Oregon<\/font><\/em><\/a><font face=\"Arial\" size=\"2\"> was the first time <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Chief Justice John Roberts has dissented to a Court decision.  The Chief <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">joined the <\/font><a href=\"http:\/\/www.scotusblog.com\/movabletype\/archives\/2006\/01\/court_takes_no.html\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">dissenting opinion<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> of Justice Scalia, and did not write separately. <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The case upheld an Oregon law that permits doctors to prescribe medica- <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\">tions<\/font> in certain assisted suicide situations.  [See <a href=\"http:\/\/www.nytimes.com\/2006\/01\/18\/national\/18oregon.html?ex=1295240400&amp;en=00e144f3292706d2&amp;ei=5090&amp;partner=rssuserland&amp;emc=rss\"><em><font color=\"black\">NYT<\/font><\/em><\/a>, &#8220;Fraught Issue, but <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font size=\"2\">Narrow Ruling in Oregon Suicide Case,&#8221; Jan. 18, 2006]<\/font><\/font><\/p>\n<p><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">We can&#8217;t know what was on Justice Roberts&#8217; mind, other than the issues <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">discussed by Justice Scalia.  Nonetheless, it&#8217;s impossible not to wonder <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">whether the following 2004 <a href=\"http:\/\/www.priestsforlife.org\/magisterium\/bishops\/04-07ratzingerommunion.htm\">statement<\/a> by then-Cardinal Joseph Ratzinger, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">who <\/font><font face=\"Arial\" size=\"2\">is now Pope Benedict XVI, played an important role: <\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">                                                                                      <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/Benedict16.gif\" alt=\"Benedict16\" \/><\/font><\/p>\n<blockquote><p>\n<font face=\"Arial\" size=\"2\">The Church teaches that abortion or euthanasia is a grave sin. <\/font><br \/>\n<font face=\"Arial\" size=\"2\">The Encyclical Letter Evangelium vitae, with reference to judicial <\/font><br \/>\n<font face=\"Arial\" size=\"2\">decisions or civil laws that authorise or promote abortion or euthanasia, <\/font><br \/>\n<font face=\"Arial\" size=\"2\">states that there is a &#8220;grave and clear obligation to oppose them by <\/font><br \/>\n<font face=\"Arial\" size=\"2\">conscientious objection. [&#8230;] In the case of an intrinsically unjust law, <\/font><br \/>\n<font face=\"Arial\" size=\"2\">such as a law permitting abortion or euthanasia, it is therefore never <\/font><br \/>\n<font face=\"Arial\" size=\"2\">licit to obey it, or to \u2018take part in a propoganda campaign in favour of <\/font><br \/>\n<font face=\"Arial\" size=\"2\">such a law or vote for it\u2019&#8221;. Christians have a &#8220;grave obligation <\/font><br \/>\n<font face=\"Arial\" size=\"2\">of conscience not to cooperate formally in practices which, even if <\/font><br \/>\n<font face=\"Arial\" size=\"2\">permitted by civil legislation, are contrary to God\u2019s law. Indeed, from <\/font><br \/>\n<font face=\"Arial\" size=\"2\">the moral standpoint, it is never licit to cooperate formally in evil. [&#8230;] <\/font><br \/>\n<font face=\"Arial\" size=\"2\">This cooperation can never be justified either by invoking respect for <\/font><br \/>\n<font face=\"Arial\" size=\"2\">the freedom of others or by appealing to the fact that civil law permits <\/font><br \/>\n<font face=\"Arial\" size=\"2\">it or requires it.&#8221;<\/font><\/p><\/blockquote>\n<p dir=\"ltr\"><font face=\"Arial\"><font size=\"2\">We have opined at this website that John Roberts appears to be a &#8220;<a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2005\/08\/01#a4443\">serious<\/a> <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font size=\"2\">Catholic&#8221; who would feel a moral obligation to act on the above statement, <\/font><\/font><\/p>\n<p dir=\"ltr\"><font size=\"-0\"><font face=\"Arial\" size=\"2\">which is directed at Catholics in public life.  [see our <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$4450\"><font color=\"#000000\" face=\"Arial\" size=\"2\">prior post<\/font><\/a><font face=\"Arial\" size=\"2\"> here]  <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/JohnRobertsPix.gif\" alt=\"JohnRobertsPix\" \/><\/font><\/p>\n<p dir=\"ltr\">&nbsp;<\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font size=\"2\">The Chief Justice joined the dissent of Justice Scalia (with concludes that the <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font size=\"2\">term <em>&#8220;<font face=\"CenturySchoolbook,Italic\">legitimate <\/font><\/em><\/font><\/font><font face=\"Arial\"><font face=\"CenturySchoolbook\" size=\"2\">medical <\/font><\/font><font face=\"Arial\"><font face=\"CenturySchoolbook\" size=\"2\">purpose . . . surely excludes the prescription of drugs <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\"><font face=\"CenturySchoolbook\" size=\"2\">to produce death&#8221;), <\/font><\/font><font face=\"Arial\"><font face=\"CenturySchoolbook\" size=\"2\">rather <\/font><\/font><font face=\"Arial\" size=\"2\">than <\/font><a href=\"http:\/\/scotus.ap.org\/scotus\/04-623p.zd1.pdf\"><font color=\"#000000\" face=\"Arial\" size=\"2\">Justice Thomas&#8217; dissent<\/font><\/a><font face=\"Arial\" size=\"2\"> (with its focus on the <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">inconsistency with <\/font><font face=\"Arial\" size=\"2\">the <em>Raich v. Gonzales<\/em> precedent, which struck down <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">California&#8217;s medical<\/font><font face=\"Arial\" size=\"2\"> marijuana <\/font><font face=\"Arial\" size=\"2\">laws).  That at least suggests that John Roberts <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">had moral issues on his mind more than statutory construction and <em>stare <\/em><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\"><em>decisis<\/em>.  (Those same priorities might also be on Steve <a href=\"http:\/\/www.professorbainbridge.com\/2006\/01\/im_confused.html\"><font color=\"black\">Bainbridge&#8217;s mind<\/font><\/a>, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">as well as the gang at <em><a href=\"http:\/\/www.mirrorofjustice.com\/mirrorofjustice\/2006\/01\/the_oregon_case.html\"><font color=\"black\">Mirror of Justice<\/font><\/a><\/em>.)<\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\"><font color=\"red\"><em><strong>update<\/strong><\/em> <\/font><font color=\"black\">(Jan. 19, 2006)<\/font>: Robert Tsai offers his take on the Roberts&#8217; <\/font><\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">DIssentat <em><a href=\"http:\/\/www.concurringopinions.com\/archives\/2006\/01\/hail_to_the_new.html\"><font color=\"black\">Concurring Opinions<\/font><\/a><\/em> (Jan. 18, 2006), including that <\/font><\/p>\n<blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;He, like Scalia, is willing to read Congress&#8217; enumerated <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">powers broadly (and the core of state&#8217;s rights narrowly in <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">advance of national interests)&#8211;even when the strongest <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">interest appears to be in cultivating moral standards. This <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">is bad news forproponents of interstitial federalism.&#8221; [&#8220;Hail <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to the (New) Chief: Death With Dignity &#8212; Part III&#8221;]<\/font><\/p>\n<\/blockquote>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><a href=\"http:\/\/blog.reidreport.com\/2006\/01\/roberts-watch.html\">Reid Report<\/a> suggests we &#8220;Recall that during his hearings, Roberts <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">demurred on the &#8216;right to die&#8217; issue.&#8221;  Also, <a href=\"http:\/\/talkleft.com\/new_archives\/013739.html\"><em>TalkLeft<\/em> gathers<\/a> editorial <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">responses from the press (&#8220;Pro-Life Groups to Urge &#8216;John Ashcroft, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">MD Law&#8217;,&#8221; Jan. 18, 2006). And, <em>Prof. <\/em><a href=\"http:\/\/www.professorbainbridge.com\/2006\/01\/scalia_scuttles.html\"><em>Bainbridge<\/em> frets<\/a> that &#8220;Scalia <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">Scuttles Federalism&#8221; &#8212; and it &#8220;no longer seems possible, however, <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">to believe that he is developing a coherent conservative jurisprudence.&#8221;<\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">That suggests that (a) Steve may not be particularly in sync with <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">Scalia&#8217;s <\/font><font face=\"Arial\" size=\"2\">&#8220;public morality&#8221; position, and (b) Steve has the untenable <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">notion that there can be a monolithic &#8220;conservative jurisprudence&#8221; <\/font><\/p>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">and that it will hold <em>all<\/em> the anwers to every judicial decision. <\/font><\/p>\n<\/blockquote>\n<blockquote>\n<blockquote>\n<blockquote>\n<blockquote>\n<blockquote><\/blockquote>\n<p dir=\"ltr\"><font face=\"Arial\" size=\"2\">processional<\/font><\/p>\n<p
