{"id":4319,"date":"2004-04-19T13:30:41","date_gmt":"2004-04-19T17:30:41","guid":{"rendered":"http:\/\/blogs.law.harvard.edu\/formerlyknownas\/2004\/04\/19\/some-monday-inspiration-on-co"},"modified":"2011-08-05T14:58:51","modified_gmt":"2011-08-05T18:58:51","slug":"some-monday-inspiration-on-courts-fairness-liberty","status":"publish","type":"post","link":"https:\/\/archive.blogs.harvard.edu\/ethicalesq\/2004\/04\/19\/some-monday-inspiration-on-courts-fairness-liberty\/","title":{"rendered":"Some Monday Inspiration (on courts, fairness, liberty)"},"content":{"rendered":"<p><a name='a1285'><\/a><\/p>\n<p><FONT face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Yesterday evening, I was lucky enough to find an inspiring&nbsp;speech posted on the <\/FONT><A href=\"http:\/\/www.selfhelpsupport.org\/index.cfm\"><FONT face=\"Arial\" size=\"2\"><FONT color=\"black\"><EM>SelfHelpSupport<\/EM>.org<\/FONT><\/FONT><\/A><FONT face=\"Arial\" size=\"2\"> website.&nbsp; It&#8217;s called <\/FONT><FONT face=\"Arial\" size=\"2\"><A href=\"http:\/\/hennepin.timberlakepublishing.com\/article.asp?article=780&amp;paper=1&amp;cat=147\"><EM>A Court and a Judiciary As Good As its Promise<\/EM><\/A><\/FONT><FONT face=\"Arial\" size=\"2\">, and was given by Chief Judge <A href=\"http:\/\/www.courts.state.mn.us\/districts\/fourth\/\">Kevin S. Burke<\/A> of Minneapolis, MN,&nbsp;upon acceptance of the William Rehnquist Award in November, 2003.&nbsp; Judge Burke has gleaned wisdom from some great Americans, and woven it into a plea that judges and lawyers&nbsp;use &#8220;the decisions we make day in and day&#8221;&nbsp;to &#8220;affirm the public&#x2019;s faith in the strength of democracy.&#8221;<\/FONT><\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/gavelneg.jpg\" alt=\"gavel neg\" \/>&nbsp; Judge Burke asks for feedback on the speech, which&nbsp;deserves to be read in full&nbsp;(as do many of the sources cited).&nbsp; Here are some key points in the speech:<\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;Today the <STRONG>dissatisfaction with the administration of justice<\/STRONG> is at a level which none of us should tolerate or accept for it <STRONG>threatens our democracy<\/STRONG> as much or more than any terrorist.&#8221;<\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">Citing, Roscoe Pound&#8217;s <\/FONT><A href=\"http:\/\/64.233.161.104\/search?q=cache:E2XuaWsTbaEJ:www.law.du.edu\/sterling\/Content\/ALH\/pound.pdf+Pound+%2B%E2%80%9CThe+Causes+of+Popular+Dissatisfaction+with+the+Administration+of+Justice%E2%80%9D&amp;hl=en&amp;ie=UTF-8\"><FONT face=\"Arial\" size=\"2\"><EM>The Causes of Popular Dissatisfaction with the Administration of Justice<\/EM><\/FONT><\/A><FONT face=\"Arial\"><FONT size=\"2\">, Judge Burke notes that a major factor that contributed to this dissatisfaction&nbsp;<SPAN style=\"mso-spacerun: yes\">&nbsp;<\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><FONT face=\"Arial\" size=\"2\">&#8220;was political jealousy the other branches of government have with the judiciary due to the doctrine that courts have the final say in what the constitutional law is in our nation .<SPAN style=\"mso-spacerun: yes\">&nbsp;. . . <\/SPAN>Unfortunately, some political leaders are too&nbsp;easily prone to speak of judicial tyranny when there is disagreement with the outcome of a case.<\/FONT><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><SPAN style=\"FONT-SIZE: 12pt; <\/SPAN>The <STRONG>sporting theory of justice<\/STRONG> is the view that essentially the legal process is two modern gladiators in a pitted war, with the role of the judge to be simply a referee for the combat.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>Even today the sporting theory of justice is so rooted in the legal profession in that many of us take it for a fundamental legal tenet.