Blawg Review Ed"},"content":{"rendered":"<p><a title=\"a5744\" name=\"a5744\"><\/a><\/p>\n<blockquote><p> <font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;<em>Ed<\/em>&#8221; the mysterious Editor of <\/font><a href=\"http:\/\/www.blawgreview.com\/\"><em><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Blawg Review<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> and <\/font><a href=\"http:\/\/kevin.lexblog.com\/cat-about-kevin.html\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Kevin O&#8217; Keefe<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, founder <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of <\/font><a href=\"http:\/\/kevin.lexblog.com\/\"><em><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">LexBlog<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, are having a public Blog Fight.  The tiff started when Ed asked <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Kev how <\/font><a href=\"http:\/\/www.pubsub.com\/lists\/law.php\"><em><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The Law List<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> (which O&#8217;Keefe edits) works, but Kev wanted to know <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">who Ed was and wrote a piece <a href=\"http:\/\/kevin.lexblog.com\/thoughts-and-happenings-1741-blawg-review-why-afraid-to-disclose-identity.html\">decrying anonymous<\/a> lawyer webloggers and <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">objecting to the word &#8220;blawg.&#8221;  Ed then posted about <\/font><a href=\"http:\/\/blawgreview.blogspot.com\/2006\/01\/blog-fight-club.html\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">their Fight<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> [and got <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">some <\/font><a href=\"http:\/\/techlawadvisor.com\/blog\/2006\/01\/04\/blawger_anonymity_not_allowed.html\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">moral support<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> from his <em>BR<\/em> co-editor Kevin J. Heller], Kev O. wrote <\/font><br \/>\n<a href=\"http:\/\/kevin.lexblog.com\/thoughts-and-happenings-1753-lawyer-blog-fight-should-anyone-really-care.html\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">again<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, and Ed both <\/font><a href=\"http:\/\/blawgreview.blogspot.com\/2006\/01\/old-lawyers-have-web-logs.html\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">defended<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> using &#8220;blawg&#8221; and announced that several <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">weblogging personalities [including yours truly] are <\/font><a href=\"http:\/\/blawgreview.blogspot.com\/2006\/01\/not-editor-of-blawg-review.html\"><font color=\"#000000\"><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\"><em>not<\/em> Ed<\/font><\/font><\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">.   <\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">         <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pennysm.gif\" alt=\"penny sm\" \/> <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/pennysm.gif\" alt=\"penny sm\" \/><\/font><\/p>\n<blockquote><p> <font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">As we enter the era of 39-cent stamps, today, I&#8217;d like to put in<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">my two cents on each issue.  First, I should mention that Ed <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">and I have had a congenial correspondence over the past half-<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">year, and he&#8217;s never been disagreeable, even when we disagree.   <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">It&#8217;s been quite <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/19#a1293\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">a while<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> since Kevin <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/21#a852\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">O&#8217;Keefe and I<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> have correspon-<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">ded; we have <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/01#a668\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">often<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/14#a1221\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">disagreed<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, and it was <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/12#a1200\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">not always<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> pleasant.  <\/font><\/p>\n<p><font face=\"Arial\"><font size=\"2\"><em><font color=\"red\"><strong>update<\/strong><\/font><\/em>: In an <\/font><a href=\"http:\/\/blawgreview.blogspot.com\/2006\/01\/open-letter-to-giacalone.html\"><font color=\"black\" size=\"2\">Open Letter to Giacalone<\/font><\/a>, this morning, <em>Ed<\/em><\/font><br \/>\n<font face=\"Arial\">says &#8220;There was <em>never<\/em> a fight in my mind.,&#8221;<font size=\"2\"> and that Giacalone <\/font><\/font><br \/>\n<font face=\"Arial\"><font size=\"2\">got the <\/font><\/font><font face=\"Arial\" size=\"2\">timeline and background facts wrong.  