#8220;theirs.&#8221;&nbsp; Thus, they adamantly <A href=\"http:\/\/www.southcoasttoday.com\/daily\/07-05\/07-23-05\/a03lo142.htm\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"black\" size=\"2\"><STRONG>oppose<\/STRONG><\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> the hiring of more public defenders.<\/FONT><\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">(see our <A href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$4346\">prior post<\/A>)&nbsp; Perhaps, like auto workers, their organized successes may <\/FONT><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">prove to<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">be their undoing.&nbsp; <\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\">&nbsp;<\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the mountain moon&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp;&nbsp; <BR>gives the blossom thief<BR>light<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"1\">&nbsp; &nbsp;<\/FONT><A href=\"http:\/\/www.haikuguy.com\/issa.html\" rel=\"nofollow\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#ff0000\" size=\"1\"><STRONG>Issa<\/STRONG><\/FONT><\/A><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"1\">,<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"1\">&nbsp;&nbsp;&nbsp;&nbsp; translated by <\/FONT><A href=\"http:\/\/www.haikuguy.com\/aboutme.html\" rel=\"nofollow\"><FONT face=\"Geneva,Arial,Sans-Serif\" color=\"#000000\" size=\"1\"><STRONG>David G.