&#8221;<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN><\/FONT><\/SPAN><\/DIV><br \/>\n<BLOCKQUOTE><br \/>\n<DIV><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><FONT face=\"Arial\" size=\"2\"><SPAN style=\"mso-spacerun: yes\">&#8220;<\/SPAN><STRONG>Pound argued that the sporting theory of justice disfigures our judicial administration at every point.<\/STRONG><SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>It leads the most conscientious judge to feel that he or she is merely to decide the contest, as attorneys present it, according to the rules of the game, and not to search independently for truth and justice.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>It leads attorneys to forget that they are officers of the court and to deal with the rules of law and procedure exactly as the professional football coach deals with the rules of the sport.&#8221; <\/FONT><\/SPAN><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><FONT face=\"Arial\" size=\"2\">&#8220;We need to maintain perspective. <\/FONT><\/SPAN><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><FONT face=\"Arial\" size=\"2\">Our nation has always been critical of the judiciary.&#8221;<\/FONT><SPAN style=\"mso-spacerun: yes\"><FONT face=\"Arial\"><FONT size=\"2\">&nbsp; [Burke gives examples such as impeachment movements against Chief&nbsp;Justices Marshall and Warren, billboards in the 1970&#8217;s against Justice William Douglas, and&nbsp;Teddy Roosevelt&#8217;s claim a banana had more backbone than Oliver Wendall Holmes.]&nbsp; <\/FONT><\/FONT><\/SPAN><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; &#8220;A factor that contributes to our generation&#x2019;s cause of popular dissatisfaction with the administration of justice is the way we conduct public debate on the issues of our time.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN><STRONG>Regrettably too often the current method of policy disagreement is to take the other guy&#x2019;s idea, mischaracterize it and announce your profound disagreement and outrage<\/STRONG>.&#8221;<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN><\/FONT><\/FONT><\/SPAN><\/SPAN><\/SPAN><\/DIV><br \/>\n<DIV><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><SPAN style=\"mso-spacerun: yes\"><SPAN style=\"mso-spacerun: yes\"><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"black\">In his <A href=\"http:\/\/www.criminaljustice.org\/public.nsf\/ENews\/2002e67?opendocument\">The Spirit of Liberty<\/A> speech in 1944, &#8220;<A href=\"www.encyclopedia.com\/html\/h\/hand-l1ea.asp\">Learned Hand<\/A> articulated a vision of justice and liberty that &#8212; despite our healthy and legitimate differences about how justice should be delivered &#8212; calls to mind some of our highest aspirations.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>On <\/SPAN><SPAN style=\"black\">May 21, 1944<\/SPAN><SPAN style=\"black\">, when the world faced many of the same kinds of challenges we face today, he asked: <SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><SPAN style=\"mso-spacerun: yes\"><SPAN style=\"mso-spacerun: yes\"><SPAN style=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">What, then, is the spirit of liberty? I cannot define it; I can only tell you my own faith:&nbsp;<\/FONT><\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/FONT><\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN>&nbsp;<\/DIV><br \/>\n<UL><br \/>\n<LI><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; <\/FONT><\/SPAN><\/SPAN><\/SPAN><\/SPAN><\/SPAN><br \/>\n<LI><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><SPAN style=\"FONT-SIZE: 12pt; FONT-FAMILY: 'Times New Roman'; mso-fareast-font-family: 'Times New Roman'; mso-fareast-language: EN-US; mso-ansi-language: EN-US; mso-bidi-language: AR-SA\"><SPAN style=\"mso-spacerun: yes\"><SPAN style=\"mso-spacerun: yes\"><SPAN style=\"black\"><SPAN style=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">The spirit of liberty is the spirit which weighs their interests alongside its own without bias.'