The Open Letter <\/font><br \/>\n<font face=\"Arial\" size=\"2\">left <\/font><font face=\"Arial\" size=\"2\">me unclear of the circumstances, facts and motives. How-<\/font><br \/>\n<font face=\"Arial\" size=\"2\">ever, <\/font><font face=\"Arial\" size=\"2\">I&#8217;m pretty sure that &#8212; whether there is a fight or just a debate <\/font><br \/>\n<font face=\"Arial\" size=\"2\">or a misunderstanding &#8212; the primary issues (weblog anonymity <\/font><br \/>\n<font face=\"Arial\" size=\"2\">and use of the word &#8220;blawg&#8221;) still separate Kevin and Ed and <\/font><br \/>\n<font face=\"Arial\" size=\"2\">are appropriate for my commentary.  They both used the words <\/font><br \/>\n<font face=\"Arial\" size=\"2\">&#8220;Blog Fight&#8221; in their headlines but, as I conclude below, they <\/font><br \/>\n<font face=\"Arial\" size=\"2\">aren&#8217;t really all that far apart.  Unless, of course, they are.  <\/font><br \/>\n<font face=\"Arial\" size=\"2\"><font color=\"red\"><em>5 PM update<\/em><\/font>: &#8220;Ed&#8221; has helped clarify the tone of his Open Letter, <\/font><br \/>\n<font face=\"Arial\" size=\"2\">by adding an appropriately lighthearted emoticon, with a link to <\/font><br \/>\n<font face=\"Arial\" size=\"2\">&#8220;<a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2006\/01\/08#a5737\"><font color=\"black\">tongue-in-cheek<\/font><\/a>&#8220;.  Thanks, Ednonymous One.<\/font><\/p><\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>  Let&#8217;s start with the easy point:  Ed is absolutely correct: he is not   <img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/profyabutsmallflip.jpg\" alt=\"prof yabut small flip\" \/>  <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">David Giacalone.  I shall add for emphasis, that he is not David&#8217;s twin,<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Arthur, nor any of his f\/k\/a alter egoes (Prof. Yabut, ethical Esq, dagosan, <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">haikuEsq, Joe Cliente, etc.).  David Giacalone barely has the energy to <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">keep this site going; you would not for a moment find him taking on a <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">job like Editor of <em>Blawg Review<\/em> &#8212; and, certainly, not without getting the <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">glory that comes with it.<\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Next, I do agree with Kevin O&#8217;Keefe that there often are times when <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">knowing the identity of the human being behind a weblog is very important <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">for the weblog&#8217;s integrity and the value of its information and opinion (see, <em>e.g.<\/em>, <\/font><br \/>\n<a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/04\/14#a1221\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Selling the Perception of Expertise<\/font><\/a> &amp; <a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/2004\/02\/01#a668\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Ghosts Will Kill the Weblog Community<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">).<\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;MirrorG&#8221;  However, I do not find it disconcerting that <em>Ed<\/em> wishes to stay anonymous &#8212; <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">especially after being reassured that he is not a cover for Evan, Mike or Kevin H., <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the <em>Blawg Review<\/em> co-editors.  It&#8217;s not very difficult to imagine perfectly good <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">business, professional or personal reasons that the Editor of Blawg Review <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">might want to remain anonymous.  <\/font><\/p>\n<blockquote>\n<blockquote><p> <font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/> Each reader has every right to discount the value<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of <em>Blawg Review<\/em>, or its Awards, in the content of <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\"><em>Ed<\/em>&#8216;s anonymity.  I&#8217;m sure he&#8217;s taken that reaction <\/font><\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">into account in choosing to remain unnamed. <\/font><\/p><\/blockquote>\n<\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>  On the next issue, count me among those who has no idea how to use  <img decoding=\"async\" src=\"http:\/\/media-cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/ekgchartG.jpg\" alt=\"ekgG\" \/>  <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">the &#8220;information&#8221; available at PubSub&#8217;s <\/font><a href=\"http:\/\/www.pubsub.com\/lists\/law.php\"><em><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">The Law List<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\">.  I <em>learned about The Law <\/em><\/font><\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\"><font size=\"2\"><em>List <\/em>from &#8220;Ed&#8221; &#8212; who apparently recommend it to many fellow law webloggers.  <\/font><\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Therefore, it&#8217;s ironic that an attempt by Ed to find out more information about the <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">service, after people such as myself told him it was confusing, annoyed Kevin so <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">much. Makes me wonder (as in some of our prior dealings) why Kevin is so darn <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">defensive.<\/font><\/p>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><img decoding=\"async\" src=\"http:\/\/cyber.law.harvard.edu\/blogs\/static\/ethicalesq\/tinycheck.gif\" alt=\"tiny check\" \/>  Except for his tone of derision, Kevin and I are rather compatible on the <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">final topic &#8212; use of the word &#8220;blawg.&#8221;  Despite <font color=\"black\">its <\/font><\/font><a href=\"http:\/\/www.samizdata.net\/blog\/glossary_archives\/002511.html\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">origin<\/font><\/a><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> from the punning and <\/font><br \/>\n<font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">cunning mind of <\/font><a href=\"http:\/\/bgbg.blogspot.com\/\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Denise Howell<\/font><\/a><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, I have long believed that we all would have been <\/font><br \/>\n<font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">better off without the creation and spread of this confusing, odd-sounding mutation <\/font><br \/>\n<font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">on the <\/font><a href=\"http:\/\/blogs.law.harvard.edu\/ethicalesq\/stories\/storyReader$2828\"><font color=\"black\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">ugly little word<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><font color=\"black\"> &#8220;blog&#8221;.  This is a topic that<\/font> deserves its own post, but I want  <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">to make two quick points:  First, I wish I had lived up to my public promise, made <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Sept. 30, 2003, in a piece for BloggerCon2003, called &#8220;<\/font><a href=\"http:\/\/blogs.law.harvard.edu\/bloggerCon\/discuss\/msgReader$545?mode=topic\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Jargon Builds Walls<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> Not <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Bridges:&#8221;<\/font><\/p>\n<blockquote><p> <em><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;Blawg&#8221; is, as of today, purged from my dictionary, <\/font><\/em><br \/>\n<em><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">glossary and ken.  <\/font><\/em><\/p><\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;BoxerSignN&#8221;  Second, lawyer weblog owners and editors who are using the term &#8220;weblawg&#8221;<\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">shouldn&#8217;t take personally Kevin&#8217;s statement that it is &#8220;<\/font><a href=\"http:\/\/kevin.lexblog.com\/thoughts-and-happenings-1541-blawgs-should-be-banned.html\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">just plain stupid<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8221; to do so <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">(<em>Real <\/em><\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"><em>Lawyers Have Blogs<\/em>, Oct. 25, 2005).  You see, on January, 5, 2004, at the <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">very start <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of his <\/font><a href=\"http:\/\/kevinokeefe.typepad.com\/imarketinglawyers\/2004\/01\/blog_setup_publ.html\"><em><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Real Lawyers Have Blogs<\/font><\/em><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> weblog, <\/font><a href=\"http:\/\/www.kevinokeefe.com\/imarketinglawyers\/2004\/01\/blogs_nielsenne.html\"><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">Kevin placed<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\"> this description <\/font><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">of himself in his <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">template, at the foot of each page:<\/font><\/p>\n<blockquote><p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">&#8220;Kevin has now founded a company providing a turnkey <\/font><br \/>\n<a href=\"http:\/\/lexblog.com\/\"><font color=\"#000000\"><font size=\"2\"><font face=\"Geneva,Arial,Sans-Serif\"><em>blawgs<\/em> solution<\/font><\/font><\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">, by LexBlog, Inc., the leading provider of <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">law blogs, <em>blawgs<\/em> or weblogs for lawyers and attorneys <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">desiring to use a legal blog, <em>blawg<\/em> or weblog for effective <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">lawyer and attorney Internet Web site marketing and started <\/font><br \/>\n<font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">a <\/font><a href=\"http:\/\/kevin.lexblog.com\/\"><font color=\"#000000\" face=\"Geneva,Arial,Sans-Serif\" size=\"2\">new Real Lawyers :: Have Blogs blog<\/font><\/a><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">.&#8221; [emphases added]<\/font><\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p><font face=\"Geneva,Arial,Sans-Serif\" size=\"2\">If Kevin can come this far, there&#8217;s clearly hope for all of us.