&#8221; <\/FONT><\/FONT><\/SPAN><\/SPAN><\/LI><\/UL><br \/>\n<DIV><SPAN style=\"black\"><FONT face=\"Arial\"><FONT size=\"2\">&#8220;Hand tried to tap the powers we<I> bring to<\/I> <I>the bench<\/I>, not just those that are <I>attributed to us on the bench<\/I>.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>If judges and lawyers are &#8216;not too sure we&#8217;re right&#8217; we can be far more creative.&#8221; <\/FONT><\/FONT><\/SPAN><\/DIV><br \/>\n<DIV><SPAN style=\"black\"><\/SPAN>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"black\">&#8220;<\/SPAN><SPAN style=\"black\">We can move away from the sporting theory of justice.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>Instead, <STRONG>whether we are judges, lawyers, or administrators, we must move from recycling problems toward resolving them with the best thinking of the courts and communities<\/STRONG>.<SPAN style=\"mso-spacerun: yes\">&nbsp;. . . <\/SPAN>The courts of the future require partnerships with the other helping professions and the public at large.&#8221;<\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"black\"><\/SPAN><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\">&#8220;Today more than ever we must model our behavior and our debate of the issues that face the courts so that the other branches learn from our example.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>In the relationship judges have with court administrators and employees, we must remember we were appointed, perhaps elected, but never anointed.&#8221;<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><SPAN style=\"mso-spacerun: yes\"><\/SPAN><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/scalesrichpoor.jpg\" alt=\"scales rich poor\" \/> &#8220;Courts cannot be satisfied with being quick.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN><STRONG>Nor can we be satisfied with being clever<\/STRONG>.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>We must strive to be fully just to every person who leaves the courthouse.<SPAN style=\"mso-spacerun: yes\">&nbsp;. . . <\/SPAN>To address the popular dissatisfaction with the administration of justice, courts and judges <STRONG>must measure and be accountable for the fairness of our actions<\/STRONG>.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN><\/FONT><\/FONT><\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"mso-spacerun: yes\"><\/SPAN><\/FONT><\/FONT>&nbsp;<\/DIV><br \/>\n<DIV><FONT face=\"Arial\"><FONT size=\"2\"><SPAN style=\"mso-spacerun: yes\"><\/SPAN><\/FONT><\/FONT><FONT face=\"Arial\"><FONT size=\"2\">&#8220;Most importantly, we need to directly confront the notion that although judges at every level must be neutral &#x2013; <STRONG>neutrality does not dictate that we mask that we care<\/STRONG>.<SPAN style=\"mso-spacerun: yes\">&nbsp; <\/SPAN>Litigants and the community must know that the judges of our country care about them as individuals.&#8221;<\/FONT><\/FONT><\/DIV><\/BLOCKQUOTE><br \/>\n<DIV dir=\"ltr\"><FONT face=\"Arial\" size=\"2\">Lots of good ideas &#8212; but they&#8217;re <STRONG>useless if we don&#8217;t put them into practice<\/STRONG>, into the practice of law and judging.<\/FONT><\/DIV><br \/>\n<UL><br \/>\n<LI><br \/>\n<DIV><FONT face=\"Arial\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Back in December 2002, <A href=\"http:\/\/www.armedliberal.com\/archives\/000501.html\">Armed Liberal<\/A>&nbsp;wrote about the&nbsp;Learned&nbsp;Hand speech on liberty: <\/FONT><FONT face=\"Arial\" size=\"2\">&nbsp;&#8220;But the key phrase to me is: <I>The spirit of liberty is the spirit which is not too sure that it is right&#8230;&#8217;<\/I> That&#8217;s something I&#8217;m working on pretty hard, and something I look for and care about in other commentators.&#8221;&nbsp;
